Non- conforming uses in Butte County are governed by Butte County Code Sections 24-35 though 24- 35.55 inclusive. These sections of the code provide for the replacement of a nonconforming use subject to the requirements contained therein. This applies to all nonconforming uses in Butte County. General Zoning Regulations and Procedures* 24-35.15 Continued use of a legal nonconforming use. Except as hereinafter otherwise provided, any use, building or structure, existing on the effective date of this chapter may be continued even though such use, building or structure may not conform with the regulations of the zone in which it is located. Provided, however, that such use must have been lawfully established and not in violation of any ordinance, statute or regulation in effect at the time. Furthermore, such use, structure or building must have been in existence at the time, not merely contemplated. Use permits, variances, building permits or other permits not exercised within the required time do not establish the right to a legal nonconforming use. Pursuant to law, the party asserting a right to a nonconforming use has the burden of proof to establish the lawful and continuing existence of the use at the time of the enactment of the ordinance, statute or regulation. (Ord. No. 3176, § 1(Exh. A), 1-24-95) Chapter 24 ZONING* Article II. General Zoning Regulations and Procedures' 24-35.20 Change or expansion of nonconforming use. Except as hereinafter otherwise provided, no nonconforming use shall be expanded, enlarged, extended, reconstructed, substituted, or structurally altered unless made to conform to the use standards and regulations for the zone within which it is located. Provided, however, that any nonconforming use may. be changed to another nonconforming use, expanded, enlarged, extended, reconstructed, or structurally altered upon obtaining a use permit from the planning commission. When considering a use permit for a nonconforming use, the planning commission shall grant the use permit when it finds that the change, expansion, enlargement, extension, reconstruction, or structural alteration of such use will not conflict with, impair or be detrimental to the uses both permitted and conditional of the zone in which it is located and/or adjoins. This finding shall be in addition to the findings required by section 24-45.10 of the Butte County zoning ordinance. Pursuant to section 24-45.15 the planning commission may impose conditions upon the issuance of the use permit which are reasonably related to the use of the property for which the use permit is requested. In addition the planning commission may at its own discretion establish a date for either the termination of the use or review of the use permit. Whenever a nonconforming use has been changed to conform to the uses, standards and regulations of the zone in which it is located such nonconforming use shall not thereafter be changed to a nonconforming use. This house did not receive final inspection and approval until ,June 19, 1992, after the Maffei permit to complete the house (92-1051) was issued on April 9, 1992. I believe the attached copies of the insulation certificate and correspondence with Mr. Maffei will answer most of your other questions. The owner and contractor were contacted several times in late 1981 and 1982 to try to 'get corrections made, but we were unsuccessful. I understand the final building Vallejo permit was never issued until June 19, 1992. FAX (415) 945-1318 From my discussion with Russell Bloomfield of your offices he .in- dicated that the building department had made numerous attempts e ` to contact the original owner Counsil in order to perform the final inspection and issue the final building permit. According to Bloomfield his review of the records indicate that there was no response by Counsil. It is my understanding the records were .�� then shipped to Oroville and basically stored until recently. 7-14171-73 Mr. Jim Glander June 29, 1992 Page Two I discussed the problems with the insulation in the attic of this house. According to Bloomfield this is foam type insulation. According' to Bloomfield it was not properly installed. According to Bloomfield the foam type insulation had started to deteriorate. I had asked Mr. Bloomfield if this foam type insulation was im- properly installed when the house was originally constructed. He claimed that it was. He claimed that they failed to put a foil/paper backing on this foam which would prevented its deterioration and spread. He also advised me that the new owners of the house Maffei had taken action to remove this foam type insulation. I asked Mr. Bloomfield if the foam type insulation had to be removed because it was dangerous or for some other reason. He indicated that was not the case. He indicated that the Maffeis could have mitigated their damages by placing batt type insulation over the foam type insulation. At that time I requested a letter from Mr. Bloomfield covering the above facts. I also requested the documents he had shown me concerningzithe various attempts to contact the original owner Counsil as well as the activities that led to the final building permit on June 19, 1992. He noted that he would have to discuss such with his supervisor. It is my understanding his supervisor contacted your offices in Orland. It was; finally agreed that I would have to request this information in writing from yourself. I am attempting to determine, the following: 1: Was a final building permit ever issued around the time of construction which was in 1978/1979? It is contended by the. assured that your employee Bob Henson did issue a final building permit. He indicates that the final building permit was used to obtain his final payment from Bank of America. 