ANALYSIS:
This project is a request to segregate an existing hal-no from the
surrounding orchard. The Purpose for the segregation is to allow the
Original owners of the property to continue to live in Cheir home while
the orchard is operated under the family trust. As such, no new homes
are to be. builto and operation of the orchard will rOMAin essentially as
it 18 now. rhe proposal appears to meet all of the r(4cluirements of
Butte County Code Section 24-54 resardirig the segrogatlon of hQmosito$
in agricultural zones. The environmental documents have been completed,
and a Negative Declaration Is recommended.
A. Find that the requirements of CEQA have been Completed and
considered in making this decision and adopt a Negat*
and Ive Declaration;
B. Find that the propolaed use of the property will not impair the
integrity and charat;ter of the zone in which the land lies and that
the use would not be unreasonably incompatible with, or injurious to
surrounding properties or detrimental to the health and general
Welfare of the persons residing or working in the neighborhood or to
the general health) welfare and �;afety Of the County; and
C. Find that the project meets the requirements Of Butte County Code
Section 24-54 and approve the Use Permit to allow "fie Segregation of
