This reduction would ;f:fect an upstairs bedroom that would not be
reduced below minimum requirements of the 'building code. This would
also allow the designed 2 foot cave to remain entirely around the
building. The parcel to the northwest of the requested Variance on
AP 44-67-11 is presently vacant. The parcel to the southwest of
AP 44-67-12 is d condominium development of similar character to
this project that does not encroach into any setback areas, 'No
other Variances have been granted inthearea. There appears to
be no hardship based on size, shape, topography, location or
surroundings that deprive these two StrUCtUrCO Of privi7:e9es en-
j oyed by other property in the area and tinder the same zoning.
As such, granting of the Variance would be contrary to Butte
County Ordinances and. :the California State Government Code.
Add-itionally, if this Variance is granted for these two structures,
the cave overhangs would have to be adjusted in order to comply
with the provisions of the Uniform Building Code (1/3 of the distance
;from the structure to the property line).
