On or about November 19, 1999, this Department informed you of the requirements set forth in the California Safe Drinking Water Act for operating a water system. In order to determine if the existing water source met preliminary. standards, two water samples were submitted for Nitrate analysis in December of 1999. The results exceeded the maximum contaminant level of 45 mg/L allowed for Nitrate. In a letter dated December 28, 1999, this Department ordered you to have the water system in compliance with the monitoring standards set forth in the California Safe Drinking Water Act for state small water system within one hundred twenty (120) days. Furthermore, this Department required you to notify all consumers of the water system about the Nitrate analysis results. In a letter dated April 10, 2000, this department reminded you of the approaching deadline and responsibility to comply. On April 17, 2000, Wayne Cateron, acting on your behalf, informed this Department that he was working on the problem. After no compliance, this Department issued an order to comply on June 13, 2000, requiring you to complete the following items by July 14, 2000: Comply with Title 22 California Code of Regulations (22 CCR) Section 64213 (d) by obtaining a water source to serve the Tree Breeze Inn which meets the monitoring standards including those established for Nitrate set forth in the California Safe Drinking Water Act. Section 64213 (d) states, "The water supplier operating a state small water system shall comply with any corrective actions ordered ...for any chemical contaminant which exceeds the maximum contaminant level." Tree Breeze Inn, SSWS # Pending March 15, 2001 Page 2 2. Comply with 22 CCR Section 64211 by submitting a completed permit application to operate a water system. Section 64211 (a) states "No person shall operate a state small water system unless a permit to operate the system has been issued by the local health officer" On July 19, 2000, an application to drill a new well for the Tree Breeze Inn was submitted. On August 17, 2000, the permit to drill a well was issued. Subsequently, an application to operate a state small water system at the Tree Breeze Motel was signed and submitted. However, this Department was unable to process the application since the form was not notarized and no supporting documentation was submitted. After the new well was drilled in September 2000, this Department notified you in a letter dated October 18, 2000, of the required analyses that needed to be conducted on the water source. Furthermore, this Department requested that a completed permit application to operate a water system along with applicable operating fee be submitted. This Department again notified you of your responsibility to comply with 22 CCR Section 64211 and requested that the permit application and permit fee were to be submitted by November 3, 2000. On November 8, 2000, Wayne Cateron submitted part of the application packet to operate a water system and the one hundred thirty -dollar annual operating fee. As discussed with Wayne Cateron, the remaining items for the permit application still needed to be submitted. After a delay, the submersible pump was installed in the well in late November/early December. On December 11, 2000, water samples were taken and submitted to Monarch Laboratory for the following analyses: General Mineral, General Physical, Inorganic Chemical, Volatile Organic Chemical and total and fecal Coliform. According to the bacteriological results, the well was positive for total coliform. This Department requested that the well be chlorinated and re -tested for total and fecal coliform. On February 8, 2001, this Department met Wayne Cateron on site. During the visit, this Department conducted a brief inspection and took a water sample for bacteriological analysis. As per my discussions with Mr. Cateron, the new well would be hooked -up within the next 2 Y2 weeks. Furthermore, this Department informed Wayne Cateron that the existing pressure tank did not appear to be good condition and would need to be replaced. On February 12, 2001, this Department left a message for Wayne Cateron informing him that the sample taken on February 8, 2001 was positive for total coliform. This Department requested that he chlorinate the new well and proceed with the hook-up. Tree Breeze Inn, SSWS # Pending March 15, 2001 Page 3 On March 1, 2001, this Department conducted a quick inspection of the water system. No progress was noted. On March 5, 2001, this Department returned Mr. Cateron's telephone call and left a message advising him to chlorinate the well and proceed with the hook-up. On March 12, 2001, this Department conducted a follow-up inspection. No work appeared to have occurred since the February 8, 2001 inspection. On March 13, 2001, this Department spoke with Wayne Cateron. As per our telephone conversation, the following items will occur by March 19, 2001: 1. The new well will be chlorinated. This'Department recommends that contact be made with a professional well -versed in chlorination procedures for assistance. 2. The existing pressure tank will be removed and a pressure tank(s) in good condition and properly sized to meet the demands of the water system will be installed. 3. The new well will be connected to the water supply system and the existing well will be physically disconnected. As discussed with Mr. Cateron. prior to connecting the new water source, all tenants must be notified to utilize alternative potable water source until the water system meets bacteriological standards Upon completion of the above noted items, the following items must occur and be completed by March 26, 2001: 1. The entire water system, including the new well, pressure tank(s) and distribution system must be chlorinated. 2. After properly chlorinating the entire water system, the water system must be flushed clean of all chlorine residual. After the water system is free of chlorine residual for 2-3 days, two water samples must be taken and analyzed for total and fecal coliform. One sample must be taken from the well and the second sample must be taken in the distribution system. The samples must be submitted to a state certified laboratory for analysis. Please note that an inline chlorination system may be required if the water system continues to be positive for total coliform. 