PHONE : 534-4601 Subject: Assessor's Parcel..'No. 047-25-0 0=27.-0 Dear Mr. Coutolenc: In reference to your letter of January 30, 1984 discussing the above Assessor's Parcel :number,. I will attempt to answer your. letter .point by point. It has beeii brought to the attention of'your tenant, Mr. Troy Wilkins, he has been operating a commercial business, specific ally an auto body and paint repair shop, contrary to County zoning ordinances.. This tiaras first noted by the Butte .County Building=Department on August 24, 1983 (see their letter of January 30, 1984). When you acquired the property in 1963, it was zoned A-2 (General). According to Planning Department records, in 1.966 you applied for and.we-re granted a Use Permit to allow the storage of fertilizers and agricultural chemicals as well as the above -ground storage of gasoline. That Use Permit was re -approved in 1967.: You subse quently completed the construction.of the fe.rtili.zer storage building on February 27, 1968.. At that time the stora-ge of agricultural chemicals and fertilizers on the property became an established us,'e in the A -2 -zone. Incidentally, the Planning Director at that time was Mr. Wing Fee Chan. The sto-ragc of agricultural chemicals and.fertilizers established early in 1968 could legally continue even though the zoning has now changed. Additionally, the A-2 zone in effect when .you bought the property allowed many other commercial rises without the necessity of obtaining a Use Permit. An auto. body repair shop, however, is a use which requires a Use Permit in the A-2 zone. The SR -1 (Suburban Residential, 1 acne minimum) zone adopted in 1.981 does not allow commercial uses such asauto body shops. The zone allows one single family dwelling per parcel and some 0 ��. Coutolenc Page 2, February 8, 1984 agricultu-ral uses subject to various :restrictions: In addition, any use legally. established prior to the imposition of the SR -1 zone and still in operation at the time of zoning couldcontinue within the SR -1 tone. A search of the Planning Department files has .revealed no.'applicationsfor auto .body shops in the t�i.nte period when the property was still zoned A-2. Therefore, it does riot appear that the auto body shop was l.egally established prior to 'the. 'rezoning of the land. to SR -1 .on January .20, 1981 Addition- ally, according to site. *plans on file in the .County Building Depart- ment, it .appears that the body shop is being operated'oiit of the building. that was approved for the storage of fertilizers. Since Mr.. Wilkins does no.t reside on the property, he does not qualify as a Home Occupation. Therefore, for -you and Mr. Wilkins to operate within the provisions of the Butte County code,_ it will be necessary to either discontinue operation of the. -auto body and paint shop or to obtain a rezoning.toeither C-2 (General Commercial),. L -I (Limited Industrial), M-1 (Light.Industrial), or.M--2.(Heavy. Industrial). In order for the Butte. County Board of Supervisors to legally adopt.such a zone on . your property, it would be necessary for them to: find that zone in conformity with the Butte County General. Plan. The Butte County General Plan indicates that agri- cultural. and residential uses are the only uses appropriate for this particular -area. While you may apply .for a General.Plan Amend- ment to Commercial or Industrial :Eor the.subject property,. the text of the General Plan indicates that such a designation wou:Ld.not be appropriate in this area. As a property.owner you may make applica- tion .for any general plan designation and zone that you wish; h.ovwever, you should.be aware that it is doubtful that such applications.would be_successful. For your information the filing fees for a General Plan. Amendment and Rezone would total $654.00 and the processing time would be at least four months. It is also likely that an environ- mental impact report (EIR) would be required. If. so, additional fees and processing gime would be. -required. When the issue,originally came up by way of a visit from your Chico based building inspector to my -tenants place of business, I called your Oroville office and discussed the matter, I believe, with Mr. Glander.. Mr. Glander, during the.course of that telephone conversation.was unable to tell me the purpose of the inspection, what the inspector was seeking to find, or in general the purpose of the inspector entering the premises. He made some references to statutes, codes, and stated that there could be "thousands of things the building inspector could be looking for." I indicated to him during the course of that telephone con- versation, that I was reluctant to give anybody blanket authorization. to inspect property owned by me, unless tliey could clearly indicate to me what specifically they were looking for, what lead them to believe there were violations, and provide me with some general outline by what circumstances would insue in the event violations were observed. To date I have not had any subsequent communications on this matter from you, your office, or via Mr. Wilkins, my tenant. In the absence of any further communications from your office I considered the matter closed.
