The Public Works Department requested that a one (1) foot no access strip be provided along East Avenue, thereby eliminating the need for conditions 44 and #5 of the Planning Department, These conditions were originally added so that through access could be providedto the cul-de- sac, since the cul-de-sac length exceeded the maximum, allowed by approximately 100 feet. To accommodate this request, the applicant was advised to apply for an exemption per Section 20- 4 of the County Code and obtain Fire .Department approval. If the Fire Department agrees, an exemption can be supported since a special circumstance exists on site (existing narrow lot) and approval would not be detrimental to public health and safety. Ordinance 1226 indicates that the 'R-4 zoning district ext. nds 250 feet from the East Avenue tenterline. The way Based on ordinance, Zoning in e, candid show a 250 feet zoning boundary ,from the edge of right- of-way, would not be required and is consequently being requested to be deleted, Since the Advisory Agency did not feel that the lot configuration was an issue, it is ;recommended. that lots 1-8 be used as split duplexes only, in order to :maxiMize open space, The County Fire Department has agreed to exempt the rayl -de -sac length. Provided that the applicant meets their conditions in the attached letter It is recommended that conditions 2 4 and 5 of the original report, (attached) be deleted a►id the project be approved with the following new condition. 1, A note shall. be placed on, the Anal map stating, "Lots 1-8 shall be limited to split -duplex i development only." The present zoning is ,,V,-4 (Residential) and A -R (Agricultural -Residential). The Land Uze Plan Map of the Butte County General Plan designates this area as Medium Density Residential. There are no specific or, community ;plans for the area;. Zven though the parcels c. -Amply with lot depth and size requirements, there are several issues of concern with this request. The major issue is with the configurations and width of lots 1-8. This far -tore combinedwith the setback requirements, will create undesLrable building and yard areas. Particularly, Lots 1, 6 and 1 seem to be the most impacted Therefore, it is .recommended that this subdivision be denied and subsequently brought back with deeper lots. concern is that the applicant is requesting that lots 9 Ir, v.16ped as Commercial. However, neither the Subdivision. -tap 1- t. ru,)r 4-4,: County Subdivision Ordinance permits vesting rights for development. There will be some disruption, displacement, compaction and oyorco'vering of the soil to facilitate site development. Since the project will require on site and off site drainage facilities, this 1ipact will, be insignificant. There will be some potential erosion Of the soil duriag construction of the site since the project site is basically level, this impact is considered to be Insignificant. b,c. The absorbtion rates will decrease due to the over.covering of I, tl e soil with impervious surfaces. But this impact will be reduced by the installation of appropriate drainage facilities, therefore, reducing runoff cotcerins. Off site drainage facilities are currently being installed along Alamo, that eventually drains into tbR Undo, Channel. This project will tie into that facility. 4a, d. 'this project will result in the reduction in acreage of a orchard crop. However., since this project is located within a urban area and is planned for development, this should not be a significant impact 6b. Residential development of parcels 9 through 13 would expose people to noise levels that exceed :hose recommended in the.Noise Zlemc 4: of the Butte County General Plan. The no-iBe.element Vindicates that residential development within 200 feet of the ,northern lane of East Avenue would expose people to the noise threshold levels setforth in the General Plan. 'However, it is the a.pplicantZ,'intention to develop these bots as professional offices, which would be compatible with the noise leve: ia,c The project will result in an incremental increase in traffic Movement and traffic concerns on Alamo Avenue at the intersection of Last Avenue. In addition, the ctAl-de"sac exceeds the 500 foot minimum established for urbanized areas. If the project is redesigned so that the proposed li-nited access points along Fast Avenue are carried through to the cul--de-sac., this impact should be insignificant. Also, the access ,,oints along East Avenue should be limited to right turn movements only. 71his project will also provide full street Iff1provements within. the project boundaries and is subject to the Cf'ti.co Urbar. Area street fees which are established to offset potential impacts. The applicant should also pay a pro rata share towards the installation Zif a traffic signal at the East Avenue and Alamo Avenue intersection. Signalization of this intersection is not covered under the street facility mproveme.)t fee structure adopted by the Butte County Board of Supervisors for development within the Chico Urban. Area.. As such, At will be necessary for the pro rata fees to be paid. 14a,b,c,d e,f. This project will represent an incremental increase in demands f*,r public services is the area. The project lies within the west Chico Fire Station Assossmont areai similar projects in the area have paid a $7,5.00 per lot fee towards construction of a new fire station on the west side of Chico. This action has been found by the Fire :Department to be an appropriate mitigation. measure. Park fees and school fees are also collooted ;at the time - of issuance of - -- building permits which will off,+et this potential impact: The applicant will also be required to form a Community Service Area to pay for the maintenance of public facilities including the roads. 16,a,b,c,d,e. Powert communicati,bris_,vater, and sewer lines will have to be extended to the propertiY to ,serve the individual. lots. These services are all. available and are not expected to be significant., ig 'the ' represent res will ro ect re ent _an .i ii `tcremental .crease in demands t f p recreational facilities within this: Chico Area Recreation n str Xt. Vowever, fees are collected. at the t'me of building permits to offset this potential impact. The following are the recommended mitigation measures: 1. Residential development shall not be permitted within 200 feet of the north lane of East Averrze unless sufficient proof is provided at time of issuance of building permits that the noise levers are met in accordance with tha County's noise elemelt. 