3. Submit the following paperwork: Distribution Data Sheet Sample Siting Plan Emergency Notification Plan Well Data Sheet Permit Application Form (Signature must be notarized) Tree Breeze Inn, SSWS # Pending March 15, 2001 Page 4 As of March 14, 2001, you, Mr. David Halimi resl2onsible patty for the above listed water system, have failed to comply with the following Sections of Title 22 California Code of Regulations (22 CCR): Section 64213 (d) - "The water supplier operating a state small water system shall comply with any corrective actions ordered ...for any chemical contaminant which exceeds the maximum contaminant level." Section 64211 (a) - "No person shall operate a state small water system unless a permit to operate the system has been issued by the local health officer' Failure to comply with the above noted items and established timeframes will result in this matter being referred to the Butte County Code Enforcement Department. This Department will request that a citation be issued for failure to comply. Furthermore, as allowed by Section 101325 of the California Health and Safety Code all time spent by this Department on this matter will now be billed to you, the responsible party of the above noted water system, at an hourly rate. This Owner -Builder Verification is required by Section 19831 and 19832 of the California Health and Safety Code. This verification must be completed and returned to our office before we are permitted to issue the permit. OVER OWNER BUILDER INFORMATION Dear Property Owner: .B.-1 An application for a building permit has been submitted in your name listing yourself as the builder of property improvements specified. For your protection, you should be aware that as "owner -builder" you are the responsible party of record on such a permit. Building permits are not required to be signed by property owners unless they are personally performing their own work. If your work is being performed by someone other than yourself, you may protect yourself from possible liability if that person applies for the proper permit in his or her name. Contractors are required by law to be licensed and bonded by the State of California and to have a business license from the city or county. They are also required by law to put their'license number on all permits for which they apply. If you plan to do your own work, with the exception of various trades that you plan to subcontract, you should be aware of the following information for your benefit and protection: ♦ If you employ. or otherwise engage any persons other than your immediate family, and the work (including materials and other costs) is $300 or more for the entire project, and such persons are not licensed as contractors or subcontractors, then you may be an employer. ♦ If you are an employer, you must register with the State and Federal Governments as an employer and you are subject to several obligations including state and federal income tax withholding, federal social security taxes, workers compensation insurance, disability insurance costs, and unemployment compensation contributions. ♦ There may be financial risks for you if you do not carry out these obligations, and these risks are especially serious with respect to worker's compensation insurance. ♦ For more specific information about your obligations under Federal Law, contract the Internal Revenue Service (and, if you wish, the U.S. Small Business Administrition). For more specific information about your obligations under State Law, contact the Department of Benefit Payments and the Division of Industrial Accidents. If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform their work personally or through their own employees, without a licensed contractor or subcontractor, only under limited conditions. A frequent practice of unlicensed persons professing to be contractors is to secure an "owner builder" building permit, erroneously implying that the property owner is providing his or her own labor and material personally. Building permits are not required to be signed by property owners unless they are performing their own work personally. Information about licensed contractors may be obtained by contracting the Contractors State License Board in your community or at 1020 N Street, Sacramento, CA. 95814. Please complete the "Owner Builder Verification" on the reverse side of this form so that we can confirm that you are aware of these matters. The building permit will'not be issued until the verification is returned. rely, Mic el C. Vi ira, C.B.O. Ma ger, Building Inspection NOTE. Occupying a structure without a functioning disposal system. This is a formal notice that Item Nos. 14,15,16 and 17 are in violation of the Butte County Code, as follows: Butte County Code, Chapter, Section 24-260 - Camping Limitations and Prohibitions. A. No person shall place or park or allow the placing or parking of any trailer coach, recreational vehicles, tent trailer or tent, or otherwise occupy or allow the occupancy of any parcel (as defined in Section 24-305.310) for the purpose of camping (as defined in Section 24-305.095) on public or private property within the County for a period in excess of 9 days in any one calendar year, except in an outdoor recreational facility, campground, recreational vehicle park, or hunting/fishing camp, lawfully established and maintained pursuant to this Chapter. Butte County Code, Chanter 24, Section 24-90 - The A-5 (Agricultural, 5 acre parcels) zone does not "specifically authorize" large accumulations of junk. The storing of more than 100 square feet of "junk" on a parcel is one of the items used to determine that a "junkyard" condition exists. A "junkyard" is not an allowed use in the A-5 zone without a Use Permit. "Automobiles and other vehicles, dismantled, in whole or in part" are considered to be "junk." Chapter 11, Section 11-4 forbids people, whether at a licensed junkyard location or not, from storing junk in public view. It shall be unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes or sewage in a sanitary manner. Butte County Code, Chapter 19, Section 19-4 - Unlawful Disposal Methods. It shall be unlawful for any person to construct, maintain or use any sewage disposal system which results in any of the following: (a) Sewage overflowing any lands whatever. (b) Sewage emptying, flowing, seeping or draining into any stream, spring, river, lake or other waters within the county. (c) Sewage being accessible to rodents, insects or humans. Butte Count, Code, Chapter 19, Section 19-5 - Permits Required. (a) No person shall begin or cause to have begun construction of any building or any sewage disposal system without first submitting plans of the means of sewage disposal to the health officer and obtaining a permit therefor from the health officer. (b) No person shall construct an auxiliary sewage disposal system for a