Warner Petroleum Inc. proposed Negative Declaration with mitigation measures
regarding environmental impacts and JLLse Permi�t to allow a new bulk plant facility with
warehouse, office, mini mart and 24-hour cardlock for fueling, on property zoned M-2
(Heavy Industrial) located on the northerly side of Highway 32, across from Oak Way,
identified as AP 042-1.40-127 and 128, Chico. (VIDEO TAKEN)
The Commission waived the reading of the Staff Findings, A video tape was shown of this site
Wally Warner said they have a bulk plant on Nord. ktmnue at this time, across from a pizza
parlor. He said one of the reasons for relocating this plant out approximately I mile towards the
northerly direction of Chico, is because of les- automobile traffic. He said the primary reason for
relocating is because the EIPA, i.e., state, federal laws, say that he has to conform to Phase 1, Phase
H vapor recovery, new containment for all types of piping on properties. He said by 1998
undergroun d tanks at the Nord Avenue site will have to be replaced. He said as long as they have
this expense, they felt it would be wise to relocate in an area where traffic was not as congested.
He said the mini -mart is for additional income to help pay for this project. He said that the oak
trees near the street will be removed as there is a 15 foot frontage easement. He said they are
planning to save as many trees as possible. He said the service station will caus-- removal of the
trees in the middle of the lot.
Commissioner Lambert, asked Mr. Warner if the mini -mart would generate more traffic?
Mr. Warner discussed the traffic in the area on Sacramento Avenue and 8th Avenue and the
possible future widening of Sth ANenue. He was concerned that there was a condition requiring
installation of a sewer along the entire frontage of his property that would benefit a housing
development, going in across the street. He felt that everyone should contribute to the sewer
system,
Chairman Forbes noted that there are no conditions listed concerning sewer installation or main
extensions.
Commiss-3'oner Lambert asked if Condition 4 meant all the hydrants or each hydrant? it was a
consensus of the Commission that this condition should be changed to say "each" instead of "all".
Answering a question from Commissioner Lambert, Mr, Warner stated that his company services
Butte and Tehama Counties.
Thomas York, CSUC student, said this business should be moved off of Noi d Avenue compictely
because of the heavy traffic impacts. He enoouraged the Commission to think before putting this
kind of traffic generator on a busy street.
The hearing was closed.
Commissioner Lynch said this kind of ifidtistrial use is appropriate in the M-2 zone. He said that
this area i's one of the relatively few M-1 zones.
Commissioner Ostrowskil acknowledged the letter received from Mrs, Deatsch.

Commissioner Ostrowski said the zoning is patchwork in the area with some residential andsome
industrial.
Staff gave a brief background on how the zoning in the area came about. Staff said there iss a
proposal to extend Eaton Road from Highway 32 to Highway 99, that will divert some traffic froin
this area,
Commissioner Lambert said this is the same area being considered for a school, and this is a
concern. She said she was not against the project, only concerned with the traffic that will be
generated.
It was moved by Commissioner Lambert, seconded by Chairman Forbes, and unanimously carried
for approval as follows:

S. The proposed project meets the requirements of the Butte County Code Section 24-
33i 24-47, and 24-117) specifically: The proposed uses of the property will not impair
the integrity nor character of the zone in which the land lies and that the use would
not be unreasonably incompatible with, or injurious to surrounding properties or
detrimental to the health and general welfare of the persons residing or working in
the neighborhood or to the general health, welfare and safety of the County.
B. Adopt a Negative Declaration with mitigation measures and approve the Use Permit on AP
042-140-127 and 128 to store inflammable materials subject to the following conditions and
mitigation measures:
1. Obtain a permit from the Butte County Air Pollution Control District.
2. Provide two fire hydrants serviced by a pressurized water system.
3. Place fire hydrants on the project site in accordance to the Fire Departments
specifications.
4. Each fire hydrant shall deliver a fire flow of 2,500 gallons per minute,
5. All structures shall incorporate the use of automatic fire suppression sprinkler
systems designed to the standards of the National Fire Protection Association for
industrial and commercial structuresi
6. The applicant shall pay the $1,700 development impact fee to the Butte County Fire
Department/Califormia Department of Forestry for the Westside Fire Station Fund
prior to the issuance of a building permit.
7. Obtain permits for underground tank installation from the Butte County Department
-of Envi'ro , ninontal Health.
8, Submit plans on mini -market plus plan check fees to the Departmeint of

9. Install curb, gutter, sidewalk and necessary paving along property frontage.

Recovery System and shall meet the requirements of the Air Pollution Control District.

Oak Way, Chico.
1. Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
reve,,iahon of said permit in accordfince with the procedures set forth in the
Butte County Zoning Ordinance, including Butte County Code Sec. 24-62.
2.. Unless otherwise provided for in a special condition to this use permit, all
conditions must be completed by the Pzrmittee within 12 months of the
deliveiy of the countersigned permit tc the Permittee.
3. If any use for which a use permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the permittee,
the permit shall become null and void and reapplication and a new permit
shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, successors, legal representatives, and assigns
of the Permittee.

I am responding to your referenced letter and its attached
Evaluation of Environmental Impact. Walton Engineering is a
architectural, engineering, and construction firm specializing
in petroleum related facilities. We are providing Warner
Petroleum with services related to the referenced project,
This project can best be describe,6 as a relocaLion and upgrade of
Warner Petroleum's existing facility, which is also within the
Butte County jurisdiction at 310 Nord Avenue (Highway 32),
adjacent to Big Chico Creek, near the City of Chico. I feel it
is `flportant to view r -his project from the viewpoint that all the
uses proposed (with the exception. of the small convenience store)
for new site already exist in close proximity to the new site,
that the older, existing uses will be abandonedr and that the new
uses will be a considerable improvement in the area of
environmental t-4,1 fire safoty� based on currentpotroleum design
and engiheeting.
