Dear Mrs. Webber:
This letter is in response to your request for a County cleterminat ion of the location of
your above referenced property with respect to the Federal Emergency Management
Agency (FEMA) Flood Insurance Rate Map (FIRM) Panel 06007CO310D. Butte County
was one of the first Counties to be digitally mapped by FEMA for their FIRMs. They
used the Census Tiger Files for the location and names of all the roads within the
County, which made the County absolutely, reject the initial maps in 1992, since the
road and flood plains were drastically moved from the previous 1989 Series B FIRM. In
some instances the roads had moved more than 600'from their previous location for no
apparent reason. Most of the problems Were corrected prior to the publishing of the
Series C FIRM effective June 8, 1998, adjustments were made to certain flood plain
areas resulting in the issuance of Series D FIRM for certain panels on April 20, 2000.
The Series C and D FIRMs depict a flood plain for Rock Creek and a location within that
flood plain for Songbird. Lane; 'a copy of this area is attached for your ..reference. This
would indicate to your lending institution that a portion of your property, and possibly
your structure, lies within the flood plain (Zone A). In fact a structure is required by
Federal Lending Regulators like FNMA, FHLMC, FDIC, FSLIC, to have flood insurance if a
federally backed mortgage is made on a property in a Special Flood Hazard Area as
shown on the FEMA FIRM. Since the Firm does not show the location of existing
improvements, the normal practice for lending institutions is to require flood insurance
if any portion of a property is shown as lying within a flood plain.
In comparison, if you use the existing subdivision map or survey in the field you can
easily demonstrate that the distance between the thread of Rock Creek and the
centerline of Songbird Lane is sufficient to place your property and Songbird Lane
outside the flood plain shown on the current FIRM, in other words the location of
Songbird'Lane is incorrect on the FIRM. Unfortunately most lending institutions do not
have direct access to this information. However, if the lending institution or FEMA were
to overlay the digital FIRM on the USGS digital ortho quads, they would definitely see

that not only is your property outside the flood plain (Zone X), all of Songbird Lane is
outside the flood plain.
The determination to require flood insurance is totally up to your lending institution,

can provide an, Elevation Certificate showing the lowest floor of your structure is above
the flood plain. Alternatives would be to have your Civil Engineer pursue a Letter of
Map Change (LOMC) to remove your structure from the flood plain, or to request FEMA
to review and correct the location of Songbird Lane,, either of which may'allow the
lending Institution to not require flood insurance for your property.

and a job card. Please post the job card on the job site in a
conspicuous location for the inspector to sign during the various phases
of construction, and also have the approved set of plans on the site at
all times. Inspections will not be made if the job card and approved
plans are not on the job at the time of inspection.
Please review the approved set of plans before construction and make
note of any corrections made in red. If any of these notes or
corrections are not clear to you, please contact this office - do not
proceed with the work without making the correction.
The job card must be signed by the inspector before proceeding with each
item listed. Should he not sign the card, a white correction notice
will list the corrections to be made and a call back inspection must be
made before going any further. Please allow 24 hours for inspection
service.
As a reminder to you, it is illegal to occupy this building or portion
of building for which this permit is issued without approval from this
office. On certain occasions a temporary occupancy will be permitted.
Please do not confuse gas or electrical service to the building as an
occupai,.,icy clearance. Before occupancy, all of the "final items" listed
on the job card must be signed by the inspector or special permission
given.
Your permit expires one year from date of issuance. If the work has
started, but is not completed and finaled by the expiration date, a
renewal permit is required. If the renewal application has not been
made within 30 days of the original permit expiration date, or if the
work has not commenced, a new permit application and fees will be
required.

