Commissioner Lynch said the other problem is.the creation of two dwelling units on "the;'

It'.was moved by Chairman 'Forbes; seconded by Commissioner Lynch, and unanimously',
carried for -denial as follows,
A. Note that the project is a Class 5(a) (Variance to setback) Categorical Exemption; and

Zoning Ordinance; and
C. Find that the proposed variance does not comply with Butte Caunfy Code. Section U-
40, thaf there are no special :circumstances applicable to the property including" size,
shape, topography, location, or surroundings, and the strict application of this chapter
does not deprive such property of privileges enjoyed by other, property in, the vicinity°

'Information:
on the above mentioned property 'there are two structures and
three living units: Structure (1) is the main house which has an
apartment converted from a garage with permits in 1965-66 and
purchased by, Mr. Florio in September of 1,971 is not an issue at
this .'living Unit,(Structure 2)- a detached garage
time: Thethird
and Studio Apartment which is the issue.
History:
July 6., 1976:
Mr. Florio applied to the Building Department for ;application to
convert a garage toe studio. The permit was issued July 12 and
the building ;inspector went to inspect- it on. July 23rd. His
inspection revealed the work had been completed and contained
another living unit, making three on the property.- -
Se tember 28, 1:989:
I called a meeting with Mr: Florio. for a pretrial hearing. At
the meeting a discussion was had with Planner Dave Hirvnimus as
to the aiternatives Mr. Florio could. seek. There were Four
options mentioned (;see attached note): At the end of the meeting
the only major differences were the time extension:Mr. Florio
I to `enact one of the options and when the structure mas
converted to a living unit. The County, is. suggesting 90 days
Which `woul'd allow, Mr. Florio enoughtime to apply for building
permits; use permits or application to the'City'of Chico. Mr:
Florio is requestixg Six Months so he can give the person renting
structure number (2) time to relocate.
As far as when the 'conversion took place the above mentioned
notation of the building Inspector and a conversation x had with
'assistant Assessors Ken Reimers who stated the assessors records
show-the first notation of the garage conversion (number 2
structure); is on 2-;2;--77, when an assessor went to reassess
structure, `number (1 ) for its remodeling .
