There are 54 lots in Mountain Oaks Estates. Each is bordered on all four sides by common area owned by the community. Between each lot the common areas vary from 10 feet to 40 feet or more. These lots are designated in the Mountain Oaks Estates Planned Unit Development maps as Lot A. It is my understanding that lands designated in Lot A were 1) designed for passage or occupancy of wildlife by the California Department of Fish and Game, or 2) were not suited as building sites due to geology, hydrology, utility corridors or access problems. The Mountain Oaks Declaration of Covenants, Conditions, and Restrictions (CC&Rs) as recorded May 25, 1995, indicate in Article VI, Section 1 that "No person other than the Association or its duly authorized agents shall construct, reconstruct, refinish, alter or maintain any improvement upon, or shall create any excavation or fill or change the natural or existing drainage of any portion of the Common Area. In addition, no person shall remove any tree, shrub or other vegetation from, or plant any tree, shrub, or other vegetation upon the Common Area without express approval of the Association." Article VII, Section 3 that "The Common Area shall be preserved as open space and used for recreational purposes and other purposes incidental and ancillary to the use of lots. Such use shall be limited to private use for aesthetic and recreations purposes ... No improvement, excavation or work which in any way alters the Common Area ... from its natural or existing state on the date such Common Area ... shall be made or done except by the Association and then only in strict compliance with the provisions of this declaration." Therefore, construction of a private -dwelling on the common area is both prevented by the original charter and by the CC&Rs. Lot #10 is separated from Lot #9 by a common area that is approximately 70 feet wide along Sunview Road and approximately 20 feet wide at the rear of the property. The common area between Lots #10 and #11 is 27 feet along Sunview Road and approximately 60 feet at the rear of the property.
