XXX- DISCUSSXON OV ENVXRONMENT&L EVALUATION
This proposal is for a use permit and subsequent tentative parcel
map to allow th 0 segregation of a I -acre homesito in an agricultural
A"5 zoning distl'ict. The 5 -acre property is located on the north
side of Oak Way, 1/3,mile west of Sandy Gulch, 1800 feet east of
Muir Avenue., west of Chico. Soils are Vina fine sandy loam, a deep,
well drained agricultural soil.
The site and area currently are in agricultural, orchard use, with
a half dozen rural residences dispersed along Oak Way in the area
including a rosidence on the subject site. The entire area is
designated for agricultural use, zoned A-5. Parcels range in area
from � acre to 20+ acres; generally are 5 to 15 acres.
Environmental effects resulting frOul this proposal 'will be minimal
considering the A-5 zoning, the area residential use along Oak Way,
and the existing residence on-site. However) a Precedent creating
this type of 1-acre.parcel may be established in the a,rea. Continued
encroachment of residential use on almond orchards in this agricultural
area would sustain agricultural -residential land use incompatibilities,
and Potential problems.

ANALYSIS:

This is a proposal to segregate a one acre 1'es'debtiAl homesite from a
five acre parcel currently in agricultural production. The applicant
originally bought the subject five acre parcel from the owner of the
14 i 5 acre parcel imMOdlatOly to the west (NIargtaret Schell AP 42 --13 -55)
DUO to the OXistilig A-5 Zoning, the a�plicant Is parcel divided over fout
acres of a producing almond orchard . rom the more oxt-qsive orchard on
the Scliell property. It is the applicant's intention, if his segregation
of a one acre homesitb 3'8 approved to sell the four acre remainder back
to the original owner to be managd� as a single orchard unit, (Telephone
coriv-ersation with the applicant Mid August 1981). It should be stressed
that the, provi8ions of Secti)n 24-S4 womitt restrict development of any

future divellingunits on the entire five acres covered by the developmen

RECOMMENr AT ION:

C. Approve the use permit to allow tile segregation of a one acre homesite
in an agricultural zone on AP 39-08-56, subject to the follolling
conditions:
I. Parcels shall be created pursuant to the State Siibdivision Map
Act and Chapter 20 of the Butte County Co7e, (Ptiblic Works)
2. lHaintain at least 8,000 sq. ft. of usable area for sewage disposal
in addition to well setback area, and all required setbacks on
homesito parcel, (Health)
3. Prior to the division being effective, the owner or owners of tile
PrOPertY included in the approved development plan shall execute
and cause to be recorded 'in the office of the Recorder of Butte
County a resti-iction binding upon the original owners and their
heirs, successors and assigns, which disallolis Additional dwellings
from being located on the property until either of the following
conditions occur:
a. The property is rezoned to any othe-i zone; or
b4 At least ton (10) years has elapsed from date of recordation
and the Commission finds circumstances regarding said property
and other properties in the area have clianged sufficiently
to reconsiaer the restriction. (planning)
