Upheld your appeal regarding the subject map, the Board's intention was.
that the road requirement be .in Conformance with Section 20-136 of the
Butte, County Subdivision Ordinance.
1n accordance with their intentions; as stated in otr letter of August 8,
1990, conditions #2y 3, 4; and 12 are deleted
That portion of condition #7 requiring, A 50 foot bu dling setback line
from the centerline of the access easement is deleted.
Add a condition that reads. The project must meet all of the requirements

DATE; May 3, 1990
This is a proposal to divide 1..11 acres to create 2 parcels, 1 at 0.85 acres and 1 at 0.26
acres. The present zoning, is A-SR (Agricultural - Subutban Residential). The Land Use
Plan Map of the Butte County General Plan designates, this area as Low Density
"Residential. There are no specific or community plans for he area.
The proposal does not conflict with. County zoning nor any adopted or proposed element
of the Butte County General Plan nor any County, specific or community plan:
'The pro,;;,ct-as proposed does not conform to the standard set forth in the Butte County_
Subdivision Ordinance for minimum street width: The original parcel was created taking
advantage of Butte County Code Section 24-136which allow a private easement as an
approved access where one (Y) parcel is being divided into two (2) lots where providing a
full sixty (60) foot access is required by the Subdivision Ordinance would prevent
development of a proposed lot or where existing development on the proposed lot does not
leave enough area to provide the full access easement, Approval of this subject parcel was
originally made subject to the following conditi6ns
A. The property shall, prior to division be within an urban area as designated on
Appendix 1 of the Design Standards,
P. The easement may serve only one (1) single family dwelling.
C. The building free turning area shall be provided on the lot or parcel served
by the easement.
D. Maximum length of the easement shall be no :more than 200 ft.
E The minimus! width of the easement shall be twenty (20) ft, to be improved
as followsi

The map creating the su' iect parcel complied with all of the conditions listed above. This
new proposal to create an additional lot would be a third lot created by this owner, not only
two (2) as contemplated by the ordinance section, would not comply with conditions B aild,
r► and would violate the note on the original map required by Condition I requiring
additional right-of-way:
Approval of thi, map would set a precedent that would effectively negate any ability to
enforce either 'Butte County Code Section 20-134 or 20-136. Additionally, Board of
Supervisors policy in the Chico Urban area has required full urban improvement on all
s�;Ireets, This would include curb,guttet and sidewalk in :addition to the street section. If
the proposed cul-de-sac is oto provide access to two (or more; if similar ;3ubsequent actions
take place) dwelling 'units 'then the cul-de-sac would not be a private drive as approve d
access ai defined in Butte County Code Section 24-136, and therefore must become a street
its defined nn Section 20-131. If the cul-de-sac becomes a street then it would need the full
urban improvement:3 and there would. not be enough room with the twenty (20) 'ft. right-
of-way to provide those improvements.

overcovering; of the soil due to development of building sites, driveways, parking areas, etc. which
will lead to changes in absorption rates, drainage patterns and the rate and amount of surface
runoff. Thi;; could lead to an increase in erosion of soils both on and off site and result in
siltation of area drainage whys and streams. The subject property is located within a drainage
district and s:►ny improvements will have to meet the requirements of that drainage district.

system of unknown activity. Construction of homes to Uniform Building Code Standards for

8., The project as proposers does not conform. to the standard set forth in the Butte County
Subdivision Ordinance for sninimurn street width. The originalparcel was created tatting
advantage of Butte County Code Section 24-136 which allow a private easement as an approved
access where one (1) parcel is being divided into two (2) lots where providing a felt sixty (60)
foot acce.,;s is required by the Subdivisiion Ordinance would prevent development of a proposed
lot or where existing development on the proposed lot does not iPave enough area to provide the
full access easement. Approval of this subject parcel was originally made subject to the following
conditions:
A. The property shall, prior to division be within an urban area as designated on
Appendix I of the .Resign Standards:
B. The easement may serve only one (1) single family dwelling.
C. The building free °turning area Shall be provided on the lot or parcel served by the
easement.

neighboring parcels.
I. A statement shall be placed on the map indicating that the parcel to be served by the

The map creating the subject parcelcomplied with all of the conditions listed above. This new
proposal. to create an additional lot would be a third lot created by this owner, not only two (2)
as contemplated by the ordinance section, would not comply with conditions B and D and would
violate the note on the original snap required by Condition I requiring additional right-of-way.
Approval of this map would set a precedent that would effectively negate. any ability to enforce
either Butte County Code ;Sectio«n 20-134 or 20-136. Additionafly, Hoard of Suporvisors policy
in the Chico Urban area has required lull urban improver,,nent on all streets. This Would include
curb, gutter and sidewalk in addition to the street section. If the: proposed cul-de-sac is to
provide access to two or more if similar subsequent actions take place) dwelling units then the

cul-de-sac would not be a private drive as approved access as defined in Butte County Code
Section 24-136, and therefore must become a, street as defined in Section 20-134. If the cut -de -
sac becomes a street then} it would need the full urban improvements and there would not be
enough roomi within, the twenty (20) ft,right-of=way, to provide those improvements.

Development of an additional parcel in this location would lead °to additional' traffic (10 trips per
day average) and related noise,, dust and traffic hazards. Wart of the rational for limiting private
drives is approved access to a single family was to limit traffic impacts as theymighteffect -
neighboring properties that would not be subject to the normal fifty (50) ft. setback requirements
of a public street,
13: This project will represent an incremental increase in traffic. and associated traffic hazards
in the area and they especially effect the neighboring parcels on either side of the easement. See
item 12
14a., This project will represent an incremental increase in demand for fire protection in the
area. Currently no fire station exists on the west side of the Southern Pacific Railroad tracks and
response time can be slow at times. Payment of a $75.00 per lot fee towards the construction
of a west side fire station has been deemed an adequate mitigation on past projects.
Additionally, construction of a second dwelling on along narrow easement may create problems
regarding fire; protection and that trucks may not have adequate space to pass one another or
other traffic exiting the property or adequate room to turn around to exit the property. Fart of
the rational behind the minimum fifty (50) ft, width cul-de-sac as, described in Butte County Code
Section 20-1.34 is to provide adequate street width to accommodate parking, emergency vehicles,
driveway exit and entrance movements and other uses associated with residential neighborhoods.
