One of the conditions is: "Verify legal access to the parcel from a publicly maintained road". The reason that this condition was placed on the Conditional Certificate of Compliance is that the access easement deeded to you stated in part, "over an existing road". Since it is impossible to positively state that the existing road is now in the same location as when the deed was written, or will be in its original location at some time in the future, Butte County does not accept this type of description as providing legal access. Mid Valley Title Company has submitted a deed to this office that shows that you have purchased AP 56-20-21, which lies immediately north of AP 56-20-24. Since you now own the parcel through which your access easement runs, you may be able to meet the condition for legal access by deed at the time of a sale, recording of a map, or change of ownership. He is now taking the steps to satisfy the conditions. County employees are not allowed to issue permits on a property that is in non-conformance, such as Mr. Salvagnos. However, under Butte County Code section 41.10 (b): (b) Exception: Subsection (a) above shall not prevent the issuance of permits, licenses or other entitlements necessary to correct or abate the noncompliance or violation. The County must issue permits directly related to making his property conform to County regulation.
