Fiberboard sheathing 4 -foot by 8 -foot (1219 mm by 2438 mm) panels not less than 1/2 inch (13 mm) thick applied vertically on studs spaced not over 16 inches (406 mm) on center when in- stalled in accordance with Section 2315.6 and Table 23 -H -J. 2320.11.2 Framing details. Bearing and exterior wall studs shall be capped with double top plates installed to provide overlapping at comers and at intersec- tions with other partitions. End joints in double top plates shall be offset at least 48 inches (2438 mm). EXCEPTION: A single top plate maybe used, provided the plate is adequately tied at joints, corners and intersecting walls by at least the equivalent of 3 -inch by &-inch (76 mm by 152 mm) by 0.036 -inch - thick (0.9 mm) galvanized steel that is nailed to each wall or segment of wall by six 8d nails or equivalent, provided the rafters, joists or trusses are centered over the studs with a tolerance of no more than 1 inch (25 mm). When bearing studs are spaced at 24 -inch (610 mm) intervals and top plates are less than two 2 -inch by 6 -inch (51 mm by 152 mm) or two 3 -inch by 4 -inch (76 mm by 102 mm) members and when the floor joists, floor trusses or roof trusses which they sup- port are spaced at more than 16 -inch (406 mm) intervals, such joists or trusses shall bear within 5 inches (127 mm) of the studs beneath or a third plate shall be installed. Interior nonbearing partitions may be capped with a single top plate installed to provide overlapping at corners and at intersec- tions with other walls and partitions. The plate shall be continu- ously tied at joints by solid blocking at least 16 inches (406 mm) in length and equal in size to the plate or by 1/8 -inch by 11/2 -inch (3.2 mm by 38 mm) metal ties with spliced sections fastened with two 16d nails on each side of the joint. Studs shall have full bearing on a plate or sill not less than 2 in- ches (51 mm) in thickness having a width not less than that of the wall studs. 2320.11.3 Bracing. Braced wall lines shall consist of braced wall panels w tc meet the requirements for location, type and amount of bracing specified in Table 23 -IV -C-1 and are in line or offset from each other by not more than 4 feet (1219 mm). Braced wall panels shall start at not more than 8 feet (2438 mm) from each end of a braced wall line. All braced wall panels shall be clearly 7. For Metho s 2, 3, 4, 6, 7 and 8, each braced panel must be at least 48 inches (1219 mm) in length, covering three stud spaces where studs are spaced 16 inches (406 mm) apart and covering two stud spaces where studs are spaced 24 inches (610 mm) apart. For Method 5, each braced wall panel must be at least 96 inches (2438 mm) in length when applied to one face of a braced wall panel and 48 inches (1219 mm) when applied to both faces. All vertical joints of panel sheathing shall occur over studs. Horizontal joints shall occur over blocking equal in size to the studding except where waived by the installation requirements for the specific sheathing materials. Braced wall panel sole plates shall be nailed to the floor framing and top plates shall be connected to the framing above in accord- ance with Table 23 -II -B-1. Sills shall be bolted to the foundation or slab in accordance with Section 1806.6. Where joists are per- pendicular to braced wall lines above, blocking shall be provided under and in line with the braced wall panels. 2320.11.4 Alternate braced wall panels. Any braced wall panel required by Section 2320.11.3 may be replaced by an alter- nate braced wall panel constructed in accordance with the follow- ing: 1. In one-story buildings, each panel shall have a length of not less than 2 feet 8 inches (813 mm) and a height of not more than 10 feet (3048 mm). Each panel shall be sheathed on one face with 3/8 -inch -minimum -thickness (9.5 mm) plywood sheathing nailed with 8d common or galvanized box nails in accordance with Table 23 -II -B-1 and blocked at all plywood edges. TWO anchor bolts installed in accordance with Section 1806.6, shall be provided in each panel. Anchor bolts shall be placed at panel quarter points. Each panel.end stud shall have a tie -down device fastened to the foundation, capable of providing an approved uplift capacity of not less than 1,800 pounds (816.5 kg). The panels shall be supported directly on a foundation or on floor framing supported directly on a foundation which is continu- ous across the entire length of the braced wall line. This founda- tion shall be reinforced with not less than one No. 4 bar top and bottom. 