AP 42-17-34 ASSESSOR°S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth be..l.ow: Jerry Myers is hereby granted a Use Permit in accordance with application filed: 9/25/84 to allow a mobile home as a temporary second dwelling on property zoned A-10 located at the northeast corner of Dairy Road and Grape Way, in west Chico. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Fnabling Ordinance. 2. Unless otherwise provided for in a•condition to a use permit, all conditions must be completed by the permittee within 12 months of the de livery of the countersigned permit to the permittee. 3. If any use for which a use permit has been granted is not established within one year of the date of receipt of the countersigned permit by the permittee, the permit shall be come null and void and reapplication shall be required to establish the use. SPECIAL CONDITIONS: 1. Occupancy of the mobile home is limited to a close friend or relative by blood or marriage. 2. No rent is to be charged to the occupant of the mobile home. 3. The temporary mobile home is to be connected to the existing septic tank and water well. 4. The mobile home is to be a temporary use on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The use permit shall expire two years from the date of issuance of the use permit. Upon application, the Planning commission may grant an extension of the use permit not exceeding one year. I 6. In the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then in that event, the use permit granted herein shall automatically expire and the mobile home shall be removed within one' hundred twenty (120) days. In the event the mobile home is not removed within one hundred twenty (120) days pursuant to the terms of the use permit, the County shall remove the mobile home and store it at the owner's expense. 7. Meet the requirement of the Building Division of the Butte County Department of Public Works. S. PG and E trench for electrical service shall not be located under the proposed dwelling. 9. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. I hereby declare under penalty of perjury that I have read the foregoing conditions, that they are in fact the conditions which were imposed upon.the granting of this use permit, and that I agree to abide fully by said conditions. VARIANCES. 16.1 Trailer dwellings are permitted in A-2 (General) zoning districts, subject to se- curing a sewerage disposal permit and a trailer living per- mit from the Butte County Health. Department. 16.2 With the exception of the R-1 (Single Family Resi- dential) Districts, a special use permit for temporary trail- er dwellings may be issued by the Planning Department in all the other remainingzoning classification districts for a period not to exceed one (1) year and provided that all of the following conditions are complied with: a. ,That the occupant has secured a building per- mit for a residence; b. That the occupant has secured a sewerage dis- posal permit from the Butte County Health De- partment; c. That before six (6) months have elapsed from the date of the is- suance of the building permit, the occupant shall have completed the foundation, rough plumbing, framing and the roof of the proposed residence; and d. That the house must be completed within the One (1) year period and the trailer dwelling must be abandoned. e. That any variance granted hereunder shall be null and void in the event of the occupant's non-compliance with any of the provisions of this section. 16.3 Where hardship can be shown by the property owner in meeting the standards of this ordinance, or where condi- tions exist which make com- pliance with any rule impracti- cable, the Planning Commission may recommend the Board of Supervisors to modify or amend any minimum requirement set forth in this ordinance as to said property. The foregoing amendment to Ordinance No. 475 shall take effect thirty (30) days after the passage of the same, and be- fore the expiration of fifteen (15) days after such passage the foregoing amendment shall be published with the names of the members voting for and against the same at least once in the Paradise Post, a news- paper published in the County of Butte.
