Apparently what Mr. Eitel relayed to us on site regarding his leach lines and replacement area was accurate. Mr. Eitel hired Chico Septic Service to locate his leach lines and the .Health Dept. file contains a copy of a document showing these locations. Even he if. abandons the public utilities easement on the West side, and moves the building back out of the West Sacramento road easement and setback, he will be to close to the main leach line. The only possible solutions would be; 1. Make the building smaller. 2. Abandon one of the leach lines being used at this time, and relocate that line into replacement area. Doug stated that it appeared that there was replacement area available, but it would involve tearing up the back yard, possibly the side yard or the front yard if there was enough room. The same size building could then. be move back out of the setbacks. The. structure is for a garage, not a house, as stated below in the original e-mail. He applied for a permit and was issued one. Larry Painter signed off the planning clearance without regard to a 12' utility easement or a road right -of -way. The inspector went out and issued a correction list to verify the setbacks. The contractor came in and verified them at the counter with Carl Durling. He proceeded to pour at which time, he was then told by Richard Nixon to cease construction due to a setback problem. I told Mr. Eitel to not do any further construction, as he may have to tear it out. He followed my direction and stopped construction at that point. I scheduled a follow-up meetingwith Mr. Eitel and all staff from other departments to try to find any loophole that would allow him to build in a road right of way. It would be possible to get the utility easement abandoned, as it is not used and the subdivision is built out. But, there was no possible resolution for his road encroachment. I offered some suggested changes in building dimensions to utilize the existing trusses he purchased, and told him I would personally have his project expedited if he wanted to make the revisions to the plans necessary. This is the last I heard from him. Did we make a mistake? Absolutely. Larry should have pulled the subdivision map and if he had would have clearly seen the setbacks: I spoke to county counsel about this a few months ago and they did not believe he had proceeded to a point where he had vested interest. We are not telling him he cannot build a garage. We are telling him he needs to make it smaller or move it to a different location.
