Staff said the applicant wotiAd have to answer that question. Commissioner Lynch said this will only have new construction around the garage and the house would not be required to Book onto city sewer and staff said that this is correct. Commissioner �'{mbert asked about sewering of all of the Chico Urban Area because of the current requirements and timelines of the Nitrate Action Plan: Staff said the Nitrate Action Plan says ;the Chico Urban Area will have sewers by the year 1995, Vice-chairman Matson s i -1d that Condition 14 was in conflict with the 6 ft, high fence around the property. Staff said if a fence is located within the setback of the street, it wih not be allowed, to be 6 ft. high, The, hearing was opened to the public. Paula Kenyon gave the: C:ommismon some background un her school, its prior location, and how it was growing. She said the school requires a nice rural neighborhood setting. She said she would like the Use Permit granted so they can use the building by September when school opens. She discussed taking out bu ;Iles to make it safer for traffic on the corner: She asked the Commission to change condition 03 to read "to connect to sewer or use existing septic system". She said she would not have more than 60 students. She said there is a ride shoring program already as aid they should not get over 20 cars coming in at one tir�ae, requested in Condit oia 15. Commissioner Ostrowski asked Ms. Kenyon if she was able to hookup to city sewer? Ms. Kenyon said that the cost to hook up to the city sewer is approximately $75,1700 and would not be possible for her to do. She said she has the opportunity to possibly hookup to the sewer behind - the property temporarily until sewer is nearing the front of her property. Siie said she has an easement from the other property owner behind her. She said the ratio of children to teachers is 12 to 1. She said there is a lot of supervision for the children. Jan Camb pell, 1765 Hooker Oak, Chico, said i she was against the school in the neighborhood. She said a school at this location was environmentally unsound. She said this s a quiet, family neighborhood. She said West Lindo Avenue is unsafe for even an increase of 20 cars per day. She said it is a 'fast and dangerous street. She was concerned with noise generated from the school. She was also concerned with the noise that would be generated from the renovation of the 75 year old House. She urged the Planning Commission to deny. the Use Permit. Kathy Ricci was opposed to the school. She said she has been a teacher for 12 years and she did not think they could keep 60 children quiet. She said the street is dangerous. She discussed the wildlife along Lindo Channel being disturbed. Philip Spe,Je said he was against the permit. He said West Lindo Avenue is a winding narrow, scenic road that people use to walk on, jog on, exercise their dogs on, etc. He said there are no sidewalks or shoulders along this road. He said an increase ease in traffic could be a danger to the people who use the road. He submitted a letter against the project. Ho mid his main concern was not the school, but the increase in traffic. He said the road is too narrow. He discussed speed limits and the people who break the speed limit. Charles Alexander said he was against this permit. He said lie wants to preserve the rural nature of the neighborhood. He said Condition 3 says the applicant must hook up to sewer. He questioned if a residential septic system could take care of 60-70 people. He said the property should also be hooked up to Cal Water. He did not think that ride sharing was enforceable. He said a bus service would be the only alternative to the traffic situation. David Habimi said his son goes to this school. I He voiced strong support for the school. He said lie is responsible for the safety of his child. He said the property is being purchased with the support of the parents. He said the traffic concerns have been addressed through the mitigation measures and he asked that the Use Permit be granted. Lauren Zak said her son attends this school. She said a Montessori school is not like a public school. She said the children are walked into the school and picked up at the door. She said the children are not allowed to wait out in front of the school without supervision. She was willing to donate a Culigan Water System if necessary for drinking water. She said therf, would be a sign posted stating this is a school zone; She was in favor of the permit. She said if need be different classes could start at different times so all the cars would not be there at the same time. jan Campbell said she was not there to debate the quality of the school, but was concerned about noise, traffic, and night programs. She said there is no place to park if they hold a program for the parents at night. Nancy Wadell said she was one of the parents that would be car pooling. She was in favor of the permit. Peter Corinakas said he is a teacher at the school and was in favor of the Use Permit, He said this is an ideal site for their school. Ms. Kenyon said the staff's analysisstates this is compatible and the problems have been addressed and mitigated. She said there will be no increase of the proposed staff size. The hearing was closed, Commissioner Lynch said the Commission needs to be clear that there is a limitation of 60 peopl- if the permit is approved. He said there is no way to mitigate the sewage requirement for public sewer, Commissioner Lambert said she shares the concerns of the neighbors regarding the speed' and danger of the traffic on West Lindo Road. ANALYSIS: This project is a Use Permit request to operate a Montessori school: The project site -is located in a S -R zone and is designated by the .Butte County General Plan as Low Density Residential. The applicant proposes modifying ?ri existing older home to accommodate approximately A children as a Montessori school. The proposed homesite is approximately 1:3 acres large and lends itself well for a school setting. The project site is located within a suburban residential neighborhood in the Chico, Urban area. To the north and the west of the project site is Lindo Channel and West i1ndo ,Avenue, - Immediately south of the project site is the Almond Grove West Subr1ivis on. Properties to the ewA of the project site are single-family residential on larger acreage. The project site is rr;latively isolated due k-, subdivision design; roadway geometry, and the spacial 'relationship of Lindo Channel to the project site-. Because -this building is no longer being uQed for residential purposes, rather a commercial endeavor, the building must meet the current b; iilding Codes of Butte County. In addition, in accordance with Section 307 of the Uniform Building Code entitled "Certificate of Occupancy" it is the responsibility of the new business proprietor to obtain an inspection and certificate from the Butte County Building Department in order to. occupy a once residential building for commercial purposes. The applicant proposes a Phase II plan which involves the addition of a pre-school on the project site. The applicant proposes to convert the existing garage for a pre-school. The time frame for adding the pre-school is two (2) plus years which exceeds the time limits for making improvements under a Use Permit allowed by Section 24-48.1 of the Butte County Zoning Code. Because the pre-school operation will not take place within the prescribed time limits of the code, it is recommended that only the montessori school be granted a permit at this time. A Negative Declaration with mitigation measures has been prepared for the proposed project in accordance with the California Environmental Quality Act. No significant effects are anticipated from the proposed Use Permit. RECOMMENDATIONSt MOTION; ACCEPT THE RECOMMENDATIONS OF STAFF MEMO DATED July 5,1990; MAKE THE FINDINGS LIS'T'ED UNDER "A"; MAKE THE MOTION LISTED UNDER "B" INCLUDING THE CONDITIONS TITSTED 1 THROUGH 15 A. Connect the proposed Montessori school to the public sewer. 4. Install roadway and drainage improvements on West Lindo Avenue in accordance with the specifications of the Butte County Department of Public Works: 5. Dedicate the necessary right-of-way to the County of Butte to accommodate the required roadway improvements. 6. Provide parking lot landscaping/shading to the approval of the Butte County Planning Department; 7. Obtain a Certificate of Occupancy from the Butte County Building ?Department. 8. Meet the requirements of the State Fire Marshal. 9. This is due to the fact that the school will be in operation for only approximately 180 days of a the year. Because the intent of the Nitrate Action Plan and Basin Plan Ammendment are to reduce nitrate loading to a level that will be protective of the area drinking Water aquifers, it is reasonable to use annual average nitrate loadings to determine when exemptions to the Basin Plan apply. Also, your particular usage i:� much easier to verify than many other usages would be (i.e., the number of students and the annual days of operation are easily verified), 1 Therefore we feel that a population of 60 at the school follows the spirit and letter of the Nitrate Action Plan and Basin plan Amendment and do not object to your request. Our approval is based upon a maximum student/staff of 60 and usage of the facility for no tPore than 182 days/per year.
