ASSESSOR'S PARCEL NO.
Pursuant to the provisions of the zoning -Ordinance of the County of
Butte and the special conditions set forth below: Robert Conway is
hereby granted a Use Permit in accordance with application filed:
12/12/88 to allow the expansion of Lime Saddle Mobile Home Estates to
the north by sixty acres and to use such property as indicated by the
development plan as a leachfield to dispose of waste water on property
zoned R -C, U, S -H, located on the west side of Pentz Road across from
Kunkle Reservoir, south of Paradise.
1. Failure to comply with the conditions specified herein as
the basis for approval of application and issuance.of
-Permit, constitutes cause for the revocation of said permit
in accordance with the procedures set forth in the Butte
County zoning Enabling Ordinance.
2. Unless otherwise provided for in a condition to a use
permit, all conditions must be completed by the permittee
within 12 months of the delivery of the countersigned permit
to the permittee:
3. If any use for which a use permit has been granted is not
established within one year of the date of receipt of the
countersigned permit by the permittee, the permit shall be
come null and void and reapplication shall be required to
establish the use.
SPECIAL CONDITIONS:
1. All areas disturbed by earthwork associated with the development
of leachfields should be re -vegetated with native forbs and
grasses, within six (6) months of disturbance.
2. No additional' access to Pentz Road other than the original plan
is allowable.
3. Provide scale plot map showing accurate location of all soil
exploration holes to the Environmental Health Department.
4. Owner will be required to submit percolation data on AP 55-31-05
from a licensed engineer or land surveyor to the Environmental
Health Department.
5. Reversion to acreage will be -required for two existing lots of
record.
6. Owner to prove to the Health Department's satisfaction, that
sufficient potable source capacity exists to meet maximum demand
requirements'.
7. If water source is located off-site, the owner will need to
supply pipe line easement. The width of said easement will be
sufficiently large enough to allow maintenance vehicles access to
site, and appurtenances, and cover actual sources of water.
S. Owner will be required to amend existing small community water
supply permit, to reflect all alternations, and additions. to the
existing system.
9. Sewage disposal plans to be engineered by registered sanitarian
or civil engineer.
10. Owner to supply Health Department with full set of sewage
disposal, drainage, water supply, utility, grading, site, and
landscape plans prior to receiving final approval.
Owner shall report to the Central Valley Regional Water Quality
Control Board, any material changes in the character, location,
or volume of discharge as per the original report of waste
discharge.
12. Area of shallow soil will need to be delineated and labeled
unsuitable for sewage disposal; otherwise, groundwater monitoring
stations will need to be installed in order to observe
groundwater conditions over the winter time.
13. A fire fighting water system and hydrants shall be installed to
the specifications of the Butte County Fire Department/California
Department of Forestry and Fire Protection, consolidated fire
protection.
14. Applicant must also comply with all other applicable State and
local statutes,.ordinances, and regulations.
I hereby declare under penalty of perjury that I have read the
foregoing conditions, that they are in fact the conditions which were
imposed upon the granting of this; use permit, and that I agree to
abide fully by said conditions.
