Staff said that three conditions have been modified. Condition 3 suggested a Certificate of Occupancy be obtained; Condition 8 reflects the intent to allow a solid fence or block wall;and Condition 10 is anew condition regarding the parking required, landscaping, and barrels being 30 ft. from the white centerline of River Road. Commissioner Lynch said parking was discussed at the last meeting and the applicant stated they could not meet the regulations for 54 spaces. He asked if the seating was reduced, could the applicant meet the parking requirements of I space for every 3 seats? The hearing was opened to the public. Jill Bachman said the most spaces available on-site are 43 spaces. She said the building is considered recreational and the parking is figured on the square footage. She said with a sq. footage of 5824 only 29 spaces would be required for recreational. She asked what was required for a Certificate of Occupancy. Staff said for a commercial building, such as this, you need a Certificate of Occupancy from the Building Department prior to operation of the business. Commissioner Lynch asked if the building permits will be issued after all of the conditions of the use permit are met? Staff id building 3 was modified from the original condition which read "obtain all necessary ng permits from Butte County Building Department for all structures and improvements on the project site within 60 days :of the issuance of the Use permit", this has been modified to delete the wording "obtain all necessary building permits within 60 days" in the modification it says "obtain all necessary building permits from Butte County BuildingDepartment for all structures and improvements". Commissioner Lynch asked d if all the conditions. of the use permit have been met? Staff said that part of the problem was the plans for the building were not ready before and they are now. There was a question of whether the building was portable or not. Commissioner Lambert said there is still a problem with the parking. Chairman Forbes said that daring the busy season, without sufficient parking, there is a hazard in this area. Commissioner Lambert suggested the applicant consider a transportation plan such as a shuttle service, to work with BCAG or Parks and Recreation or contribute to a fund towards this end. He said they are working on the speed limit and parking situation on River Road. Mr. Scott said the problem is the tubers, which he can not control. He said he has expanded the parking lot, but can only get 43 spaces. He said he is willing to contribute to a transportation system. Staff suggested that the applicant request Butte County Association of Governments discuss and consider some type of public transportation in the area. Mrs. Bachman was concerned with the condition on the parking. The hearing Was closed. Chairman Forbes questioned the section Mrs. Bachman referred to concerning parking for a recreational building. Staff said the building is a bar/restaurant. Staff ` said the regulations are ;for a "no case less than" situation. Staff said you need a minimum threshold to work from. Commissioner Lambert asked if parks and Recreation funding is available from BCAG? Staff said no. Staff said BCAG is funded by transportation monies with no local funds. Chairman Forbes discussed the possibility of getting a letter from Mrs. Scott consenting for 11 parking spaces on the adjacent property when the 43 spaces are full. Mr. Scott said he would send a letter, but Mrs. Scott does not want any parking improvements on her property. He said she is willing to let the overflow park on her property, but she does not want any lined or paved area done. It was moved by Commissioner Lynch, seconded by Commissioner Lambert to modify the Use Permit per the Planning Memo dated 21-27-80 as follows: Conditions 1-9 and on Condition 10 In lieuof11 additional spaces on-site, the applicant will provide a letter from adjacentproperty owner to the County for a guarantee of a minimum of 11 overflow parking spaces, applicant will explore through BCAG public transportation to the site and none of which shall require backing onto the public right-of-way to exit. It was moved by Commissioner Lynch, seconded by Commissioner Matson, and unanimously carried to modify the use permit as follows: Grant a Modified Use permit (Modification to Use Permit 088-26) on AP 04.2-260-019 (1ohn W Scott) subject to the following conditions; 1. Install barriers, to the approval of the Butte County Planning Department, on River Road to limit ingress and egress to the project site to two locations. game as Use Permit 088- 26). 2. (Continued 'open from. November 9, 1989) Staff submitted a memo dated 12/12/89. Staff noted there was a new site plot subznitted by the applicant. Staff showed a video tape of the project: site. Staff said the new site plan delivered today appears to have resolved some of the questions Planning raised in the memo of the 12th. Staff said it does not appear to have the required off- street parking spaces and whether or not they will be able to achieve the number required to comply with the use permit previously issued. Staff still has concerns about: the landscaping, whether or not the Commission feels that the barrels with planting does in fact fulfill the landscaping requirements. The location of the barrels should be discussed since they appear to be in the right-of-way. Staff did not think the County would want the liability of structures in the right-of-way that the County has not approved. Staff said there is still the condition for a vegetative screen between River Road and the facility. Staff said Planning will not sign off on the Building Permit until staff is satisfied that the applicant meets the conditions that tha Commission has imposed. Staff said a Certificate of Occupancy should be considered in this band use issue. Commissioner Lynch was upset with the first paragraph of the memo dated 12/12/89. He said the Commission has not failed to address the remaining requirements. He said the Commission has addressed the remaining requirements. He said they have been concentrating on the building because it was the building situation that was brought forward to the Commission, but the Commission has addressed the other areas as well. He discussed the condition for a planter screen. He said the Code requires a 10 ft, wide planter with raised curbs and irrigation etc. He said they have to make a decision, if they require this, the oak trees Nvill die. He said that planter tubs are a good alternative and they will save the oak trees. Staff said ere are two isses, the vegetation screen was to cut down on light intrusion from the ar aonto R 8 Road. The landscaping and planters are separate issues. Commissioner Lynch read Section 24-35 paragraph i3 from the code book. He did not want planters around the oak trees. SLS �r November 9,;ggg Mrs, Bachman said the Uniform Building Code has no regulations for a portable building. She said Mr. Scott has diligently pursued everything he could do. She explained the problems with Mr. Bachman's health that caused some of the delays. She recommended the applicant and herself be allowed to work with the Building Department to resolve the problems.