building presently served by a sewage disposal system without first submitting plans of the proposed means of sewage disposal to the health officer and obtaining a permit therefor from the health officer. (c) No person shall extensively alter, repair, relocate, add to or replace any existing sewage disposal system without first securing a permit therefor from the Health Officer. (d) Permits issued pursuant to this section shall be valid for one (1) year and shall automatically become void one (1) year from the date of issuance, unless renewed prior to the expiration date. Only one-year renewal shall be permitted. Permits for repair, alteration, replacement or enlargement shall be valid for one (1) year from the date of issuance and are not renewable. The determination that Item Nos. 14,15,16 and 17 exist on the property is based on the following definition in the Butte County Code: Butte County Code, Chapter 24, Section 24-305.240 - Junk. Any worn-out and discarded material in general that may be turned to some use including, but not limited to, any old iron, wire, copper, tin, lead, rags, paper, bags, lumber, empty bottles, bones, parts of bicycles, tricycles, baby carriages, automobiles, and other vehicles, dismantled, in whole or in part, kept, stored, located, situated or piled in public view, and all other similar personal property ordinarily defined and classified as "junk" kept, stored, located, situated or piled in public view and not screened from public view by a fence. V Occupant June 2, 1999 Page 4 Butte County Code, Chapter 19 - Sewage Disposal. Sewage, as used in this Chapter, includes any and all waste substances, liquid or solid, associated with human habitation; this includes what is commonly referred to as gray water. It is unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes of sewage in a sanitary manner. Chapter 19 requires that prior to any dwelling or building being constructed or occupied, that plans for the means of sewage disposal be submitted to the health officer for his or her approval and that a permit be obtained for any required sewage disposal work. The Building Division requires that any dwelling, building or structure that requires a building permit, whether or not it would utilize a sewage disposal system, must first receive a clearance from the Division of Environmental Health. The clearance by the Division of Environmental Health will verify, before construction, that a proper sewage system can be established or that the construction will not interfere with an existing sewage disposal system or that the construction will not take place in an area that has been designated as a - replacement leach field. It is unlawful to construct, maintain or use any sewage disposal system which results in sewage overflowing any lands or into any body of water or to allow the sewage to be accessible to rodents, insects or humans. Not only is a permit required for the original system, but any extensive alteration, repair, relocation addition or replacement shall also require permits, inspections and approvals from the Division of Environmental Health. Butte County Code, Chapter 24,Section 24-305.095 - Camping. Occupying or maintaining for occupancy any place for temporary living, sleeping or other human occupancy purposes. "Camping" does not include: The parking or storage of an unoccupied and otherwise unused trailer coach, recreation vehicle, or tent trailer on a privately owned parcel, as defined in Section 24-305.31; occupying a trailer coach, or recreation vehicle, connected pursuant to county permit to permanent sewage disposal and water supply systems; or occupying a trailer coach or a recreation vehicle for any accessory use allowed in the applicable zoning district. At the time the above -referenced property becomes vacant, it shall not be occupied until all violations are corrected. This is your final warning. Unless you contact this office and make the proper arrangements to correct or abate the violation(s) voluntarily, within ten UW days from the date of this letter, enforcement shall be pursued through the issuance of a citation (ordering you to appear in court) for said violation(s) and for failing to comply with this warning letter. Upon conviction of said violation(s) or of failing to comply with this letter, the court shall impose penalties (fines) and a Notice of Violation shall be recorded in accordance with Butte County Code Section 41-7. The Notice of Violation will include a description of the premises the violation concerns, a description of the violation, the date of your convictions and the action necessary to correct or abate the violation(s). You will then be prevented from claiming state tax deductions for taxes, depreciation, amortization, or interest expenses connected with the property as long as it remains substandard. This notice is given to you pursuant to Section 24436.5 of the California Revenue and Taxation Code. To comply with the California Health and Safety Code, Section 17920.3 (a) 6,7,11,13; (d); (e); (g) 2,4; (h); 0); you must obtain all required permits for repairs from the Butte County Department of Development Services, Building Division, 7 County Center Drive, Oroville, California and in order to bring the property into compliance with the Butte County Code and avoid further enforcement actions, you are hereby requested to take the following abatement or correction actions: Remove all "junk" in accordance with the Butte County Code, Chapter 24, Section 24- 305.240. 2. Occupant June 2, 1999 Page 4 Butte County Code, Chanter 19 - Sewage Disposal. The clearance by the Division of Environmental Health will verify, before construction, that a proper sewage system can be established or that the construction will not interfere with an existing sewage disposal system or that the construction will not take place in an area that has been designated as a_ replacement leach field. It is unlawful for any person to maintain, occupy or use any building not provided with a sewage disposal system which disposes of sewage in a sanitary manner. The clearance by the Division of Environmental Health will verify, before construction, that a proper sewage system can be established or that the construction will not interfere with an existing sewage disposal system or that the construction will not take place in an area that has been designated as a replacement leach field. It is unlawful to construct, maintain or use any sewage disposal system which results in sewage overflowing any lands or into any body of water or to allow the sewage to be accessible to rodents, insects or humans.