2: I would like to determine whether the foam type insulation put in the attic of the Maffei residence was illegal at the time. It is being contended by their attorney that such insulation was illegal at the time of installation. If foam type insulation was later prohibited from use I would like to determine the year and date such was pro- hibited for use. 3: According to my discussions with Russell Bloomfield he indicated that even back when the home was originally constructed he would not have approved the insulation as it was.. He indicated that it was not technically because the insulation was faulty but there was a failure to place a barrier such as a paper/foil barrier over this foam type insulation. I would like such addressed in any report I would receive from your office. 4: Per my discussions with Mr. Bloomfield he indicated that the foam type insulation was starting to deteriorate. I asked him if this meant that it needed to be removed. I would like an explanation of this addressed in your report. 5: Per my discussions with Mr. Bloomfield if the foam type insulation was installed in the sidewalls it was indicated that such would have been approved by him at the time of the original con- struction. I would like such addressed in any report sent to this office. 6: Per my discussions with Mr. Bloomfield he indicated that the insulation in the attic would not have been inspected until the final inspection. I would like such addressed in any report sent to this office. 7: I would like to determine if the Maffeis were instructed to remove;'all foam insulation from their attic by your offices. I was given the impression by Mr. Bloomfield that there was not a direction that they had to remove all foam type insulation from, their attic. I was: also given the impression by Mr. Bloomfield that there were other ways of handling this situation. I would appreciate it if such was addressed in your report. 8: I would like to be supplied with documents concerning the attempted contact with Mr. Counsil by your department. I would also like to be supplied with documents relating to the inspection of 87 Landmark Drive in Chico including the final inspection whether it was performed in the late 70s or performed in 1992. Any other supporting documentation that you think would be necessary for my investigation would be highly appreciated. Such information is being requested from your offices so we can respond to the attorneys who represent Mr. and Mrs. Maffei. Your help in this matter may prevent litigation in the future. The provisions of this section shall govern the require ments and uses of foam plastic insulation in buildings and structures. For trim, see Section 1705 (e). Except where otherwise noted in this section, all foam plastic insulation used in building construction shall have a flame -spread rating of not more than 75 and shall have a smoke -developed rating of not more than 450 when tested in the maximum thickness intended for use in accordance with U. B. C. Standard No. 42- 1. All packages and containers of foam plastic insulation and foam plastic M insulation ingredients shall bear the label of an approved agency showing either the flame -spread rating and smoke -developed rating of the product at the thick- ness tested or the use for which the product has been listed. The interior of the building shall be separated from the foam plastic insulation by an approved thermal barrier having an index of 15 when tested in accordance with U.B.C. Standard No. 17-3. The thermal barrier shall be installed in such a manner that it will remain in place for the time of its index classification based upon approved diversified tests. (b) Specific Requirements. Unless otherwise specifically approved as pro- vided by Section 1712 (c) or by other sections of this code, foam plastic insulation may be used as follows: 1. Masonry or concrete construction. Foam plastic insulation may be used without the thermal barrier described above, regardless of the type of construc tion, when the foam plastic insulation is covered by a minimum of 1 -inch thickness of masonry or concrete in a wall, floor or roof system. 2. Attics and crawl spaces. Within an attic or crawl space where entry is Y made only for service of utilities, foam plastic insulation shall be protected against s... ignition by 1 1/2 -inch -thick mineral f iber insulation, 1/a -inch -thick plywood, hard- ignition board or gypsum wallboard, corrosion -resistant sheet metal having a base metal �Q thickness not less than 0.0160 inch at any point, or other approved material installed in such a manner that the foam plastic is not exposed. 3. Cold storage construction.
