Chairman Walter stated that the condition that was laid on this section of the subdivision, Condition 30, was approved by the Commission and agreed to by Mr. Halbert on August 30$ 1986; then on October 7, 1986 the Board approved this subdivision with Condition 30$ Ordinance 2558. He stated that Mr. Halbert knew at both of these times the setbacks and accepted the condition. He said that on November '17,, 1986, Mr. Halbert filed the final map which was recorded on December 5, 1986; then on January 21, 1987 Mr. Halbert took out the building permit on this hOUSe. He stated that Mr. Halbert has known of the requirement for 15 fti minimum side yard setbacks since August. He stated that there are seven (7) lots that are the same size, with five (5) other lots on the outside boundaries of this current subdivision as recorded. He stated that the property belongs to Mr. Halbert and it is anticipated that Mr. Halbert will develop more subdivisions around the edge of this property. He felt that this Was the only one of the five exterior lots that will have this problem. He estimated that the building was approximately 707 completed when the developer stopped construction. He said the staff report talks about the building envelope, but there nre Many nice houses that are 35 feet or less in width. He stated that moi - having the variance would not make the property unusable If the house that Is there now Is not put In. He did not feel that all of the comments In the staff report were pertinen4--. commissioner Lynch stated that when the Commission worked on this 8ub3IvIsIon they had a difficult time coming up With open space for the project. He stated that they had to use front yards to Meet the requirement of the PUD for common area. He felt the owner is responsible for the engineer's error.