2. DISCUSSION OF ENVIRONMENTAL EVALUATION AP # 42-45-0.9 1Lb,e,f,3b,c,f,l6ei Development of 20 residential. lots on the ;northerly 60 percent of the property will lead to some disruption, d.splacement, compaction, and overcovering of the soil which will 'dead to changes in absorption bsor tion rates, drainage patterns, and the rate ,and amount of surface 'runoff. This may lead to an increase in soils both on rosi.on of s • or off-site. in order to reduce these impact there will be a need for surface drainage improvements bath on and off-site. Butte County Development standards for subdivisions of this type within the urban area will require u permanent solution to drainage and installation of appropriate facilities. 1: Development of this property will represent a minor loss of agricultural land. Since the project is located within an urban area and is slated for development this should not be a significant effoct. All of Butte County is within a moderate earthquake intensity onn VIII. The subject property' is located approximately 6 miles southwest of the Tuscan mdcjaocline, a fault system of unknown activity Construction of buildings to Uniform Building Code standards for seismically active areas should provide adequate protection to occupants in case of seismic activity. 4d See item lg: 5bi The Noise Element of the Butte County General Plan indicated that dev-elopment within 200 feet of the near lane of East Avenue. vDul expose occupants to noise levels above those recommended for residential areas. This noise area is zoned R-4 which will permit multiple family, residential dwellings and neiginborhood commercial tises with a use permit. Development of commercial uses in the noise area would be compatible with the policies of the NoiseElement of -she General. Plan: Construction of m,'Iti-family dwellings would require noise attenuation in accordance with the ;Uniform Building ;ode and could be made to comply under the conditionally acceptable standards of the Noise Element. Single-family dwellings, however, are not subject to the noise reduction standards of the Building Odes Accordingly, single family dwellings would either have to be setback at least 200 feet from the near Lane 'of East Avenue, be rade to requirements for multi meet the sound attenuation --farnly dwellings; or sound attenuation devices such as sound walls be onion impossible constructed along East Avenue. Si n, it is im ossible +comtemplated for the remaining ;P o since the type of development to recommend an appropriate method notfor ownmitigat.ing noise. Accordingly, the developer may wish to show the remaining portion as not being available for development until such time as either' a Certificate of Compliance is granted or Other action by the Advisory Agency takes place. 5,,110121 This project will represent the first lots of thLs size in the immediate area. Since the area is panned for densities in excess o'f those proposed by this project and since extension of City f of Chico sewer lines is ,taking place to felicil.itate implementation of doth, the City and County's 'General Plans this project can he considered in compliance with those plans. The affect on neighboring prop sties may be to trigger requests for similar lot sizes. Depending on the 1.'.:ation of those rec(uests they too could be considered in compliance with the General Elan. 13a,c,f: I_caffic generated by the 20 subdivision lots of this project will represent an incremental increase in traffic and traffic. hazards on Alamo Avenue and at the intersection of Alamo Avenue and East Avenue. As this area develops, a traffic signal at East Avenue acid Alamo Avenue will be necessary. The applicant should be pay a pica rata share towards the installation of a traffic signal. gnalizatlon of this intersection is not covered under the Street facility Improvement Fee Structure adopted by the 3utte County suoh, of Supervisors for development within the. Chico Urban Area. As such, it will be necessary for the pro rata fees to be paid. Traffic generated by eventual development of the parcel shown as. "remaining lands and consisting of 4.7 acres could utilize either Alamo Avenue or East Avenue for access. .Because of traffic safety concerns orlon East Avenue and increased turning movements in the middle of the block, ii. would be desirable to direct all traffic onto Alamo Avenue in order to utilize the intersection and traffic control devices for entering East Avenue. it is recommended that a one -foot no access strip be required along the East Avenue frontage. 14 This project will represent an incremental increase in demands p r The project site lies within the .for Chico sPire S in the assessment area. j Similar projects in the West Chico Fire Station apses. area have paid $75.00 per lot towards construction of a new fire station on the west side of Chico. This action has been found. by the Fire Department to be an appropriate mitigation measure. 16a,b,c,d: Power, communications, water and sewer lines will have to extended into the property to serve the individual lots. 19 This project will represent an incremental increase in oomands for recreational facilities within the Chico Area. Recreation District. Recommended Mitigation Measures 1. Show the easuntil suchetimescisitheaAdvi:soryaAgencyas a grantsna development such Certificate of Compliance or takes other action. Any action must be accompanied by a plan for noise attenuation where appropriate as discussed in this initial study. 2. We share the concerns of Supervisor Dolan regarding the East Avenue access and the less than desirable; size of the Lots numbered 21 through 31. We also take excep- tion to the implied proposal for multifamily use of lots 32 and 33, notwithstanding 'their obsolete R-4 zoning designation. We have consistently over our four year existence pushed for restriction of vehicular access to Fast Avenue to the maximum extent practicable. The obvious reason is that this vital east west thoroughfare can ill afford additional impediments to the free and safe flow of traffic, Traffic interuptions betwean future traffic signals at Cussick.and Alamo will reduce the capacity of at least the two outer lanes, and will have a tendency to degrade the env.roiiment in a number of ways It is our position that the area does not warrant additional multifamily uses on East Avenue. If the planning agencies of Butte County had not been rendered ineffective by lack of funds and personnel,, the zoning mistakes of two decades ago would have been corrected by now. The ;,4eighborhood Council recommends that the map dated November 1985 be disapproved, and that the subdivider 'revis'e the map to incorporate the following .features: 1. Dedication of a l foot non -access :;trip a" rung the East Avenue frontage 2. A 6 foot high masonry or stucco wall along the East Avenue frontage for sound attenuation and privacy. 3. An interior street through ,lots 15 and, 26 to connect the main access street off.