2. In the first story of two-story buildings, each braced wall panel shall be in accordance with Section 2320.11.4, Item 1, except that the plywood sheathing shall be provided on both faces, three anchor bolts shall be placed at one-fifth points, and tie -down device uplift capacity shall not be less than 3,000 pounds (1360.8 kg). 2320.11.5 Cripple walls. Foundation cripple walls shall be framed of studs not less in size than the studding above with a minimum length of 14 inches (356 mm), or shall be framed of sol- id blocking. When exceeding 4 feet (1219 mm) in height, such walls shall be framed of studs having the size required for an addi- tional story. Cripple walls having a stud height exceeding 14 inches (356 mm) shall be braced in accordance with Table 23 -IV -C-2. Solid blocking or wood structural panel sheathing may be used to brace cripple walls having a stud height of 14 inches (356 mm) or less. In Seismic Zone 4, Method 7 is not permitted for bracing any cripple wall studs. Spacing of boundary nailing for required wall bracing shall not exceed 6 inches (152 mm) on center along the foundation plate and the top plate of the cripple wall. Nail size, nail spacing for field nailing and more restrictive boundary nailing requirements shall be as required elsewhere in the code for the specific bracing mate- rial used. 2320.11.6 Headers. Headers and lintels shall conform to the re- quirements set forth in this paragraph and together with their sup- porting systems shall be designed to support the loads specified in this code. All openings 4 feet (1219 mm) wide or less in bearing walls shall be provided with headers consisting of either two pieces of 2 -inch (51 mm) framing lumber placed on edge and se- curely fastened together or 4 -inch (102 mm) lumber of equivalent cross section. All openings more than 4 feet (1219 mm) wide shall be provided with headers or lintels. Each end of a lintel or header shall have a length of bearing of not less than 11/2 inches (38 mm) for the full width of the lintel. 2320.11.7 Pipes in walls. Stud partitions containing plumbing, heating, or other pipes shall be so framed and the joists underneath so spaced as to give proper clearance for the piping. Where a parti- tion containing such piping runs parallel to the floor joists, the joists underneath such partitions shall be doubled and spaced to permit the passage of such pipes and shall be bridged. Where plumbing, beating or other pipes are placed in or partly in a parti- tion, necessitating the cutting of the soles or plates, a metal tie not less than 0.058 inch (1.47 mm) (16 galvanized gage) and I1/2 in- ches (38 mm) wide shall be fastened to each plate across and to each side of the opening with not less than six 16d nails. 2320.11.8 Bridging. Unless covered by interior or exterior wall coverings or sheathing meeting the minimum requirements of this code, all stud partitions or walls with studs having a height -to -least -thickness ratio exceeding 50 shall have bridging not less than 2 inches (51 mm) in thickness and of the same width as the studs fitted snugly and nailed thereto to provide adequate lateral support. 2320.11.9 Cutting and notching. In exterior walls and bearing partitions, any wood stud may be cut or notched to a depth not ex - 1-220 2001 CALIFORNIA BUILDING CODE ceeding 25 percent of its width. Cutting or notching of studs to a depth not greater than 40 percent of the width of the stud is per- mitted in nonbearing partitions supporting no loads other than the weight of the partition. 2320.11.10 Bored holes. A hole not greater in diameter than 40 percent of the stud width may be bored in any wood stud. Bored holes not greater than 60 percent of the width of the stud are per- mitted in nonbearing partitions or in any wall where each bored stud is doubled, provided not more than two such successive doubled studs are so bored. In no case shall the edge of the bored hole be nearer than 5/8 inch (16 mm) to the edge of the stud. Bored holes shall not be located at the same section of stud as a cut or notch. 2320.12 Roof and Ceiling Framing. 2320.12.1 General. The framing details required in this section apply to roofs having a minimum slope of 3 units vertical in 12 units horizontal (25% slope) or greater. When the roof slope is less than 3 units vertical in 12 units horizontal (25% slope), mem- bers supporting rafters and ceiling joists such as ridge board, hips and valleys shall be designed as beams. 2320.12.2 Spans. Allowable spans for ceiling joists shall be in accordance with Tables 23 -IV -J-3 and 23 -IV -J-4. Allowable spans for rafters shall be in accordance with Tables 23 -IV -R-1 through 23 -IV -R-12, where applicable. 