ANALYSIS:
The purpose of the proposed ag.
segregation is to segregate existing huller,
op'orations from the almond orchards
for financial pttrposes
Applicant is also xegtaesting a Variance to parcel size. Butte County code
Sec. 24-55 allows the segregated
parcel to range from 1 to 5 acres. Applicant
is proposing
a 10 acre parcel,,
The parcel encompasses htill.er facilities,
office, scalos', well and access
road. The western boundary exists from tate

original parcel. The eastern boundary allows fora 1 acre+ expansion of
the huller operation onto noxi=cultivatable soils (hard-panj. Unless a
flag lot is created the facilities can not be sited on less than a 0
acre parcel. It does not seem unreasonable to allow for a 1 acre expansion
of the facilities
Due to the soil conditions (as stated by engineer) and the odd shaped
parcel, that would result if the code section .were adhered to, the request
for a variance seems reasonablo.
Findings required by Code Section 24-55
1. The remaining parcels either moet r surpass the 40 acre minimum:
2. Project approval should in no way` reduce the agricultural capabilities
on surrounding properties,
3. The segregation is for financing purposes,
4. The parcels all meet Butte County environmental health requirements for
sewage disposal and water supply.

RBCOMMBNDATIONS
A. Find that the requirements of C.PQA have been completed and =Isidered
! in making this decision and adopt a. Negative Declaration; and
B. Find that the proposed project meets Butte County Code Sections 24-47,
24-49 24-55, and 24-81; and
C. Approve the: Use Permit for the proposed segregation of a parcel for
agricultural processing facilities on AP 47-13-12., including a
Vari nce from requirements of Section 24-55(a), subject to the following
conditions:

County Code and the State Map Act.
2 Prior to the divi.slon being effective the owner or owners of the I
property included in the approved development plan shall execute
and cause to be recorded in the office'of:'the recorder of Butte
County a restriction binding upon the original 'owners and their
