Dear Mr. Salvagno,
The Butte County Department of Development Services, Planning Division, has reviewed the
submitted Environmental Health Permit. The subject property was issued a Conditional
Certificate of Compliance on July 3, 1985. Your parcel cannot be built upon until the conditions
are satisfied. Please review the conditions included with this letter.
Environmental Health will evaluate the parcel, and sign off on the first two requirements,
regarding sewage disposal and domestic water. The Chico office can be contacted at
(530) 892-2727.
Land Development is your contact for the second two requirements. They have informed
me that you will need to work with your title company to reserve easement rights for the
property within the deed. The easement must connect to a publicly maintained road,
physically exist and be a minimum of sixty (60) feet. Their office can be contacted at

Dear.Mr. Salvagno:
On July 3, 1985, a Conditional Certificate of Compliance was issued to you
for AP 56-20-24. One of the conditions is: "Verify legal access to the
parcel from a publicly maintained road". The reason that this condition
was placed on the Conditional Certificate of Compliance is that the access
easement deeded to you stated in part, "over an existing road". Since it
is impossible to positively state that the existing road is now in the
same location as when the deed was written, or will be in its original
location at some time in the future, Butte County does not accept this
type of description as providing legal access.
Mid Valley Title Company has submitted a deed to this office that shows
that you have purchased AP 56-20-21, which lies immediately north of AP
56-20-24. Since you now own the parcel through which your access easement
runs, you may be able to meet the condition for legal access by deed at
the time of a sale, recording of a map, or change of ownership. You
should contact your title company regarding the manner in which legal
access could be obtained by deeding.

Re: Salvagno's Conditional Certificate of Compliance
Gerald Salvagno, in 1985, was granted a conditional certificate of compliance. He
is now taking the steps to satisfy the conditions. County employees are not allowed
to issue permits on a property that is in non-conformance, such as Mr. Salvagnos.
However, under Butte County Code section 41.10 (b):
(b) Exception: Subsection (a) above shall not prevent the issuance of
permits, licenses or other entitlements necessary to correct or abate
the noncompliance or violation.
The County must issue permits directly related to making his property conform to
County regulation.

Application for Determination
At the regular meeting of the Subdivision Violation Committee held
on May 1, 1985, the committee granted a conditional Certificate of
Compliance for the above -referenced property. The conditions are.;
1. Provide satisfactory evidence that a suitable site for the
installation and replacement of a sewage disposal system for a single
family residence exists on -the property.
2. Provide satisfactory evidence that domestic water is available on
the property adequate for a.si.ngle family residence.
3. Verify legal access to the parcel from a publicly maintained road.
4. Provide traversable access to the parcel.
There is a fifteen -day appeal period before this Certificate can be recorded
unless the enclosed waiver is signed and returned, waiving your right to
appeal the committee's decision. If the conditions are cleared prior to•the
end of the appeal period a "clean" certificate with no conditions will be
recorded. Any appeals must be made in writing to the Clerk of the Board of
Supervisors.