2320.123 Framing. Rafters shall be framed directly opposite each other at the ridge. There shall be a ridge board at least 1 -inch (25 mm) nominal thickness at all ridges and not less in depth than the cut end of the rafter. At all valleys and hips there shall be a single valley or hip rafter not less than 2 -inch (51 mm) nominal thickness and not less in depth than the cut end of the rafter. 2320.12.4 Notches and holes. Notching at the ends of rafters or ceiling joists shall not exceed one fourth the depth. Notches in the top orbottom of the rafter or ceiling joist shall not exceed one sixth the depth and shall not be located in the middle one third of the span, except that a notch not exceeding one third of the depth is permitted in the top of the rafter or ceiling joist not further from the face of the support than the depth of the member. .Holes bored in rafters or ceiling joists shall not be within 2 in- ches (51 mm) of the top and bottom and their diameter shall not exceed one third the depth of the member. 2320.12.5 Framing around openings. Trimmer and header raf- ters shall be doubled, or of lumber of equivalent cross section, when the span of the header exceeds 4 feet (1219 mm). The ends of header rafters more than 6 feet (1829 mm) long shall be supported by framing anchors or rafter hangers unless bearing on a beam, partition or wall. 2320.12.6 Rafter ties. Rafters shall be nailed to adjacent ceiling joists to form a continuous tie between exterior walls when such joists are parallel to the rafters. Where not parallel, rafters shall be tied to 1 -inch by 4 -inch (25 mm by 102 mm) (nominal) mini- mum -size crossties. Rafter ties shall be spaced not more than 4 feet (1219 mm) on center. 2320.12.7 Purlins. Purlins to support roof loads may be in- stalled to reduce the span of rafters within allowable limits and shall be supported by struts to bearing walls. The maximum span of 2 -inch by 4 -inch (51 mm by 102 mm) purlins shall be 4 feet (1219 mm). The maximum span of the 2 -inch by 6 -inch (51 mm by 152 mm) purlin shall be 6 feet (1829 mm) but in no case shall the purlin be smaller than the supported rafter. Struts shall not be smaller than 2 -inch by 4 -inch (51 mm by 102 mm) members. This area is zoned for residential use only. The first three years and nine months of living here had been peaceful country bliss. In early 1995 the empty half acre lot next to us (2766 Alamo) was purchased by a couple. Construction of their new home began in March. The noises caused by the building of their house were nothing compared to the disturbances of what we endure today. Medical problems prevent me from working at this time, so I have been home and able to document information. The following is a chronological summary of our horrible ongoing experience: March 1995: We first meet our neighbor Jim Aguilar. My husband, Miles Williams, has a conversation with Mr. Aguilar. Mr. Aguilar mentions that he runs his own firewood business., At the time we think nothing of it. Weeks go by and we notice that the front of the lot is getting increasingly full of firewood. Everytime wood is dumped or loaded the noise is loud enough to wake us from a sound sleep. One Sunday at 6:00 AM, we are rudely awakened by the sound of firewood being thrown into the back of a truck. Miles unhappily goes next door to Mr. Aguilar and inquires if he is planning on running his business out of his home. Mr. Aguilar replies, "No I'm not. This is only temporary. My wife would kill me if I did". So we let it pass. August 1995: After five months of hearing the loading, unloading and processing of wood, we are once again awakened very early on a weekend morning. Again, Miles goes over to Mr. Aguilar and asks the same question. Again, Mr. Aguilar replies with the same answer. December 1995: The Aguilar's move into their new home two weeks before Christmas. We already have some misgivings about them, but do not want to start out on the wrong foot. I even bring over some baked goods and welcome them to the neighborhood. After that it continues downhill. January 1996 thru March 1996: A year later, despite all the noise and activity, Mr. Aguilar still claims he is not running his business out of his property. All the firewood is now moved to the back of the lot behind his house. We are awakened almost daily anywhere from 4:00 -to 6:00 AM by the loud trucks starting. There is constant activity in their lot. Wood is loaded, unloaded, chopped manually, or with a gas wood splitter. There are three work trucks: a commercial dump truck with yellow cab, approximately 25 ft. in length and a reverse alarm; a white loading truck; a -blue work truck. Employees are in and out with these trucks or their own cars. It is