Department of Building Inspection Butte County 196 Memorial Way Chico,CA 95926 Gentlemen: March 1,1988. During carrying out a transect for timber typing along Big Chico Creek I came across a mining site located on BLM land at T 24 N, R 3 E, sec 8, adjacent to Big Chico Creek. he site has two extremely dilapilated structures; one presumably for li- ving quarters and the other.Jor storage. Upon checking with the BLM office in Susanville, I was informed that when building on BLM land in Butte county the appropriate building codes apply to any structure including inspection of the construction. I am asking for information about the licencing and inspection of the above structures. When it was done and under what circumstances? As a homeowner and taxpayer in the county I expect that the rules apply uniformly and no person is exempt. If the structures have been constructed illegally then I would like to know what actions are planned by the county to get rid of them as soon as pos- sible? I assume that laws and regulations are not only passed but also are enforced without exception. With appreciation of your consideration, Sincer ly, L is . Mihalyi P.O. Glander Butte County Department of Public Works 7 County Center Drive Oroville, California 95965 Dear Messrs. Cheff and Glander: Re: "Dilapidated Structures" on AP# 56-20-11 A review of our records indicates that Robert Miller, et al., own the "Mini Ha Ha" unpatented placer mining claim in T. 24 N., R. 3 E., Section 8, SW1/4, M.D.M., Butte County, California. There are at least two structures on this public land which reportedly date back to the 1920's. Robert Miller and associates have recently mined this property under the authority of the 1872 Mining Law, as amended. Their use and enjoyment of these structures for mining purposes may be authorized by said law. You may find more details out about the Mini Ha Ha minTng-,claim and its owners by reviewing the records at your County Recorder's Office. We intend to continue to work with Mr. Miller and associates in managing the surface of this public land so that they are in conformance with Federal laws and regulations. This will be done as time and funding allows. Butte County is encouraged to exercise its rights to regulate and permit uses on unpatented mining claims as recently defined by California Coastal Commission v. Granite Rock Co., No. 85-1200 (S. Ct) and by the California Surface Mining and Reclamation Act of 1975. Any questions on this matter should be addressed to Ron Rogers, our geologist, at (916) 246-5325. Sincerely, Mark T.
