111. DISCUSSION OF ENVIRONMENTAL EVAtUATION
This application is for a use permit on AP # 42-08 03 and 211, in the
A2 -General zone to allow the storage of inflammabloa for a commercial
gasoline station. Three underground gasolipe storage tanks totalling
3
24,000 gallons will be located on *the site as indicated bgv the revised
site plan (located 20 feet from the Kennedy Avenue property line and
28 feet from the Highway 32 property boundary). Thes�roperties will
also be utilized for a car wash facility (four stall and an antique
shop (in an existing residential building)i The 1.5-aeve site is
located northwest of Chico adjacent to and east of Highway 321 south
of -the Kennedy Avenue intersection. The project involves the relocation
of the Robo Oar Wash and gasoline station f:?om its presout location
on PalmettoAvenue to this proposed Highway 32 site. The area surround-
ing the now commercial buildings will be paved., with access off State
Route 32 and off Kennedy Avmue, as por the site development plan.
Curb, Sutter and sidewalk urban improvements on Highway 32 and on
Kennedy Avenue will be required by the Butte County Public Wotko Depa52t-
ment , thereby. providing area for turning.
Surrounding land uses- are a Mixture of commeroiall residential, light
industriall and agricultural uses. To the east single-family residences
occur all along Xonnedy Avenue (a duplex is contiguous on the southeast).
Across KennedV: Avenue to the north is vacant landi Commercial and light
industrial uses exist further north along Highway 324 Across Highway 32
to the west are oommoru,,ial uses with scattered residential uses.
Agricultural use� , ad, residential utser3 occur further to the west. To
the south is vacc-nt land !Across Highway 32. The Butte County Planning
Commission has proposed o. General Plan Amendment for this site from
ltrban-Low Density Residential to the Commercial designation, and a
rezoning of the from, A-2 'to C-2, Gmieral Oommercial, as part of
the area -wide 353 -acre Weot Highway 32 General Plan Amendment and
Rezone. This p-.,.?oposal is currently being processed by the county4
lb� 3b, 1.6e: A conaide.,vable area of the property will be covered with
impervious 8urXacing, Senerating additional runoff (estimated. coveraget.
1+ acre on the 145 -acre Cite). The proposed drainage solution is a

Considering the project's location contiguous to a major traf."ir,
thoroughfare and the existing commercial uses in -the area, these
effects should not 'be signif i cant. The gasoline storage and dispensing
area will be located near the highway and approximately 300 feet west
of the Kennedy Avenue residences, t:hereby reducing -these impacts on
the residents along Kennedy Avenue.

3hl l7ai. If drainage wells are utilized, groundwater will be affected
from the disposal of concentrated runoff and car wash drainage waters
which will contain various urban pollutants including dirt, oil, and
other petroleum wastes. The major groundwater aquifers for Chico area
domestic water supplies are at considerable depth, beyond the area of
influence of this project's drainage well. However� shallow aquifers
within 50 feet of the surface Lave often utilized for agricultural and
some domestic uses. The Butte County Environmental Health Department
has stated that the project site may be too small for the proposed
development, as a. consequence of required setbacks from domestic wells.
6at Area noise will increase from the increased vehicular use and 4�o.,
the concentrated commercial and traffic uoe on the property. Ilso,
noise from trucks delivering the bulk fuel will be generated, though
at rather infwequent poviodsi Considering the existing highway
environment, this impact should not be great.

gasoline storage area and about 180 feet from the car wash facility,

highway corridor and other commercial tises.

that basis, we recommend denial of the use permit.,,

filed and finding that the proposed use of the property will not impair
the integrity and character of the zone in which the land lies and that
tho use would. not be unreasonably incompatible with, or injurious to,
surrounding properties or detrimental to the health and general welfare of
the persons residing or workinef in the neighborhood or to the general health,
welfare and sar-ety of the County, made a motion for approval of the p-r0ject
subject to the following conditions'
1. Dec4 to the County of Butte 40 ft. of right-of-way from the
centerline of State 32, 30 ft. of rigbt-of-way from the
centerline of Kennedy Ave* and A 20 ft. radius return at the
intersection of Kennedy Ave. and State HAvy. 32,
2. Construct vei-tical flirt, gutter, sidewalk and widen State 14wY.
52 to 32 ft. to face of curb (Similar to RS -2A Stondardt
The one-half street section consists of an 18 -foot wide paved road,. vr,ltb
vertical curb (placed at 2O feet to face of curb)q gutter, and 5 -foot
wide sidewalk, Minitum road structural section to be 21t asphalt cone -,rete$
811 class 2 aggregate base, fog seal, prime toato and 95% relative
cowpactio- f subgradt.
3. Construct Kennedy Avt. to R5 -2A standard with vertical curb,
gutter, and sida'walR, and construct standard S-5 pedestrian
ramp at the intersection of Kennedy Ave. & Stato Hwy. .32,
4. Provide a permanent solution for drainage. SuNtit construction
& drainage plans to Department of Oubl-Ic Works for approval and
install the required fracilitics.
