The new parcel configurations would result in pairbel sizes of 57.66, 118.05, 120.09, and 252.08 acres each. A Merger has been submitted concurrently (Merger 05-09) and the acreages listed*reflect the final acreages for that merger. NOTE: A Merger was submitted as in interim step to reduce the number,of parcels located on this property from 10 to 4. Merging the number of lots to a'total of 4 will allow for the approval of the Lot Line Adjustment (LLA05-08). Without merging the properties first, the applicant would have been required to submit a Subdivision Map to accomplish the same Lot Line Adjustment. The interim step of merging the properties first was arrived at through consultation with Development Services and Public Works staff and the applicant. Although two separate and distinct actions, this Lot Line Adjustment and concurrently submitted Merger must be reviewed and processed together. The property is located between SR -99 and Cana Pine Creek Road, on Broyles Road, in the north Chico area. The parcels are designated by the Land Use Element map of the Butte County General Plan as Orchard and Field Crops, and are zoned A-160 (Agricultural, 160 acre minimum parcel size) and A-40 (Agricultural, 40 acre minimum parcel size). - m Butte County Department of Development Services n m Wurlitzer Land & Farming Company, LLA 05-68 Memorandum m Page I of 5 n This property is planted with a commercial walnut orchard, and has been improved with underground irrigation. 0 A small shop for equipment and a small office is located on the property. Project Analysis • The parcels were created by various patents and early deeds and are considered to be legal parcels. • Adjusted Parcel #1-3 will only be 57.66, 118.05 andl20.O9 acres in size, but are required to be 160 acres in size pursuant to the applicable A- 160 zone. • In accordance with Section 20-95.1 of the Butte County Code no conforming lots or parcels of land shall be made nonconforming or substandard as to size or any other applicable general plan or zoning standards as a result of a lot line adjustment; provided, however, that the Department of Development Services may approve modifications of nonconforming lots or parcels where the modifications either: decrease the existing nonconformity of a lot or parcel, without increasing the nonconformity of another lot or parcel; improve health or safety conditions; or improve the design of the existing affected lots without altering the existing land uses thereon. • This merger and subject Lot Line Adjustment will be decreasing the nonconformity of many of the original lots, which are currently substandard to the A- 160 zoning. 0 The applicant has additionally provided a letter dated May 16, 2005 from Carl B. Leverenz that sets forth justification for the Lot Line Adjustment creating the substandard Parcels (Parcels #1-3).' This letter explains that the agricultural improvements located on this property were developed in accordance with local topography, but did not take into consideration existing parcel lines. Access roads have been developed for each of the merged and adjusted parcels with the intent to provide for two self-sustaining orchard operations, one to be operated by the Wurlitzers and one to be operated by the McGowans. In reviewing this letter and the proposed Lot Line Adjustment, staff finds that the Lot Line Adjustment would improve the design of the existing lots without altering the land uses thereon, and recommends that the Director of Development Services approve the merger. • The project was reviewed by the Agricultural Commissioner, Butte County Public Works Department, Building Division, Environmental Health Division, Fire Department/CDF, and the County Assessor's Office. None of these departments objected to the proposed project. • The property is subject to a Williamson Act Contract. The proposed new parcel configurations conform to the 40 -acre and 10 -acre minimum parcel sizes imposed by this Contract. A new Williamson Act Contract was executed and recorded (Official Record #2006-0001594, January 11, 2006) with the new parcel configurations. m Butte County Department of Development Services m m Wurlitzer Land & Farming Company, LLA 05-08 Memorandum m Page 2 of 5 a 0 CE0A Issues This project is exempt from the requirements of the California Environmental Quality Act (CEQA) under a Section 15305 exemption. ACTIONS FOR CONSIDERATION: Staff recommends that the Director of Development Services take the following action: Find that the project is exempt from environmental review under Section, 15305 of the California Environmental Quality Act (CEQA). A Class 5 exemption consists of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density, including but not limited to minor lot line adjustments, side yard, and set back variances not resulting in the creation of any new parcel. Because the project is exempt from the provisions of CEQA, the payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 i's not required. Ii. Approve the Lot Line Adjustment for the Wurlitzer Land & Farming Co., APNs: 047- 060-038,-048, -049, 047-070-041, -100, -101, File # LLA 05-08, subject to the following findings and Conditions of Approval found in Exhibit A: A. The proposed Merger is consistent with the requirements of Butte County Code Section 20-95. 1. B. Parcel 4 conforms to the.applicable A -160 -and A-40 zone and Orchard and Field Crops General Plan designation. C. Parcels 1-3 would be substandard to the A-160 zone but would conform to the Orchard and Field Crops General Plan designation. D. No new parcels would be created by the Lot Line Adjustment. E. The Lot Line Adjustment, together with the Merger of property lines pursuant to Merger 05-09 improves the design of the existing affected lots without altering the existing land uses thereon as supported by the following: I . The Merger and subject Lot Line Adjustment will be decreasing the nonconformity of many of the original lots, which are currently more substandard to the A- 160 zoning. 2.
