Located near the south edge of Paradise; the project site lies within critical winter range of the Bucks Mountain deer herd and supports oak - chaparral habitat in an area known to harbor sensitive plant species. Since the TPM lies within a Desigeated Development Zone, DFG does not object to the land division provided that appropriate mitigation measures are imposed as conditions of approval on the firtal Parcel Map: Those measures include: 1. Assessment of deer habitat improvement fees, 2. Fencing to meet approved standards Oak woodlands are a particularly important habitat because they provide most of the essential life 'sustaining requirements (e.g,,j food] shelter] testing and roosting sites) needed by wimerous animal species. There has been significant cumulative :losses of oak woodlands in California due to residentialr commercial; and other, development projects. To mitigate the project npacts on, oak woodlands] these restrictions are needed! 1. No oak tree removal except for that required to provide space for buildings and associated accessories and to meet health and safety standards. 2, Establish a no disturbance setbackj commencing from the outer edge of the oak tree canopy and extending outwtird a distance equal to one -Half of the canopy, radfusr around each tree. No disturbance includes irrigation and root damaging activities. 3: Retain all snags except those which pose a, direct safety hazard, Mr. John Mendonsa September 13, 1991 Page Two 4. No pruning or cutting of oaks except for safety purposes. Deciduous .oaks should be pruned during the, winter dormant season only and evergreen oaks during July - August only. This project site contains the habitat types known to Harbor sensitive plant species which have been found in that general: area. A botanical survey should be made by a qual,fied botanist during the appropriate season to determine if such species do occur onsite. if present, sensitive plant populations should be protected by; 1. Establishing a 50 -foot minimum no disturbance setback, commencing from the outer edge, around each plant population. 2. Constructing barriers to prevent damage by foot and vehicle traffic. 3. Excluding livestock. 4. The present zoning is FR -5 (Foothill Recreational, 5 acre parcels) and AR -MH -1 (Agricultural Residential, Mobile Home, acre parcels). The Land Use Plan. A mixed survey strategy was employed, The upper half, of the property (i.e. to the east of the rim of Dry Creek Canyon) is fairly level and. clear of underbrush, and it was surveyed by means of a systematic strategy of parallel transects spaced betwe�-,'n 10 and 15 meters apart. The part of the property that drops into the canyon exceeds 30% slope, and 'is densely overgrotan Kith manzanita, ceaflothus, and poison oak: The actual mid -slope Is of relatively low archaeological sensitivity, but the bottom of the canyon along the creek is sensitive with respect to the presence, in places, of bedrock mortars.
