Commissioner Walter asked if the carport needs to be 20 ft. aide. Staff said yes, if it is a 2 -car carport. The hearing was opened to the public, George MurilGo asked the width allowed for a 1 -car carport. Chairman Lynch said the issue is the carport being 41' f�;om the property line. Mr. Murillo said there is 15 ft. from the garage to the leachlines-, he said the garage was not usable for cars. He did not want to be restricted from getting to his back yard. He asked for the maximum width for the carport The hearing was closed. Commissioner Lambert said she could not make the findings to approve this variance. She said this probler'l was common on a cul-de-sac lot. ANALYSIS: This project is a request for a Variance to allow a tWQ-car carport to encroach into the side yard setback and a variance to the size 1 Alk 'F BUTTE COUNTY PLANNING COM ISSION STAFF FINDINGS -- November 21, 1988 requirements for an 'off-street parking structure as defined in the parking ordinance. The R-1 zoning requires a five foot side yard setback. The off-street parking ordinance requires that a double-car carport be a minimum of 20 feet in _width.; The proposed project parcel is located at the end of a cul.-de-sac, on an irregular wedge shaped lot. The front lot line is 46.44 ft. The distance from the edge of the garage to the property line is 19 ft. 4 inches. (see attached map) This leaves only 14' 4" available for construction. Butte County Code Section 24-41 and Government Code Section 65906 require that the Planning Commission make findings of hardship in approving a 'variance. Accordingly, the County has begun to ask: applica,its for variances to supply information regarding findings of f-ict fdr their application. Attached to the applicant0s site plans are h_ findings which indicate that he Needs the variance due to the unique shape of the lot. A field inspection of the neighborhood indicates that several neighboring homes have either converted the garage area into family rooms/workshops or have enlarged their existing garage: The applicant is restricted from moving the proposed structure back on the lot due to existing septic tank and leach lines. There are options to the request for the variance. 1. The applicant could enlarge their existing garage and stay within the buildable logit area.. 2. The applicant could construct a single-car carport and stay within: the buildable area. 3. A combination of options l and 2 are also possible. It does not appear that the findings required for granting a variance can be made based upon possible alternative solutions to the problem. The project qualifies for a Class 5(a) Categorical Exemption from the requirements of the California Environmental Quality Act AtCOMMENDATI'ONS A.
