The second question regarding a refund requires us to consider how much work have we accomplished and how far into the process have we traveled. I assume since you indicated a NOD fee that we have performed the initial study. If that is the case it would be my opinion that we should only refund the unused portion of the fees. Does the withdrawal need to go before the Planning Commission for action? There has been some recent discussion on withdrawals, but I am not sure what the outcome was. I know we have taken one or two withdrawals to the Planning Commission just for them to acknowledge the withdrawal, but they don't take any formal action (i.e., denial or denial without prejudice). 2. What about refund of the application fees? As I stated, we should not have taken in the application in the first place. We are not allowing it because of the recent change in State law that allows a second dwelling unit by right but does not allow us to issue a use permit for a second dwelling unit (per Felix and Yvonne). Basically, we should not have taken in the application but we didn't know about this issue at that time. A couple of questions come up: 1. Does the withdrawal need to go before the Planning Commission for action? There has been some recent discussion on withdrawals, but I am not sure what the outcome was. I know we have taken one or two withdrawals to the Planning Commission just for them to acknowledge the withdrawal, but they don't take any formal action (i.e., denial or denial without prejudice). 2. What about refund of the application fees? As I stated, we should not have taken in the application in the first place. The new State law allows second dwelling units by right in residential zones, but the second dwelling must meet the second dwelling standards found in the Zoning Ordinance. The project site is zoned S -R and is located in the Chico Urban Area, and as such, second dwellings are now allowed by right but must be attached to the primary unit and cannot exceed 640 square feet in size. The new State law does not allow the issuance of a use permit for a second dwelling unit that does not meet existing zoning standards. There are several options available to you with regards to the project. The first is to convert the two non -approved attached dwellings back into one dwelling. The second option would be to decrease the size of one of the two dwellings to 640 square feet or less, thus meeting the second dwelling requirements of the S -R zone. You will still need to obtain building permits to accomplish this. Please let us know what your intentions are. You will also need to send us a letter requesting withdrawal of the use permit application. Without the withdrawal request we would have to take the use permit project to the Planning Commission for a denial hearing. Building Permits Required. Prepare # sets of construction plans and make an application for permit. Construction shall comply with federal, state, and local regulations. Plans shall be prepared, sealed and signed by a California Licensed Architect or Registered Engineer for non-residential buildings and certain residential buildings. 2. Proposed improvements constitute a "change in use" or "change in the character of use" as stated in the building code.
