Environmental Health: "No objection to variance. Variance shall
also znc u e approval for part of the sewage di osal system within
30 feet of the centerline of Colorado Street ansp41 feet from the
conterline of Davis Stru t. Lot area appears adequate only for a
2 bedroom house."
ANALYSIS:
This is a request to allow a structure 30 feet from the centerline
of Colorado Street and 41 feet from the centerline of Davis Street,
And is categorically exempt from environmental review. The subject
parcel is 44 feet x 124 feet. The fronting property lines are both
20 feet from the centerlines. Observance of the SO foot setback
requirement and the 5 foot side and rear yard setback mould yield a
building envelope of 9 feet x 89 feet.: This substandard
created as Lot 12 of the o. B. Wood Subdivision in 1lot teas
104 The Ordi-
nance establishing setbacks was adopted in 1954 (Ordinance nce 506) .
Jeveral similar variances have been granted in the area, and it
appears that the findings required by Code Section 24-49 can be made.
There are some concern;, however. The Department of Public 11Orks
mentions possible sight distance problems, and is requiring the deeding,_
of additional right-of-way for future improvements, further reducing
the size of the lot. The Environmental Health Department comment
indicates that the lot aroa appears adequate only for a two bedroom
house. Coupled with the Public Works requirements, redesign or
'reduction of the building size may be necessary. The standard condi-
tion of anproval requiring compliance with all other codes, regulations,
etc. is adequate to guarantee that the completed project will meet
standards since it is the applicant's responsibility to work out
construction details with Health and Building Departments. Therefore,
this application Can be considered based only on the `requirements of
Code Sec. 24=49.
R'ECOMMENDATIONSc

During the discussion concerning the condition proposed by Public Works
Deptartment to "Deed to the County of Butte 50 ft. from the centerline of
Colorado Street and Davis Stredt", it was noted that this substandard
lot of 44 x 124 feet was created in 3.910 and that Ulposition of the
50 ft. setback -quiremont and the 5 ft, side and rear setbacks would
leave a building envelope of only 9 x 89 feet. It was also noted that
structures on all other properties on this street are in the setback
area, and foollng reasonably certain that no big street widening project
is proposed for the foreseeable future, it was the consensus of the
Commission that the I111POSiti0ft Of this condition would be not only un.;
