in connection with the activities of Tau Gamma Theta Fraternity

we feel that it is our responsibility to register a formal complaint
in connection with the activities of Tau (3ramima, Ther -a . Fraternitv
house..
Almost everyweek, since the beginning of school, we have
been subjected to drunke-.-z parties of loud amplified music,. large
CrMldst JI-ong hours into the night and impassable roads, not to
mention the litter along the countryside the following day.
Having been college students, ourselves,, we. are aware of
the social life and involvement surrounding a school caimpus. 1 -Te
do not feell- however, that it should come to, the point of threatenin

We do feel that at this time some stern action should be taken

presented many probaems to the nearby property ovirners.
Lack of parking facililt-les and so many people attending
functions creates a hazzard to orderly use

Asyouare already no doubt aware, the. Tau Gamma Teta
Fraternity Law suits have been settled. Since the Planning Commission
was not directly involved in the settlement process, but could become
involved in the: event of future revocation proceedings, we felt
it soul d. be 'well to inform you as to the settlement.
After the Board of Supervisors sustained your Commission' s
revocation of the fraternity's use permit, it became apparent that
the fraternity intended to contest the revocation. The County then
filed a law suit based on two theories; 1. That since the use per-mit
had been revoked and a use permit was required for a fraternity in t
zone, contimed operation of the fraternity house constituted a zoniig
s ri-aity cons-!--; '•-x-s e
violation. 2.: That certain activities o� the gate_�,uLG
a continuing public nuisance. Shortly after anis haw suitwasf=led
the fraternity filed its own law suit alleging that the count's ~
revocation of the. permit had been improper.
Both law suits have now been settled with the following
resF�?t 1. The use permit will be reinstated.subject to conditions
specified in an i njim- etion issued by the Court. 2.. The pe-mit may
be revoked by the Cot for violation of said. conditions, and contempt
Court
proceedings would be available to seek enforcement by the Court.
3. The permit is subject to revocation pursuant to precedures
established by applicable County- ordinance.
For your information., we are enclosing a copy of the
injunction issued by the Court. You will note that in addition to
the basic prohibition against public nuisances there are a number
of definitive conditions stated. Of course, it is our :Nope that the
fraternity will continue to demonstrate the positive attitude sb_ow ,
during our, settlementnegotiations and that these conditions will
be voluntarily adhered to.
