Now (after a considerable amount of time and a $1000 non-refundable deposit on the building they want) they have been told that they needed a full-blown building permit with 3 sets of plans from the contractor plus a 2 -foot elevation and inspections. Her husband's family has farmed the ground for over 100 years, and there has never been flooding at that location. There are no water marks even on a building that has been there since 1894. She was very dissatisfied with the extremely vague answers to her questions by Scott Rutherford. For example, he was asked "how high is high enough" and he said "I don't know". He said "I don't know" to numerous questions asked by the Howards. They are now about 3 weeks from apple harvest. Please let me know what would be a good time to meet and discuss this issue. But, in all fairness, it's hard for us to determine how to administrativelyh remove land from a FEMA floodway or flood plain without first obtaining a Letter of Map Amendment LOMA) from FEMA. While your approach is creative and logical, the County Code makes no provisions for us to interpret and declare that a vertical separation will take the building out of the flood plain. Quite frankly, we are very cautious in making such interpretations when we are under the watchful eye of FEMA. We are on the edge of being placed on probation by FEMA right now, a position where we don't want to be. We have had a number of problems demonstating compliance with FEMA requirements over at least the past 2 years. As you know they have been scrutinizing every permit we issue in the floodplain. There is too much to loose at this time in making an interpretation that FEMA may take exception to. Apparently, Stu Edell has questions about the engineers certificate of base flood elevation for this site, as well. Under any scenario, this needs to be resolved, as well. Due to the fact that this site is in the flood ay a 100 year flood plain, it is my suggestion that Mr. Howard apply for the building permit. It will cost approximate )$227 if t ere is no plumbing and electrical. Under the circumstances, he will be time and money ahead to proceed thi Beyond this permit, we would need to find out from FEMA, if under the circumstances of an Ag exempt building, whether we could exclude land from the flood plain with an elevation certificate. We should only ask that question, if we are serious about amending the code to allow for that determination to be made for an exempt ag building. If we were to proceed down this path, we would need to include a greater review of those projects. An elevation certificate would have to be obtained along with an inspection to verify the building met the locational requirements. This would entail a new process that Mike Vieira feels could jepordize our shaky standing with FEMA. Perhaps, this issue could also be further explored with John B when we meet in early August. These represent our collective thoughts for the momenta I hope they are useful, even though they do not achieve the outcome that Mr. Howard is seeking.
