XII, DISCUSSION' OF ENVIRONMENTAL EVALUATION
The applicant for this project proposes to obtain a Use Permit to
change a nonconforming use (existing) on 1/'3 acre of land to a use
similar in nature (resale of used clothing), The Chico Area band
Use Map designates the subject parcel and surrounding County parcels'
IJigh Density Residential; the 'revision to the Chico Area Lund Use I
Map: reclassifies these parcels Low Density Residential, Existing
and proposed zoning:for the project site and adjoining County
properties is R-1. Surrounding lands within the city limits of
Chico are also devoted to lore density residential uses.
The project site is located on the south side of Palmetto Avenue,
approximately 100 :Feet southwest.of Sheridan Avenue in Chico. The Z
structure proposed for retail use (existing) is 936 square feet in
size. Access to the site is provided by Palmetto Avenue: A duplex
also occupies the site (see attachments).
Primary environmental concerns associated with this project are.

ANALYSIS:
The applicant: for this project proposes to obtain a Use Permit to change
a nonconforming use, formerly c'oing business as a gun repair and sale
shop (now vacant) on one third a:;re of land to a retail, shop selling
used clothing. A building located on the project site, 936 sq. feet J.n
size, would be used for the proposed activity, A duplex, with individual.
units separated by a covered garage, also exists on the subject parcel,
Access to the site is pro'v"ded by Palmetto Avenue.
The Chico Area Land Use Hap in the County General Plan designates the
project site High Density Residential in an R-1 zone. The proposed
revision to the Chico Area sand Use Plan would classify the subject
site and surrounding parcels Low Density Residential with R-:1 zoning.
The proposed project would likely increase average daily tralffic (ADT)
along Palmetto Avenue and Sheridan Avenue, ar wrell as increasing the
demand for parking space on these streets: (Compliance with Butte County
Code Section 24-35, which regvires a specified number of _parking spaces,
surface improvements and landscaping for commercial uses, would help
meet the demand. for parking). The potential for generation o unacceptable j

shop for high .duality clothing and that the use would be low level. Iie
objected to Condition 1 to impose curb, gutter, sidewalk, etc., because
there are two trees --ane with a girth of 6.5 feet and another of 6 feet
that would be in the middle of the sidewalk > and because there are no

particular drainage problems.

The public hearing on the Riehard'D. Logue, Jr. appeal of the
Planning Commission's approval of the negative declaration regarding
environmental impact and Ron Andrade use permit to allow the change of a
non-conforming use to a use of the same nature (retail, sales) on a parcel
located in the "R-1" (single family residential) ;zone, located on the south-
east side of Palmetto Avenues approximately 100 feet southwest of Sheridan
Avenue, identified as AP 45-23-45; Chico Was held 'as advertised,,
Bettye Blair, planning director, 'set out the background on the
appeal. The Planning Commission approved the use permit. They have copies
of Planning Commission minutes and staff findings and any information that
cane into their meeting.
j Hearing open to %he public. Appearing:
1. Ron Andrade, Chico, requested that the appeal be denied and
the November 18th decision of Planning Commission be upheld. The letter'
of ,appeal was concerned with automobile traffic on Palmetto Avenue. Mr.
Andradep
posted a Couple charts he bad prepared: He would tryto limit his
comments to new information. All of the public agencies he dealt with were
most cooperative and considerate. They are proposing a business called
Second Glance and the hours would be 11.100a.m. to 5:00 p.m. for three days
per week. There would be two employees. Less than one half mile is
Mangrove Avenue with businesses anda church. He purchased the property"
September 1979. He vias informed he could conduct a business -with a use
permit. It was approved by a,>4 to 0 vote of Planning Commission. Public
Works had, conducted a survey of Palmetto in 1979 and thloount was. 3,900
cars per day and in 1977 there were 4,120 cars which is a decrease. There
wag concerns a child was hurt, but he could find no documentation on this,
The; Highway Patrol stated there, was an accident in the area five years ago.
