California Department Forestry;: "No Comment" Analysis;.., This application is a request for a Variance to allow the construction of a garage and shop building 5 feet from the rear property line. The parcel is located on the north side of 13;4dwell Avenge approximately 550 C feet west of Bidwell Place, Chico. This area was zoned R• -I in May of 1986 and with the. R-1 Gone came the 15 feet rear yard setback requirement. 'rhe lot measures 66 feet, by 213 feet and is almost one-third of an acre. There is not a hardship based on size, sJhape, topography or Location of this parcel, that could be used in the findings for granting a 'Variance. The neighborhood is characterized by older homes many detached garages, barns or other storage buildings. There are at least 5 parcels within 800 feet that have structures within 15 feet of the rear parcel line including the parcels on both sides of the applicants. These structures were built before -the R-1 zone was adopted. A 10 feet alley runs behind the parcel, Some people still use the alley to access the rear of their parcels. This alley provides a buffer between parcels and will allow for some emergency access to these parcels The parcel has a single family home in front, and a swimming pool., lawn and beautifully landscaped area in the middle. Thereat portion of the parcel has :been cleared and prepared for the shop building. There is also a large collection of rough cut hardwoods stored in this area The applicant is proposing a shop/garage`bui.lding that is almost: 1500 square feet in size. This is substantially larger than the average garage, or home hobby shop structure. A reduction in the size of the structure to meet the setback requirements will still leave enough room to build a structure approximately 1250 square feet in size. This should be adequate for an structure that is accessory to a residential use in an R- I zone. RECOMMENDATION: A. Note that this project is categorically exempt from environmental review, and B. Find tY from the proposed project does not comply with Butte county Code Section 24-49, because, and C.
