The parcel in question was originally created by a deed which appeared on its face to be a grant deed reflecting the sale of the property. The legality of the creation of this parcel was appropriately questioned in view of this. However, the persons identified in the grant deed as the grantors have submitted a declaration under penalty of perjury reciting the circumstances of the conveyance. Assuming the truthfulness of their declaration, it appears that the conveyance was indeed a gift, from the grantors to their daughter and son-in-law, but the grant deed was incorrectly prepared and did not properly reflect the fact that the conveyance was a gift. The grantors now propose to record a correcting deed containing the following statement: "THIS DEED IS GIVEN TO REVISE THE DEED OF GRANTORS DATED MARCH 30, 1992, RECORDED ON APRIL 8, 1992, IN THE OFFICE OF THE RECORDER OF BUTTE COUNTY, CALIFORNIA, AS DOCUMENT NO. 92-015135, TO REFLECT THAT THE GRANT WAS A GIFT RATHER THAN A SALE." Assuming that the correcting deed is in fact recorded it is our conclusion that the conveyance in question should be treated as having been a bona fide gift from the outset. Even if the conveyance is regarded as having been a gift from the outset; the question remains whether or not the gift created a legal parcel. It can be argued pursuant to the Court of Appeal's decision in Pescosolido v. Smith (1983) 142 Cal.App.3d 964 that the creation of a parcel by such a conveyance is subject to the Subdivision Map Act and that a map should have been filed. On the other hand, Butte County has had a long standing policy of recognizing the validity of parcels created by gift deed in situations such as this where a single parcel has been given to a family member. Pursuant to this policy, the parcel in question should be recognized as being valid. Any change in this policy 1 Aft should be made legislatively by the Board of Supervisors. These issues are more fully discussed in our Opinion No. 92-040. In view of the above, we have concluded that: 1. Based upon the information submitted and assuming the correcting deed is recorded, we conclude that the parcel in question was created as a result of a bona fide gift and that the filing of.a map is not required. 2. A building permit can be issued as to the parcel without the necessity,of a certificate of compliance being issued. 3. The parcel in question can be sold, leased or used for financing purposes without the necessity of a map being filed. If in connection with such transactions a certificate of compliance is applied for, a "clean" certificate can be issued. Please feel free to call if you have any questions regarding the above. We understand that their application is being withheld because it appears from the record that the con- veyance to them from Judith Lynn's parents, George L. and Bernice -L. Mandville,/4as a sale to them rather than a gift. Herewith the declaration of the Mandvilles to which is attached a copy of the deed which was prepared for them by Betty Fry of Betty Fry Secretarial Service. It is apparent from the Mandville declaration and the deed that Betty Fry was unaware of the provisions of California Revenue & Taxation Code Section 11911 which impose a documentary transfer tax upon properties "sold" only and not upon properties "gifted". The deed also shows confusion on the part of the preparer as far as documentary transfer tax is concerned in that we note it shows: "$24.50 DOCUMENTARY TRANSFER TAX $16.50 plus $8.00 recording" The, recording fee has no,relevance to documentary transfer tax. Butte County Public Works Land Development Services Page 2, June 18, 1992 Re: Lechner - Application for Building Permit In their declaration, the Mandvilles state that Fry asked them for their estimate of the property to be conveyed and they told her $15_,000.00. It will be noted that $16.50 would be the transfer tax on a $15,000.00 sale. It should also be noted that the Assessor's Parcel Number which Fry showed on the deed is Assessor's Parcel Number 47-44-35. On the date of the deed the 1.13 acre parcel had no Assessor's Parcel Number and Number 47744-35 was the Assessor's Parcel Number of .the Mandvilles entire 27.5 acres. (We are informed that the assessor has now given the 1.13 acres an Assessor's Parcel Number 47744-38 and has designated Assesor's Parcel Number 477440737 to the Mandville's retained acreage.) Also herewith is photocopy of a gift deed which the Mandvilles are giving to revise the deed prepared by Fry. ..On behalf of the Lechners, we request that the gift, vis-a-vis sale, be recognized .and that their building permit be forthcoming without further delay. At our request Bachman & Associates surveyed out the parcel and prepared a legal description for us (See Attachments "A" and "B"). We had no prior experience in real property conveyancing. We took Attachments "A" and "B" to a title company and told the receptionist that we wanted to gift the parcel to our daughter and son—in—law. The receptionist told us that the title company would not prepare the necessary documents, absent an escrow, and she recommended that we go to Betty Fry Secretarial Service, 28 Hanover Lane, Chico, California. We went to Betty Fry and presented her with Attachments "A" and "B" and told her that we wanted to gift the parcel as aforesaid. Fry undertook to prepare a deed (see Attachment "C").
