Zink and Doug Timmons, AP#42-59-40 February 28, 1989 This is.a ;proposal tc divide 21+ acres to create 21 Lots of 1.1 acres each. The p.esent zoning is RT -I -A (Minimum Density Residential .nailer). aThs Land Use Plan Map of the Butte County General Plan designates this area as Agricultural Residential. The project site is located within the Chaco Area Land Use Plan The proposal does not conflict with County zoning. However, Lhe proposal does not adhere to the policies of the Butte County General Plan, nor specific plan. The proposed subdx-,=ision street design conflicts with the General Plan. 'policy which calls for transportation facilities which service the needs' for rapid, efficient, comfortable, and safe passage of people .and commodities. The proposed roadway geometry and intersection, alignment does not provide a safe and efficient intersection design from one road link to another. A Negative Declaration has been prepared for the proposed project in; accordance to the California Environmental, Quality Act and forwarded to the Butte County Advisc.ry Agency within the required 165 days as mandated by the California Public Resouoes Code Section 21151.5. After our review, and discussions with County staff, it is out contention that the alignment originally proposed for the Bell .toad, Bay Avenue intersection beet suits the needs of the area. This alignment proposes that Bell: Road be turned at it's eastorly end to intersect. Bay Avenue perpendicular to Bay Ave, and that this intersection coinc;"de with the Marshall Court ilntersection.. We explored alternative intersection and lot configurations, including having Bel.? Road intersect- Bair at Shasta Avenue (see enclosed sketch) . We felt our original, proposal superior for the following reasons 1... Re-routing hell Road .northerly to meet Shasta results in a '"pie-shaped" 'property, south of Bell. This remaining piece requires eliminating one lot entirely or creating three odd shaped lots. The detrimental econ.omir effect ensuing from either -of these options would ba significant. 21 By aligning Bell. faith: Marshall: we eliminate the "problem" intersection without creating an additional 'problem", the sort which would be created at the intersection of Bell, and the projection of Shasta Further, the existing alignment of Bell would have to be retained to provide access to existing parcels southerly of the present alignment, Wherefores -access to these parcels would be made much more difficult 20 0etlaratiton brine Chico, CA, 95926 (916)'891-1,600 ,R n February 1.7, 1989 Bell Road Realignment Pacr'e 2 4;, Lastly, The County Public Works stmt' had a concern r regarding this new alignment. They feel it would provide an additional thoroughfare from the Esplanade westerly into the Bell-,Muir corridor, thus encouraging faster development. x of an already sensitive area. Considering this realignment is not within the County Road master plan, they feel that i the proposed Eaton Road extension. Will be a sufficient East _.West arterial link to this area, and would prefer not to have another, z We treat these comments will be sufficient to allow this project to proceed to the Subdivision Committee and then Advisory Agency roeetings. The proposed density of one home per acre and anticipated minimal earthwork necessary to prepare building pads and roadways is eypected to minimize any significant impacts related to compaction, displacement, or overcovering of the soil. Residential development .orf the project site will result in some increased stormwater runoff, which may create additional erosion on -situ. It is anticipate' that installation of curbs and gutters and a maximum residential density %of I dwelling unit per acre will mitigate .any significant drainage or ;toil erosion impacts. lc: The project site is relatively flat valley land. very little .earthwork is anticipated in developing 21 homesites. No significant changeIntopography or ground surface relief features is expected to locCur as a result of the proposed subdivision and residential: .development lg,4d: Twenty-one plus acres of historical orchard property will be, converted from agricultural land 'uses to residential Land uses by the proposal. The project site is located within the Chico Urban Area and is surrounded by residential development at urban densities which has minimized the commercial:/agricultural value of the project site;. 'The loss of prime agricultural land is not considered a Significant impact. lh: All of Butte County is within a moderate earthquake intensity Zone VITT, The subject property is Located approximately 5-6 miles southwest of the Tuscan Monocline, a. fault system of unknown activity.' Construction of buildings to Uniform Building Code standards for seismically active areas should provide adequate protection to residences in case of seismic activity. 8 t The proposed subdivision is consistent with the present and planned land use of the area. The project site is designated RT -1-A by the Butte County Zoning ordinance. The sand Use Map of the Count;y` teneral, plan has designated the project site "Agricultural- Residential". 13d,f: Roadway geometry and inters] .ion alignments as proposed by the tentative subdivision map will create significant hazards to motorists.xt is essential to provide safe and efficient intersection design from one road link to another, The short stagge' s in the alignment: of intersections as proposed should be eliminated to mitigate motorist hazards. The proposed roadway in the should ' Langel Court, subdivision should be realigned with Shasta Avenue and in addition„ Bell. Road should be converted to a cul-de-sac where it intersects with. Cussick Avenue and access from Bell Road to Shasta Avenue through the proposed subdivision should be provided. Other off-site traffic impacts are anticipated to be mitigated by the traffic .impact fee which has been levied by the Butte County Roard of Supervisors for the greater Chico Urban Area to mitigate overall traffic impacts. caused by urban growth.. 14a The proposed project will represent an increase in demand for fre protection services in the area. Theproject site is located Wi,hin the West Chico Fire Station Serv.+ice Area. An a :sessment fee of $75.00 per lot is required to be paid into the West Chico Fire Station Benefit Fund prior to recordation of the map. It is ,anticipated. that such fees shall mitigate all significant impacts azooci ated with the proposed project in relation to fire protection fa`f:vices 14b The Butte county Sheriff's Department is responsible for law r,n,forcement and protection in the project area. Rapid development in ;county pocket areas of the Chico Urban Area and restricted budgets have reduced the department capacity for preventative patrolling and rapid response to emergency calks 14c: The Chico Unified School. District has been impacted by rapid urban growth in the Chico Urban Area. School facilities are close to capacity and as a result a school impact fee has been instituted to finance new school facilities: 17a: The subject property is within the Chico Nitrate Action Plan .area. Additional septic systems in this area may contribute to high nitrate levels in the groundwater. The project will have to meet the requirements of the Butte County Environmentil Health Department. ucli requirements are antic.pate3 to mitigate any significant adverse ;impact caused by septic and leachfield systems 20a The project site is identified as an area of high sensitivity .for archaeological resources. Due to the high, sensitivity factor of the site, it is necessary= to preform a records check through the Department of Anthropology; California State University, Chico, in order to determine if significant sites may be located on the property. A records check will detArmine whether an archaeological survey, of the property will be necessary and whether any further mitigation measures will be needed. .Recommended Mitigation Measures:. 1. contact the Department of An':hro ol.o p p gy, California State , University, Chico, to request a records check to determine the archaeological significance of the site and whether any additional mitigation measures are necessary. 2, Realign intersections of the circulation network within the proposed subdivision so as to provide safe and efficient intersection designs: 3 install curbs and gutters to mitigate potential soil erosion problems and facilitate drainage of the project site, 6- DATA SHEET Project.
