The land already exists as 2 }parcels one at 9.92 acres and one at .78 acres. This project is being processed as a Tentative Parcel map because the change- in parcel configuration is major and doet not appear to be a "minor lot line adjustment." The .78 acre is already developed with a single family residence and the 5.92 acre has a barn and almond orchard on the premises. The orchard. is classified as a non economicai agricultural unit by the County Assessor. Under the current parcel configuration one additional residence may be constructed. The same is true about the proposod configuration. The project is not located in a sensitive botanical, archeological or geologic area. Both parcels will have adequate sewage disposal capacity and both have road frontage in accordance with County requirements. Given the above circumstances the determination has been made that this project is not subject to CEQA review pursuant to Section 15061 (b) (3) that states: CEQA applies only to project which have the potential for causing a significant effect on the environment. there it can be seen with certainty that there is not possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA: Approval is recommended for the project. 'Die proposed creation of three lots from 10.72 acres violates the AA (Agricultural$ 5 acre minimum) zoning classification which requires all lots have a minimum of five (5) acres. Assessor's Parcel, Number 042-050-039, or parcel no. '3 on your tentative map, is currently a non -conforming lot. Your proposal will perpetuate the non -conforming use and does not abate the under -sized lot, The Butte County Code, Section 24 - 37.4, which regulates changes of non -conforming uses, requires all changes or modifications to conform to the use standards and regulations for the zone. Therefore, a Boundary Line Modification between APNs 042-050-038 and 039' would only be allowed if lots are live acres or more, in compliance with the A-5 zone requirement, If you have any questions concerning the above matter, please contact this office between the hours of 10;00 a.m and 100 p,m,, Monday through Friday.
