4 THIS AGREEMENT, made and executed this 14th day of March ,
5 19 86, by and between the City of Chico (hereinafter "City") and
6 WEBB BROTHERS CONSTRUCTION (hereinafter "Owner").
7 WITNESSETH
8 WHEREAS, Owner has requested City to allow Owner to connect to City's
9 [XI sewer system--[] storm drainage system for the purpose of obtaining
10 services for Owner's real property, described and delineated on Exhibit "A"
11 (description) and Exhibit "B" (plat), attached hereto and incorporated
12 herein by this reference; and
13 WHEREAS, Owner is required by law to annex said property -in order to
14 obtain sewer service and/or storm drainage service; and
15 WHEREAS, the property herein described and delineated is located in the
16 unincorporated area adjacent to the City and [X] is not currently annexable
17 to the City [] is in the process of being annexed to the City.
18 NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS, PROMISES
19 AND AGREEMENTS herein contained; the parties hereto agree as follows -
20 1. CONNECTION: City shall allow Owner to connect to City's existing
21 [X] sewer system [] storm drainage system from Owner's real property
22 described hereinabove, all in accordance with the instructions, standards
23 and,conditions of the Chico Municipal Code and other requirements
24 established by City's Director of Public Works and in accordance with
25 Chapter 15.36 entitled "Sewer Services and Fees" of the Chico Municipal Code
26 and amendments thereto, if applicable.
27 2. FEES:

Trunkline Capacity Fee and Sewer Main Installation Fee, if any,
in effect at the time of connection to the City's sewer system.
Owner shall also pay monthly sewer charges to City after
connection to the sewer system. All fees shall be paid in
accordance with Chapter 15.36 entitled "Sewer Services and
Fees" of the Chico Municipal Code and amendments thereto.
[� Owner shall pay the storm drainage connection fees in effect at
the time of connection to the City's storm drainage system, as
set out in the City's fee schedule.
3. ANNEXATION - AGREEMENT NOT'TO PROTEST: Owner agrees that at such
time as Owner's property may be annexed to City under State law and City
desires to annex said property, Owner shall not oppose or protest, either
pursuant to the provisions of the State annexation law or in any other
manner, said annexation or any of the proceedings attendant therewith.
Owner further agrees to any conditions to be placed on the property at the
time of annexation as set forth in Exhibit "C" attached hereto and
incorporated herein.
4. ANNEXATION - PAYMENT OF BONDED INDEBTEDNESS: Owner agrees that`in
the event of annexation to the City, Owner shall.be liable for any bonded
indebtedness existing at the time such annexation is completed.
5. SUCCESSORS: This agreement is binding on the heirs, executors,
administrators, successors in interest and assigns of Owner.

Q (C) A TWO-STAGE THERMOSTAT, which controls the supplementary heat on

(B) TANK INSULATION. Storage type water heaters and storage and
backup tanks for solar systems shall be externally wrapped with
R-12 insulation or greater.

(C) PIPE INSULATION. The five feet of pipe closest to the water
heater and outside conditioned space shall be insulated with a
.` minimum of R-3. Steam and steam conditioned space shall be
insulated with a minimum of R-3. Steam and steam condensation
return piping and recirculating hot water piping outside the
building envelope shall be insulated in accordance with
T20 -1408(d).
(D) FLOW RESTRICTORS shall be provided for showerheads and faucets
as outlined in the new appliance efficiency standards and shall
be certified to the Energy Commission.

LIGHTING
(A) Lamps used in luminaries for general lighting in kitchens and
bathrooms shall have an efficacy of not less than 25 lumens per
watt (usually florescent).
