At present I am operating a business ( Western bear) in a 24 X&65 ft.
Mo ile Home. All permits have been taken out and signed off except the

Mr. Lawson read staff findings.
Proponents. Don L. Harrisi Route 3, Box 379, Chico, stated that
the proposed facility would have double doors, be sound proofed and
air conditioned.
Opponents; Richard Smith, Route.2,Box 255, Chico, livingacross Hwy.
32 from this patcel, WLS concerned about possible noise factor, odor and
depreciation of his property and adjoining properties4
A petition -containing 18 signatures wa-, presented in opposition to
this project.
The hearing was closed and motion made by Commissioner Watters
for apptoval, finding that such a use is permitted with a use permit
,in the zone and that although contrary to the General Plan of Butte
County that efforts to zone the area to b4ing it into conformity have
been effectively resisted by residents of the area. His motion was
seconded by Commissioner Smith.(Approval subject to I condition.)

The public hearing on the Richard C. Smith$ otal appeal of Planning
Commission's approval of a use permit for Don L. Harris for a 24 -run commercial
dog kennel on property located oft the northeast side of Hwy. 32 at Kennedy
Avenue, containing 2.20 acres, more or less, Chico was held as advert1sed.

Hearing open to the public: Applaring:
1* Richard C. Smithi Mr. Smith stated that he is opposed to
having a dog kennel across the street from him because it would create
a problem with noise, odor, and his property would drop in value.
2. Mrs, Watkins. Mrs. Watkins stated that she was concerned
about the pollution to the wells in the area. Mrs. Watkins also stated
that she was concerned with the sanitation problem and also the noise,
3. Don Harris. Mr. Harris set out haw the dog kennel would
be run, how the sanitation would be taken care of.

and unanimt----,sly carried, the appeal of Richard C. Smith, etal is upheld
with the findings that the use permit is incontitteat with the General Plan.
