DISCUSSION OF ENVIRONMENTAL EVALUATION AP 47-13-138 The project is a Waiver of a Tentative Parcel Map. The Waiver each. The parcel is located 2800 feparcels at 4the and rsect acres is to divide, 107.32 acres into two p t east of the intersection of Bennett Road and Southern Pacific Railroad, on the south side of Beni -tett Road, in the Nord area. Township 23N, Range 111, Sections 27 and 28. The project proposes one dwelling unit, per parcel. The access and nearest public road is Bennett Road and is adjacent to the property. Septic is the type of sewage disposal. The project will be supplied by individual wells. Power lines exist to the boundary of thee origi.d'hl parcel. The land is currently under a Land Conservation Agreement or Williamson Act contracted out for 40 acre minimum parcel size. The current zoning is for 40 acre minimum parcels. Unless the zoning is changed or the contract expires, there is no potential for further land divisions and development Environmental Setting The general terrain is flat. This is agricultural land with slopes of 0-2ti The elevation is 15`0 to 1SS foot. The soils are recent valley sediments and alluviums with a moderate iiqui£iction Potential. Subsoil permeability is moderate to moderately rapid. The pooject is located within 1 mile of a registered ear , aake Of 1 to 3,9 on the Richter. The existing zoning is A-40. the existing land use on-site is agricultural in the surround=ng a,* , the land use are agricultural with some scattered rural. resident:Lal. The zoning is A-40. The General Plan designation is Orchard and Field Crops. Parcel sizes surrounding the project range from 5 to 160 acnes with greater than 40 acres common. The nearest urban area is Nord. The relevant spheres ofinfluence are Nord and Chico. Fire service would be provided by Butte Station #41 and the school in the area is within the Chico Unified School District. The following are comments on the initial study. lb,e: If the creation of the two parcels allows for the develop- ment of one dwelling unit and that dwelling unit is built, the Project will result in some disruption and compaction of soils on-site, These will be an increase in water erosion of soils off-site from the increase in surface runoff. However, since these parcels are quite large, these impacts should be minimal. 1g The development of a house would bring about a loss of 1/2 to one acre of prime, agricultural soils currently i1i agricultural use 3b: Development of a housing site would bring about an increase in the surface runoff and storm runoff from the site. 3ht The project will be supplied by private wells. 3j The Nord area suffered heavy flooding; last year. Some of that flooding was located in the Rock Creek area which is 5,000 feet west of the project site. The Rock Creek area is a zone flood boundary, 4d'i The approval of the parcel map and the subsequent develop- ment of the housing site will redu,e the present acreage by about one acre, however, the land is currently under the William- son Act and the remaining acreage will be in an agricultux-al use as long as the contract is renewed. 8: The proposal will result in a change in the land use of the area. inasnuch as at will be bringing a new`house', but this is not thought to be a substantial change; 10a: Agricultural uses currently require the storage of pesticides and other chemicals. There is a risk of upset. Currently the land is in agricultural use and the approval of this parcel map will not change the level of risk that currently exists, Il. The projectwill result in a small change in the distribution of the population inasmuch as it is allowing for one more family to be located in what is now a primarily agricultural area. The present zoning is A.-40 (Agricultural, 40 acres) and the Land Use Map of the Butte County General Plan designates this area for Orchard and Field Crops. Plan indicates the project is within an unclassified Mire hazard area (irrigated or urban lands) There a: -e no specific or community plans For the area. The proposal does not conflict with County zoning nor any adopted or proposed element of the Butte County General Plan not any County, community or specific plan. The project is under a LCA contract (Williamson Act) .for 40 acre minimum parcels. The project wil.l. meet the zoning and requirements of the LM Recommend approval.
