R Mays, Mike From: Mays, Mike Sent: Friday, October 07, 2005 8:49 AM To: 'Baldwin, Tim' Subject: AP 041-700-022 thru 025 Tim: All 4 parcels were created by 3 Gift Deeds recorded on February 29, 1972 (3 directly by deed, 1 by remainder). At that time, Butte County Code (Ordinance 1013) required that parcels be created with a 60' deeded access easement to a publicly maintained road. None of the 3 Gift Deeds, nor the deed of the 10 ac. parent parcel, contain the required access easements. Based solely on the information you provided, these parcels do not appear to have been created in compliance with Butte County Code. Therefore, staff would not approve these parcels for a development permit. An application for Legal Lot Determination should be made to the Planning Division of the Development Services Department ((530) 538-7601) for each parcel. A separate application must be made for each individual parcel. The application fee is approximately $2,400-$2,500 each. The certificate of compliance, or conditional certificate of compliance, is the result of the Legal Lot Determination application. The certificates would be conditioned to meet those requirements that were in effect at the date of the original subdivision (2/29/72). My guess would be that at a minimum you would be conditioned to: 1) Provide a 60' deeded access easement from each parcel to a publicly maintained road; 2) Provide two-way traversable access within that easement. Two- way traversable access is basically the ability to drive a two- wheel drive vehicle in and out in all weather conditions, barring snow. 3) Verify usable sewage disposal area; 4) Verify potable water; 5) Comply with zoning requirements for parcel size. Currently this parcel is zoned "U" (unclassified). You need to check with the Planning Division to determine what the zoning was in 1972. This may or may not be a complete list of conditions. These are the most common. However, keep in mind that each department reviews the application and will issue the conditions based upon their expertise.
