The facts apparently are that Mrs. Norris was issued a building permit on November 13, 1975 for a mobile home in an area that was zoned A-2 at the time of the issuance of the permit. Subsequently, the area was interim zoned SR -1. The SR -1 zone does not allow mobile homes. Apparently, no work has been done since the issuance. of the building permit. The question is whether or not the subsequent interim zoning has effectively repealed or vacated Mrs. Norris'. building permit. The.general rule is that a permittee who has expended substantial sums,un.der a.permit cannot be deprived by a subsequent"; zoning ordinance of theright to complete construction and to use the.premises as authorized by the permit. See County of San Diego v.. McClurken, 37 C.2d 683 (1951). Since in this case no work has been done in regard to installation of the mobile home, the rule would not be applicable, therefore, the building permit issued on November 13, 1975 would no, longer be valid.
