ANALYSIS;
This variance would allow the construction of a building at the sicle and
rear 'property lines for use as a new storageand repair s3op for a gun sales
and smithing business already'established on the site. The area in which
this business is located is transitioning from residential neighborhood
to various commercial and industrial uses. It is currently zoned A-2,
which permits this process-, yet requires five ±oot side and rear yard build-
ing setbacks like a residential zone. Commercial zones permit building
construction with no side o: rear setbacks.,
The applicant has noted that an adjacent property on Bast 9th Avenue was
I ermitted to build up to the applicant's property line (an. Interim C-2
zone was granted by the Board of Supervisors 6/2,/31, Ord. # 2222, which
allowed construction of a furniture store with no setback). This adjacent
property has since reverted to A-2 status.
The site of the subject site and the special. circumstances of its location
in an area transitioning to, and planned for commercial use, combined with
the privilege eiijoyed by an adjacent property under the same zoning class-
ification, would suggest a hardship that could be relieved by way of a
variance. Under these circumstances the findings required by Section 24-49
of the Butte County Code can be Made.
RECON ENbATIONS
A. Note that this project is categorically exempt from environmental
