With this project, the parcel would have a resulting parcel size of 2.3± acres. • APN 047-460-013 is currently 2.84± acres in size. With this project, the parcel would have a resulting parcel size of 4.06 ± acres. • APN 047-460-012 is located on Gideon Lane, which is serviced by Keefer Road. APN 047-460-013 is located on Keefer Road, approximately 2500 feet east of Highway 99. • APN 047-460-012 currently has one single family dwelling and an accessory building. • APN 047-460-013 currently has one single family dwelling, and two accessory buildings. • The project site is located in Supervisorial District # 3. Project Analysis • The parcels were created by a parcel map by Richard Chambers, (Book 52 Page 92 - recorded back on June 20, 1975) which created four parcels. • The proposed parcel sizes are consistent with the SR -1 (Suburban Residential 1 -acre minimal parcel size) zoning. ■ Butte County Department of Development Services ■ ■ King LLA 05-09 Memorandum ■ Page 1 of 4 ■ • The proposed parcel sizes are conditionally consistent with the Agricultural Residential land use designation of the Butte County General Plan. 1. Compatible with neighboring agricultural activities. Project parcels already have existing residential dwellings so no additional impacts to potential agricultural uses would occur. 2. Evidence of adequate water and sewage disposal capacity. Project parcels already have existing residential development and no impacts to existing water and sewage disposal capacity would occur. 3. Availability of adequate fire protection facilities. Butte County Fire Facility (Nord Station 941 — full-time) is located approximately 1.2 miles to the southwest on Highway 99. 4. Adequately maintained approved road access with sufficient capacity to serve the area. The project parcels are served by Keefer Road, a paved county maintained (Select Arterial) road. APN 047-460-012 is served by an access easement off of Keefer Road. Since the parcels are already developed with .residential dwellings, no additional traffic will be added to Keefer Road or surrounding streets. 5. Reasonable accessibility to commercial services and schools. The project parcels are located approximately 4 miles from commercial facilities located in Chico and located 3.3 miles to an elementary school, and approximately 6.3 miles to the junior and senior high schools. No new parcels or additional dwellings being proposed. 1 • The project parcels are in the North Chico Specific Plan area which states that the majority of residential acreage will be single-family detached homes on one acre lots north of Mud Creek. The proposed Lot Line Adjustment parcel sizes will meet this minimum. • The project parcels are located in the Chico Municipal Airport Land Use Compatibility Zone D, which has no limit on parcel size. The proposed project is consistent with Compatibility Zone D. • The lot line adjustment proposes to create a lot where the length would exceed three times its width (Butte County Code 20-122) for APN 047-460-013, but the Code does allow an exception if the full depth of the lot is not buildable due to unusual topography, such as floodplains, BCC 20-122 (2). The back quarter of the parcel is in a floodplain so the parcel is in conformance. • The lot line adjustment would not result in any structure being located closer to a property line nor would it interfere with approved access to a public road. • The project was reviewed by the Butte County Public Works Department, Building Division, Environmental Health Division, Fire Department/CDF, Agricultural Commissioner's Office, and the County Assessor's Office. None of these departments objected to the proposed project. The Public Works Department recommends six conditions of project approval. ■ Butte County Department of Development Services ■ ■ King LLA 05-09 Memorandum ■ Page 2 of 4 ■ I CEOA Issues This project is exempt from the requirements of the California Environmental Quality Act (CEQA) under a Section 15305(a) exemption. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Manager take the following action: I. Find that the project is exempt from environmental review under Section 15305(a) of the California Environmental Quality Act (CEQA). A Class 5 exemption consists of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density, including but not limited to minor lot line adjustments, side yard, and set back variances not resulting in the creation of any new parcel. Because the project is exempt from the provisions of CEQA, the payment of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required. II. Approve the Lot Line Adjustment for Jim King, APN 047-460-012 and 047-460-013, File # LLA 05-09, subject to the following findings and Conditions of Approval in Exhibit A: A. The resulting parcel sizes of APN 047-460-012 & 047-460-013 are in conformance with the SR -1 zoning. B. The resulting parcel sizes of APN 047-460-012 & 047-460-013 are conditionally consistent with the Agricultural Residential General Plan Designation. C. CONDITIONS OF APPROVAL: New lot or parcel lines shall comply with setback requirements of applicable zoning and building ordinances. 2. Deeds and plats (if required) shall be submitted to the Department of Public Works, Land Development Division for checking and approval prior to recordation and shall contain the notes specified below. 3. Provide documentation from a title company of the applicant's choice verifying any deed of trust affected has been partially re -conveyed or modified to reflect the lot line adjustment and to prevent the creation of any additional lot or parcel. 4. Prior to recordation of deeds, provide documentation verifying payment of taxes as required by Subsection (b) of Section 20-95 of the Butte County Code and as specified in Article 8 of Chapter 4 of Division 2 of Title 7 of the Government Code, commencing with section 66492. 5. Prepare a plat showing approved Lot Line Adjustment 6. Record plat with deeds if one or more of original lots or parcels was created by map. If record of survey is prepared to show the lot line adjustment, recording of a plat is not required. Rufus Bess AP No.47-46-12 Garage Reconstruction Gentlemen: Per the request of Mr. Bess, our firm performed the necessary review and analysis to determine the flooding potential at the above referenced location. Based upon field inspections, survey data and historical knowledge, the following conclusions were developed. It should be noted that these conclusions were based, to a certain extent, upon personal knowledge of the area, and are somewhat.dependent upon engineering judgement. The yard where the garage is to be located is not likely to flood, even under extreme circumstances. Flooding has not occurred in the past 10 years. A cross-section of the Rock Creek channel shows the existing levee along the south bank to be approximately 1.5 to 2.0 feet above the plain to the north of the creek. This provides the necessary flood protection along �he parcel frontage. �dditional sur�ey data indicates the general slope of the vicinity to be away fro/-, the garage site, towards the south. If flocding were to occm^ upsteam it would have no effect upon the Bess parcel as the flood water Lends to flow ng Keefer Road.
