Butte County was one of the first Counties to be digitally mapped by FEMA for their FIRMs. They used the Census Tiger Files for the location and names of all the roads within the County, which made the County absolutely, reject the initial maps in 1992, since the road and flood plains were drastically moved from the previous 1989 Series B FIRM. In some instances the roads had moved more than 600'from their previous location for no apparent reason. Most of the problems Were corrected prior to the publishing of the Series C FIRM effective June 8, 1998, adjustments were made to certain flood plain areas resulting in the issuance of Series D FIRM for certain panels on April 20, 2000. The Series C and D FIRMs depict a flood plain for Rock Creek and a location within that flood plain for Songbird. Lane; 'a copy of this area is attached for your ..reference. This would indicate to your lending institution that a portion of your property, and possibly your structure, lies within the flood plain (Zone A). In fact a structure is required by Federal Lending Regulators like FNMA, FHLMC, FDIC, FSLIC, to have flood insurance if a federally backed mortgage is made on a property in a Special Flood Hazard Area as shown on the FEMA FIRM. Since the Firm does not show the location of existing improvements, the normal practice for lending institutions is to require flood insurance if any portion of a property is shown as lying within a flood plain. In comparison, if you use the existing subdivision map or survey in the field you can easily demonstrate that the distance between the thread of Rock Creek and the centerline of Songbird Lane is sufficient to place your property and Songbird Lane outside the flood plain shown on the current FIRM, in other words the location of Songbird'Lane is incorrect on the FIRM. Unfortunately most lending institutions do not have direct access to this information. However, if the lending institution or FEMA were to overlay the digital FIRM on the USGS digital ortho quads, they would definitely see Webber FE?,M Page 2 of 2 May 8, 2002 that not only is your property outside the flood plain (Zone X), all of Songbird Lane is outside the flood plain. The determination to require flood insurance is totally up to your lending institution, FEMA provides guidance in making determinations but cannot tell them not to require the insurance. You may be able to obtain lower insurance rates if your Civil Engineer can provide an, Elevation Certificate showing the lowest floor of your structure is above the flood plain. Alternatives would be to have your Civil Engineer pursue a Letter of Map Change (LOMC) to remove your structure from the flood plain, or to request FEMA to review and correct the location of Songbird Lane,, either of which may'allow the lending Institution to not require flood insurance for your property.
