circumstances applicable to the proparty, including size, shape, topography, location or surroundings, the

Any variance granted shalt be subject to such conditions as will assure that the adjustment thereby aUth-

Re Chico Unified School Dis�rict Request for Board of
Supervisors to Adopt S8 201, Fees
This is to inform you that the Board of Supervisors has considered
your request to adopt building permit fees pursuant to SB ,201 and has
rejected the proposal. While the Board of Supervisors support. the
documentation on conditions of overcrowding according to criteria in;
the California Government Code, they did not support your District's
contention all reasonable mitigating measures had been considered and
appropriately disregarded.
Alternatively, the Board of Supervisors offers a suggestion for
Chico Unified School District to seek a bond issue election as set
forth in the Mello Roos Act of 1982. In that regard, our Board wishes
to recommend a committee be formed to pursue the election to be placQ
upon the November 1984 ballot4 Members of the Board indicated a I
willingness to actively support the measure. Project committee
suggestions to Work toward this end include the following persons:
BobgJeffries, Jane King, Marta Fuqua, Karen Vercruse, Jere Bolster,
David Jones, and Pat Furr. ^'

approval of the project in question would lead to the creation of one residential unit
which would be expected to generate .23 students at the elementary level (.K-6), .10
students at the junior high level (7-9), and .10 students at the senior high level (10-
12). These students, when combined with students generated from projects in the same
school attendance area, would place Shasta Elementary School and 'Bidwell Jr. High

the Board of Supervisors regarding conditions of overcrowdsng, and the Board,he1d a
hearing on this subject on January 10, 1984. I am enclosing for your information a copy
of the letter which Martin J. Nichols, Chief Administrative Officer, wrote tp the
President of the Chico Unified School District Board of Education, dated February 7, 1984

Mr. Nichols indicates that the Board of Supervisors "...supports 'the
conditions of overcrowding...." Thus, the Board of Supervisors has
i;ecognized that overcrowding exists in the�Chico Unified School District.
The cumulative effect of apk)roving land divisions within the area served by Shasta .
Elementary School and Bidwell Jr. High School, including the: project in question, is
significant and adverse because of the conditions of overcrowding discussed above.

In order to provide access around the garage and carport it would be
necessary to move the proposed proporty lino approximately 45 feet to the
east. This would result in the creaFion of a 0.7 acre,parcel. The
applicant wishes to avoid creating an L shaped parcel by adding enough
property behind the garage to yeild two one aCA16 ',pparcel,s. As a practical
matter, the leg: of such an L shaped parcel would to essentially unusable.
Within the vicinity there are approximately 10 parcels. lessthan an acre
that are zoned SR -1 All of these parcels were created prior to the adoption
of the SR-1-oning. The environmental documents have been completed and a
Negative Declaration is recommended.