GENERAL CONDITIONS
1 . It is understood and agreed that the County has prior right to the use of its rights of way. It is further
understood'and agreed by the Permittee that the doing of any work under this permit shall constitute*an accept-
ance of all the provisions contained herein and failure on the Permittee's part to comply with any provision will
be cause for revocation of this permit. Except as otherwise provided for public agencies and franchise holders,
this permit is revocable at any time. This permit is to be on job at all times while the work is being done.
2. All work shall be done ub* t to the supervision of and to the satisfaction of the Public Works Department
of the County of Butte. The ermittee shall, at all times, during the progress of the work, keep the County
Highway in as neat and clean a condition as is possible and upon completion of the work granted herein, shall
Iii -ave the County Highway in a tho�oughly neat, clean, and usable condition.
3' J The Permittee agrees by t4e acceptance of this permit to properly maintain any encroachment placed by the
i;erimittee on any part of the County Highway and to immediately repair any injury to any portion of the highway,
which occurs as a result of the encroachment, until such time as the Permittee may be relieved of the responsi-
bility of such encroachment by the County Department of Public Works.
4. It is further agreed by the Permittee that whenever construction, reconstruction, or maintenance work upon
the' highway may require, the installation provided for herein shall, upon request of the County Department of
Public Works, be immediately moved by and at the sole expense of the Permittee.
5. No material used for fill or backfill in the construction of the encroachment shall be borrowed or taken from
within the county right of way.
6. At least one lane of any public road, under the jurisdiction of the Board of Supervisors of Butte County, and
other public roads junctioning or intersecting therewith-, shall he kept open for travel by the general public at
all times. No public road under the jurisdiction of the Board shall be closed to travel by the general public
without special permission, in writing, of the Board of Supervisors.
7. The Permittee, by the acceptance of this permit,shall assume full responsibility for all liability for personal
injury or damage to property which may arise Out of the work herein permitted or which may arise out of the
failure on the part of the Permittee to do the work provided for under this permit. In the event any claim of such
liability is made against the County of Butte or any department, official, or -employee thereof, the Permittee
shall defend, indemnify, and hold them and each of them harmless for such claim.
8. All excavations shall be backfilled and compacted immediately after work therein has been completed.
Trenches shall not be left open farther than 300 feet in advance of pipe laying operations or 200 feet to the
rear thereof, unless otherwise permitted by the Engineer.
Unless otherwise permitted under the Special Conditions, backfill shall be placed and mechanically com-
pacted in such a manner that the relative compaction throughout the entire fill within the County road right of
way shall conform to the percentage of compaction as stated below. Permitteti shall notify foreman 24 hours
before backfilling and/or paving.
a. The relative compaction from the bottom of excavation to a plane five feet (5') below finish surface
grades shall be no less than ninety percent (90%) as determined by Test Method No. Calif. 216-C of the Materials
and Research Department, State oi California, Transportation Department, Division of Highways, or other approv-
ed test method.
b: The relative compaction from a plane five feet (Y) below the finish surface grade to said finish
surface grade shall be no less than ninety-five percent (95�0) as determined by the above testing method. Permit-
tee shall bear all costs and responsibility for compaction tests.
C. Material for use as trench backfill in any existing or proposed roadway section shall be sand, shall
be placed in 8" lifts, and be compacted to a relative compaction of not less than 955.
Material for use as backfill in roadside gutter excavations shall be the native material and be compacted
to a relative compaction of not less than )0%.
Any pavement cutting shall be scored, or saw cut before trenching.
Minimum depth of cover over all underground facilities shall be 30 inches, except drainage culverts.
All installations, parallel with roadway, shall be placed as close to the right-of-way line as possible.
No portion of the backfill(s) shall be compacted by ponding or jetting.
All pavements, curbs, gutters, side%%alks, borrow ditches, pipes, headwalls, road signs, trees, shrubbery,
and/or other permanent road facilities impaired by or as a result of construction operations at the construction
site(s), or at other ground(s) occupied by materials and/or equipment, shall be restored immediately upon back-
filling of ihe excavation to the original g.-ades and cross sections, and to a condition as good as, or better than,
existed prior to the construction.
All surfacing materials of roadways and drivewaY approaches cut or damaged bY or as a result of construc-
tion operations, shall be replaced within ONE, WFI-:K.following the backfilling of excavatioo, weather permitting,
with compacted layers of surfacing materials at least its thick as the existing, and no less than two inches
(2") of asphalt concrete over eight incites (8") of aggregate base, according to current California State Specifi-
cations.
9. Whenever -necessary to secure permission front abutting property owners, such authority must be secured by
the Permittee prior to starting �vork.
10. The future safety apd convenience of the traveling public shall be given every consitleration in the location
and type of construction: Permittee shall cause to be placed, erected, and inainta.ined all warniog signals, lights,
barricades, signs, and other devices or ineasures essential to safeguard travel by the general public over and at
the site of work authorized herein.
