This is a request for a Variance to allow the creation of a 30 acre parcel in an area zoned A-
40. The project is located on both the northwest and southwest corners of Cana Highway and
Cana Hamilton Nord Highway. Intersection, approximately 1 mile west of Highway 99.
Parcel 047-100-003 is currently open fields consisting of grasslands. Parcel 041-100.012 has one

The proposed project will create 4 forty acre parcels out of Parcel 3 and 4 parcels out of Parcel.
12 (two of these parcels would be 45 acres, one parcel 40 acres and one 30 acres). These parceh
do not appear to be created by aliquot parts (Section 24-31 of Butte County Zoning Ordinance)
as defined on the plat map. The applicant cited the reason for the creation of a 30 acre parcel

There is no hardship that warrants the granting of a Variance in this instance. Mr. Schill has two
45 acre parcels defined on the plot plan, These two parcels could give up 5 acres each to the
proposed 30 acre parcel and be in conformity with the 40 acre zoning: If a 30 acre parcel was
created it could 'set precedence for other 30 arse parcels to be created. Issuance of a Variance
under these circumstances would constitute a special privilege for a project which does not meet
any important public objective.

lb: This project will create five 40 acre parcels, two 45 acre parcels, and one 30 acre parcel out
of a 160 acre parcel and a 157 acre parcel. Development of one dwelling per parcel is possible.
Some disruption, displacement,compaction or overcovering of the soil is anticipated by the
proposed project as a result of agriculture and possible construction of a dwelling on the
individual parcels. Overcovering as a result of homesite construction will nod be significant due
to the large parcel_ sizes.;
lh: All of Butte County is within a Moderate Earthquake Intensity Zone VIII. The project area-

Protection Services. it is recommended that interior fire suppression sprinkle i3ystems will
