DATED: (Apps icamt) » ; July 1, 1977 Chioo, California Gentlemen: Based upon the idea that wo were granted a varianco .to move our fence, so that we could install a swimming pool we have spent over 0600.00',6 xo moving the fence and driveway Be rerouting the following underground utilities: 1. water 2. cable T.V. S. telephone 4. electricity 5. gas The pool would extend to 41 Poet of the center of the road. There would. be absolutely no problem with, sight since the fence is already there and the pool will. be located inside the exist- ing fence. Inclosed is a copy of the variance and the newspaper notice reporting the results of the meeting with the Tanning Commission last year. We were under the impression that the variance vie obtained last year allowed us to install a pools Based upon this assump- tion we have worked many hours and spent a. great deal of money on this project. Added to this the pool would not detract from the neighborhood or in any way be a.nusianoe or hazard to the; community,_ My wife and x would greatly appreciate ,your permission to go ahead and install the swimming pool. Safety should be our first conaideration and this addition would not be consstant with this philosophy: Jim Sands was aware of the deed restrictions at the time of Purchase, and should have planned accordingly. All the homes in this area have the same restrictions and,for reasons of safety, none of the owners haQe attempted to circumvent this particular restriction, This action would also be detrimental to the attractiveness of the homes in the area. This variance is granted subject to an appeal during the eight (8) day appeal period which ends at 5:00 P.m., on September 10,, 1976. If no appeals are received, Your vztriance will be consi- dered granted after that date. Should you have any questions regarding this matter, please contact this office. Lawson SUBJECT; Letter from Carl & Bernice Kolonsek re: Variance granted to Jim and Paula Sands DATE; February 17, 1977 The minutes for the Sands' Variance indicate that the letters referred to in the Kol onsek letter were not acknowl edcled Four letters were received. Several things could have occ,u,rredy the Chairman could have overlooked them, they could have been laced in the wrong file, etc. I do not believe the omission is 1eyally critical, however, since I do menu Code Section 65801 dealing with fornial rut es of evidence or procedure states in pari:..... "There shall be no presumption that error is prejudicial or that injury was done if error is shown." Secondly, the Kolonseks did not exhaust their legislative remedies by filing an appealof the Commissions' decision with the Board in a timely manner. I believe the Commission approved the variance based on the criteria contained i'n Section 16 of the Enablinct Ordinance - Variances which states. "Variances from the terms of the Zoning Ordinance shall be granted only when, because of special circumstances applicable to the property, including size, shape, topography, location, or surroundin4s, the strict application of the Ordinance deprives such property of privileges enjoyed by other property in the vicinity and under identical classification." The Commissign minutes state....
