The 'Commission waived the reading of the Staff Findings. Staff said this project is a result of an approved Boundary Line Modification that was done without the buildings being shown on the map. The BLM was the result of a partnership breaking up and the property being split. The hearing was opened to the public. There was no one present to speak. The hearing was closed. Chairman Forbes said the project was straight forward. Commissioner Lambert said she had no problems with thit project. She asked if the plot plan was correct and staff said yes. a was moved by Commissioner Lambert, seconded by Commissioner Lynch; and unanimously carried for approval as follows: A. Variance is required to complete an approved Boundary Line Modi ic-ttion." 1 BUTTE COUNTY (PLANNING COMMISSION STAFF FINDINGS - November 1, 1990 ANALYSIS: This project is a request for a variance to the side yard setback to allow nut storage bins to the property line (0 setback) on property located west of Chico on Oak Way. This project results from a partnership that is dissolving and the division of the improvements on the property between the principles. A Boundary Line Modification (BLM) was approved in September of 1990 which would place the property line in the desired location. However, the plats for the BLM did not show any improvements and the approval was granted with the line in the location shown on the exhibit. It was later discovered by the Department of public Works that the buildings existed in the setback area relative to the new line. This variance is necessary in order to continue with the BLM and allow the partnership to dissolve. It is not possible to re -adjust the property line to provide the required setback because of underground improvements on the neighboring parcel. Rezoning would still result in a 5 ft. side yard requirement. There is still not enough room for a 5 ft. side yard setback given the improvements that are already in place. The side yard setbacks are usually required in order to provide light, air and visual relief around buildings, particularly in residential or rural settings. Granting of this variance would not compromise the purposes of a variance becauss all improvements are already in place. Additionally, the character of the location of the variance is more industrial than rural or residential and the provision of light, air and visual relief is tiot as critical: This project qualifies for a Class 5(a) categorical exemption from the requirements of the California Environmental Quality Act. RECOMMENDATIONS A. B. C.
