He said that Mr. VaY-, Wagoner had the property in escrow four or five years ago. The security deposit was ref., tried to Mr. Van Wagor-sr: Mr, ''Reimer asked if Mr. Van Wagoner was prera'nt at the previ.ius meeting. (%/Ir, sanders s aid that Mr. Van Wagoner was present at the previous meeting. Mr. Reimers said that the neighbors are in the process of filiaiizng some boundary line modifications ir► the neighborhood. Mr. Reimers suggested postponing this hearing for a month to iivcld any conflicts with the boundary line modification in process. Mr, Reimers thou&t it would be unusual for Mr. Van Wagoner to go forward with an application on property he has not had. .n escrow for several years. Mr. Edell said this committee had talked to Niro Van Wagoner, who apparently thinks that he still has the property in escrow. The committee had also talked to Mr. Van Wagoner about meeting Environmental Heafth Dept: requirements which were to have been provided at today's meeting'. Mr. Reimers asked if the icy:n could. be continued? Mr.. Erickson said the mater might be denied rather than coritinUed, Mr. Sanders said he would prefer to follow through with the motion of intent for denial of the application, Richard Coon, a helghbor agreed with what' was said by Mr. Reimers, Mr. Coon also asked that the item be continued for one or two months + Mr. Sanders said that. Mr, Edell said that the boundary line modification being done by Various neighbors might make the subject property less than 8o acres, With an A-40 zone on the property, the parcel split might be prohibited. It Would be necessary to look at the boundary line modification map in order to determine the acreage of the subject property. Mr. Bradley said that his primary concern Is to get the issues at hand resolved before allowing the situation to get more complicated, Mr. Edell said that the boundary line modification being discussed has been approved. - Mr. Bradley said that everyone Is in agreement and it is simply a matter of getting all the papers signed. Mr. Edell said he would like to look at the boundary line modification and see If this property has enough acre to comply with the zone if split into trvo parcels Mr. Sanders said he would like to see; the boundary lino modification resovled before approvaing this waiver application. Also there is insufficient information available on this property regarding soil tests. Erickson said that a professional firm needs to begin testing the soils on the subject property. He said he would check the Health Dept, files in case there is any information available on the property. Engineer: Eachi an Associates Richard Coon, a 1hbor, said that the neighbors in the area are very close to settling all the boundary line problems in the T,rea, and the maty of Charles Van Wagoner Is not based on the proposed boundary line modification already submitted to the County; If Van Wagoner 's map is approved, It would be difficult, If not Impossible., to accornplish the boundary line modification. He asked it the road would havo to be stralgl tehed all the, way to Meridian Road. The road Is not located where the deed describes it to be. Mr. Edell said there Is it two -told problem, The residents of the area want to get rid of the County 'right-of way where there is no County road, and the County would like to have a right-of-way where there Is a County road. There needs to be legal access to Lot 2. The other Lot can be accessed off Meridian 'Road, but the right-of-way to Lot 3 is about 80 t zsouth of the property and the County right-of-way is about 50 ft,, so there is a 30 ft, gap to get lee access to Governmi tit Lot 3, That is why the County has not abandoned the, r;ght-of way Siong the so lth Slee of that Lot 3, If a new tight -of -way could be. obtained, the old" one could be abandoned. Mr. Edell suggested sending a letter to Mr. Neilsen, who is the property owner, as to what he wants to do with his property.
