Dear Mr. Pierce:
Thank you for following up with your friend, the owner of the property regarding his plans to
proceed with the Ag Exempt Building Permit.
After your phone message, I reviewed the refund application and consulted with the Buiding
Official and determined that besides the refund processing fee of $54.99 we spoke of, there were
other applicable charges for work performed on the permit application. Unfortunately, charges for
file set up and plan check, even applied at minimal rates/times (15 minutes each at our old rate of
$109.98/hour) leave no balance of funds to refund.
So, Lobster is out, now hamburgers too! I guess it is the cheese line and soup kitchen ... Thank
you Allan for your sense of humor. I am attaching the calculation sheet showing how the fees were
applied, hopefully your friend will reimburse you for your expenses in paying for his permit
application.

REFUND POLICY - Butte County Code 3-41(t)
1. Refunds can only be made upon written request by the person who paid the fees, whose name is on
the receipt issued for the fees paid. Any refund checks will be made payable to the name on the receipt.
2. The request must be made within two years from the date of fee payments on permits not issued, and two
years from the date of permit issuance for permits issued - if no construction work has been done.
3. Filing fees and plan check fees for work plans checked are not refundable.
4. Fees paid to other County Departments are not covered by this claim.

Alice, just wanted to make you aware of an odd situation. Evidently a friend paid for a permit
for an Ag Exempt Bldg on 8/10/06. He wasn't aware that the friend had code violations on his
property and couldn't obtain permits. The friend, Alan Pierce, applied for a refund on 7/13/07
on that basis.
In speaking to Scott Rutherford, he determined that the owner could build, as the violations
weren't related to a building. Scott hadn't yet called the owner about this when Alan called
regarding the status of his refund.
Alan was told that he would be charged a refund fee and perhaps a small file set-up fee and/or
plan check fee. His refund wouldn't be much.
After consulting again with Scott, Alan was informed the owner could build per Scott's
determination, yet the permit was almost 1 year old. (Scott said Ag Permits didn't expire. I
asked Scott what happens when Ag Building Codes change, would an non -expiring ag exempt
permit allow this owner to build regardless of code changes? Scott admittedly didn't think
about that yet, so we came up with the following.)
Owner may build the Ag Exempt building under this permit if he does so within 1 month. Alan
will tell owner this and notify me whether or not I need to continue in processing the refund,
because he didn't believe the owner was willing to "come up" to do that within the next
month. I explained we were reviewing our Ag Exempt Bldg policies and anticipated changes in
code could prohibit or cost owner more money for a future permit should he decide to reapply
at a later date (rather than build with this permit).

Dear Mr. Law:
Through our courtesy notice on August 19, 2003, you were notified pursuant to Section 41-2 of the Butte County
Code of the presence of code violations on your above -referenced property. According to our records, the courtesy
notice has not resulted in abatement or correction of the following specific violations:
1. The accumulation of junk in public view.
2. The accumulation of garbage for more than seven (7) days in public view.
3. The keeping of inoperable vehicles in public view.
Your failure to eliminate the stated violations are cause for the issuance of this formal warning notice.
As of this date, our records indicate that the following violations to the Butte County Code still exist:
Butte County Code, Chapter 24, Section 24-190 - TM -5 (Timber Mountain) zone does not
"specifically authorize" large accumulations of junk. The storing of more than 100 square feet of
"junk" on a parcel is one of the items used to determine that a "junkyard" condition exists. A
"junkyard" is not an allowed use in the TM -5 zone without a Use Permit. "Automobiles and other
vehicles, dismantled, in whole or in part" are considered to be "junk." Chapter 11, Section 11-4
forbids people, whether at a licensed junkyard location or not, from storing junk in public view.
• Butte County Code, Chapter 31, Section 31-50 - The owner or tenant of any premises, business
establishment or industry shall be responsible for the satisfactory removal of solid waste
accumulated on said premises. To prevent propagation, harborage or attractiorboj,flies,.,rodents or
r other vectors and the creation of inert material,
shall not-be.allowed to remain on the premises for more -than seven (7) days.
Non-flammable inert materials stored on a premises shall not be allowed to become either a
harborage for rodents, insects or other vectors, nor a public nuisance. Such inert non-flammable
materials which are not properly stored shall not be allowed to remain on a premises for more than
thirty (30) days.
The determination that this violation exists on the property.is based on the following definitions in the Butte County
Code:

Butte County Code, Chapter 24, Section 24-305.240 - Junk. Any worn-out and discarded material
in general that may be turned to some use including, but not limited to, any old iron, wire, copper,
tin, lead, rags, paper, bags, lumber, empty bottles, bones, parts of bicycles, tricycles, baby
carriages, automobiles, and other vehicles, dismantled, in whole or in part, kept, stored, located,
situated or piled in public view, and all other similar personal property ordinarily defined and
classified as "junk" kept, stored, located, situated or piled in public view and not screened from
public view by a fence.
• Butte County Code, Chapter 24, Section 24-305.170 - Garbage. "Garbage" means every
arrunnila1ion of animal or vegetable waste, matter that attends or results from the preparation,
consumption, decay, dealing in, or storage of meat, fish, fowl, fruits, vegetables or other food
products and shall include any food container in which there is putrescible material either solid or
liquid.
• Butte County Code, Chapter 24, Section 24-305.370 - Rubbish. "Rubbish" shall mean all
nonputrescible solid wastes, combustible, or noncombustible, including, but not limited to, paper,
cardboard, yard clippings, grass, ashes, wood, bedding, crockery, glass, metal and other similar
materials, excepting compost boxes.
• Butte County Code, Chapter 24, Section 24-305.360 - Refuse. "Refuse" shall mean and include
any solids or semi-solid waste other than domestic sewage, including, but not limited to, garbage,
rubbish and trash.
In order to bring the property into compliance with the Butte County Code and avoid further enforcement actions,
you are hereby requested to take the following abatement or correction actions:
1. Remove all garbage, rubbish and refuse from your property and maintain a regular removal
schedule in accordance with Butte County Code, Chapter 31, Section 31-50.
2. Remove all "junk" in accordance with the Butte County Code, Chapter 24, Section 24-305.240.
3. Remove all inoperable/junk vehicles from the property.
This is your final warning. Unless you contact this office and make the proper arrangements to correct or abate the
violation(s) voluntarily, within ten 10 days from the date of this letter, enforcement shall be pursued through the
issuance of a citation (ordering you to appear in court) for said violation(s) and for failing to comply with this
warning letter.
Upon conviction of said violation(s) or of failing to comply with this letter, the court shall impose penalties (fines)
and a Notice of Violation shall be recorded in accordance with Butte County Code Section 41-7. The Notice of
Violation will include a description of the premises the violation concerns, a description of the violation, the date of
your convictions and the action necessary to correct or abate the violation(s).

BUTTE COUNTY ORDINANCE 41-10
(A) Refusal to Issue: Upon recordation of a notice of noncompliance or a notice of
violation, no department, commission, committee, officer or employee of the
County of Butte shall issue or approve permits, licenses or other entitlements
involving the property to which the noncompliance or violation pertains.
(B) Exception: Subsection (a) above shall not prevent the issuance of permits,
licenses or other entitlements necessary to correct or abate the noncompliance
or violation.
(C) Termination of Refusal to Issue: The refusal to issue pursuant to subsection
(A) above shall terminate when a notice of compliance has been recorded as
to any and all recorded notices of noncompliance or violation.
(D) Waiver: The director of the affected department may waive the provisions of
this section regarding refusal to issue if he or she determines such waiver to be
required to allow necessary or desirable remedial, protective of preventative