like living next door to a construction site. There is no such thing as a peaceful existence at home anymore. March 11, 1996: Miles calls the Planning Commission to file a complaint and speaks with Larry_Painter. Mr. Painter says it would take up to two weeks before anyone would be able to investigate. He also says that Mr. Aguilar would be sent a letter giving him 30 days to comply if found guilty of any ordinances. March 25, 1996: Miles calls the Planning Commission for an update. He speaks to Larry Painter again, who tells him no one has been out to Mr. Aguilar's property yet and did not know when they would% March 27, 1996: Miles goes to the Planning Commission Office and purchases "Chapter 24 of the Butte County Code" on general zoning regulations and procedures. Enclosed is a copy of page VI - 11 regarding wood lots in this area. April 10, 1996: After serious contemplation, we put our house up for sale. We are disgusted with the lack of consideration shown ,to us by Mr. Aguilar. We are also frustrated by the county's lack of action in our behalf. April 16, 1996: More than a month after our initial contact with the Planning Commission Office, Miles calls again for an update and speaks to Linda. She then talks to Gary Brown who knew nothing about the complaint. There is no record of it at all! Miles is very upset, and is promised that someone will get out here on April 17 or 18. April 23, 1996: Miles calls the Planning Commission and speaks with Linda, who hands the phone over to Jill (she sends out -the notices).. Jill indicates a letter was mailed to Mr. Aguilar on April 17. Then Frank Cook gets on the line. He is the Planning Code Enforcement Officer who actually came out and spoke to Mr. Aguilar on April 22. Mr. Aguilar claims he is not running a business. He says that he is just storing wood on his property and is in the process of getting rid of it. Please note that Mr. Aguilar has no fireplace or wood burning stove in his home. The wood piles are approximately 20 ft. high and 75 ft. wide. What did Mr. Cook think the wood was for? Apparently Mr. Cook believed Mr. Aguilar, because instead of issuing a ticket, he gave him until August or September to empty the lot. He also told Mr. Aguilar that no more wood was to come in or to be processed. Miles becomes upset again because he knows that Mr. Aguilar is lying. Mr. Cook tells us that if we take pictures of any activity happening on Mr. Aguilar's property that he would take action against him. April 24, 1996: Two days after Frank Cook came out here, two employees are in Mr. Aguilar's lot chopping wood. It is then I start taking pictures. I photograph everything: work trucks, employees, employees chopping wood, full and empty trucks backing in and driving out and various angles of all -the wood piles in the lot. For the next month or so there is constant activity and noise, though I never see any new wood unloaded. June 3, 1996: Two large truckloads of wood are unloaded. This time I call the Planning Commission Office and file a complaint with Lynn. June 11, 1996: Miles drives to the Planning Commission Office to speak with Frank Cook and show him the pictures I had taken. Each one is documented on the back with day, date, time and description. Frank Cook and Larry Painter personally speak with Miles and agree the pictures are incriminating. Mr. Cook tells Miles he will go to Mr. Aguilar's place later that day and give him a ticket - plus ten days to get rid of all the wood. June 17, 1996: Miles calls the Planning Commission Office and speaks with Frank Cook for an update. To our disbelief, Mr. Cook informs Miles that Mr. Aguilar is doing nothing illegal and that the pictures are not relevant. He tells us that he has given Mr. Aguilar until September 16 to get rid of the wood! Here is my question: What happened in between the time that.Miles showed Mr. Cook the pictures and Mr. Cook went out to see Mr. Aguilar? Mr. Cook did an abrupt about face! Why is Mr. Cook refusing to enforce the ordinances? After Miles threatened legal action, Mr. Cook tells him that if he can get any activity on a video camera that he will come out and issue a citation to Mr. Aguilar. The bottom line is: Frank Cook keeps changing the rules, we keep playing by them and Jim Aguilar keeps breaking them. In the meantime, our house is still for sale. We have had to lower the price. Our real estate agent tells us that we are legally bound to disclose Mr. Aguilar's activities as a nuisance to any prospective buyers. We have had several parties interested until they are informed about the ongoing problem next door. This problem should have been alleviated long ago.
