John Tousey - proposed Negative Declaration regarding environmental
impact and UsePermit to allow a cabinet shop as a home occupation on
property zoned SR -1 -(Suburban Residential -1 acre parcels) looted on
the west side of Rose Avenue, approximately 200 feet south of Oak Park
Avenue, identified .as AP 42-21-74, Chico. (Continued open from
6/11/84)
Staff stated that this hearing was continued so the applicant could submit a new
plot plan,
Chaitman Vercruse was going to abstain as she was not at the last hearing, but
the applicant had no objection to her participating in the proceedings.
John Tousey submitted the new plot plan and pictures. He felt that this new
location was a better place for the shop,
Commissioner Lambert questioned the size of the property.
Mri Tousey stated that the prop I erty was the whole drawing that was submitted.
Staff discussed the insulation of walls. Mr. Tousey stated that at the time the
building is built he has no intention of insulating the walls, just the ceiling.

Walter asked if this was on the ag. side of the Greenline and staff
stated no, it was on the urban side.
Commissioner Lambertdiscussed the contribution to the West Side Fire Station
fund, She stated that she could not support this project. She .felt that the
same conditions existed that were existing with the shop on Entler Avenue,
except this is not an Already existing shop and we have.the opportunity to
prevent it. She felt that once this was established, then they would hear the
complaints.

for denial.
Commissioner Lynch stated that this was stetching the home occupation, but he
feat that the applicant was trying to do things right and this is legal under
the present code and there is no opposition from the neighbors.
Commissioner Lambert discussed page 6 of the environmental evaluation on the
space requirements.
Chairman Vercruse stated that the problem with the one on Entler Avenue was that
it was continually expanding and was not a home occupation.
Commissioner Walter asked if it was possible to have a review process;
Staff suggested that where the Planning Commission 'has made a limited use permit,
it was where the use could ;be easily abated. once a ,.,,lding is established it
is not very likely to be torn down.
Commissioner Lynch read Page 155b of the code on occupation objections. He
stated that they could not anticipate future objections.

It was moved by Commissioner Lynch, seconded by Commissioner Walter, and carried
for approval as follows,
A. Find that the requirements of CEQA have been completed and considered and
adopt a Negative Declaration; and
B. Find that the proposed project complies with butte County Code Sections
24-43, 24-47 and 24-200 in that the proposed use: of the property will not
impair the intPgrit,y and character of the zone in which the land lies and
that the use would not be unreasonably incompatible with, or injurious to
surrounding properties or detrimental to the health and general welfare of
the persons residing or working in the neighborhood or to the gene;,al
health, welfare and safety of the County; and
C, Approve the proposed use permit to allow a cabinet shop as a home occupation
on AP 42-21-74 (John Tousey), subject to the following conditions:
1. Submit storm drainage plans to the Department of Public Works for approval
and install the required facilities prior to issuance of final 'building
permit,
2. Comply with the Noise Element of the Butte County General Plan. Noise
levels not to exceed 60 dB at property lines.
3, Obtain an .Authority to Construct from the Butte County Air Polution Control
District,
4. Employment and work in cabinet shop is limited to family membr.,rs residing on
the premises.
5. All materials, sawdust, furniture, wood, etc., to be Located within the shop
building.
6. Advertising on-site Limited to one unlighted sign not to exceed 3 square'
feet,
7. Insulation shall
be required comparable to requirements for residential use.
8. No windows,, doors or other openings in the building shall be allowed on the
South side.
9. No more than l cubic yard of sawdust shall: be stored on-site atany one
time.

Mr. Tousey asked the Commission to explain about the fine fund.

The applicant IS a cabinetmaker, who does all custom work. Business Is
secured through advertising, word of mouth and Selected cabinet shops in

where measurements are taken. Very few clients i,4ill ever visit the
site. All raw materials and finished products are transported by the
applicant In a passenger trucko
All materials are stored indoors. A 2400 square foot building has been
requested to allow ample room between machinery and for storage.
Potential 11inpacts Include dust and noise; Dust will be controlled
through adherence to Air Pollution Control District Standards. Noise 18
minimized through enclosure; all equipment will be located Indoors. The
closest neighbor (south) could be subject�d to 60dB on a worst-case
basis. Sixty dB is within the allowable standards for an 09ricoltural
zone., Actual noise will be les8p since one Person cannot run five
