In regards to the clean-up of the Cohasset property on which
you sent us a citation for non -permit buildings and health
hazards, I recently sent you a letter describing what I had
accomplished to correct the matter.
Since my last letter, I have been down with the flu and then
back problems. I am just now able to be up and around thus
I have not been able to do any physical work. The doctor
recommended that I not lift weight greater than 25# which
would not allow me to remove the remaining materials at this
time.
One iof the local trailer people, after inspection of the
mobile home stated,.its salvage worth does n6t warrant the
cost df removal. When it was located on site, it was pushed
in over some skid or else erosion has removed some dirt from
under it. He recommended that I remove the roof and walls
to both reduce its weight and size, then the rest could be
removed or cut up for metal salvage. This is•what I will do
when I am able.
I do guarantee that what remains is unliveable and unless
someone squats on the few open spots, no-one will live
there. I will keep you up-to-date. We will be out of state
for the next 6 months, but I will see to the completion of
clean-up when we return.

We. sent you a warning letter dated July 21, 1992 notifying you that you
are in violation of the Butte County Code at the above referenced location.
As of this date, the following violations still exist.
Failure to obtain the required permita,.inspections and approvals from
this office for utilities for travel trailer, cabana and r8mada in
violation of the Mobilehome Parks Act of Title 25, California Code
of Regulations adopted by Section 28A-1 of tfP Butte County Code as
follows:
(a) 1018 -Permits Required for any Plumbing or Electric
(b) 1.04€3 -Inspections Required for any Plumbing or Electric
(a) 1018 -Permits Required for any Mobilehome Accessory Structure

The above violation(s) shall be corrected or abated by you by submitting
three (3) complete vets of plane, applying for the required permits, and
paying the appropriate fees, including, penalties, within thirty (30) days
of the date of this letter. After permit issuance and field authorization
to proceed, the work must be completed and approved by this office within
the permit specified time.
Unless the violation(s) is (are) so corrected or abated, a citation shall
be issued to you to appear in court for said violation(s) and for failing
to comply with this notice. Upon conviction of said violation(s) or for
failing to comply with this notice, penalties shall be imposed and a Notice
of Violation recorded in accordance with Section 41-7 of the Butte County
Code.

Butte County Code at the above referenced location as follows:

by our field inspector to proceed. This field authorization cannot be made

Please be aware that Butte County has entered into a Code Enforcement Program
that seeks voluntary compliance with the Butte County Code but provides
an effective means of enforcement if such compliance is not obtained. If
voluntary compliance is not obtained, enforcement will be pursued through
the issuance of citations, fines, and the recording of a Notice of Violation.

My letter dated 11/9/93
Dear Mr. Viera:
On 19-22 January and 24-25 January, 1994, I spent time up at our Cohasset
property. In that time I accomplished the following tasks:
1. Removed 70% of the large roof area that covered the main trailer unit,
the two 8 X 10 side rooms, and the large 12 X 15 side room that was of
wooden construction.
2. Removed 85% of the add-on room leaving only the floor joists, several
wall supports, and small portion of roofing.
3. Cleaned most of the residue filth and trash from the inside areas.
4. Cleaned up most of the trash in the near vicinity of trailer unit, there
is still some wall and roofing material on ground waiting to be hauled away.
5. Filled two each 20 cubic yard roll -off dumpsters full of lumber, filth
and trash. I had to stop work because the snow and wet roads stopped the
removal of another dumpster.
While I was there January 22nd, a son of the former resident,'Joann Shanks,
came by with some local friends to see what I was doing. He said I had no
right to tear down his home. I explained to him the reason I was there and
the right I had. When I was absent on the 23rd, someone came and broke all
the windows and glass doors, stripped some of the panelling off the interior
walls, rammed a steel pipe through the outside skin in several places,
tipped over the few remaining appliances and then shot holes through the
appliances and side of trailer with both a gun and shot gun. I did report
the damage to the Chico Sheriff Office. I talked to Dave Martin on 1-24-94.
He said that since the trailer was purchased and owned by the Shanks, it
would be hard to have a case. He did say he would file a report. My
question is if they really own the trailer, why were they not required to
remove it? And how or where do we get permission for removal without proof
of ownership? The removal of the roof and malicious damage has removed the
possibility of someone moving in without yours or our permission and
knowledge.
As my schedule and weather allows, I will return and complete the necessary
work to remove the rest of the roof and room so that the trailer unit can be
moved. I have made several inquiries about someone who could come and
remove them for salvage. The malicious damage has removed the possibility
of someone using it as a storage unit.
I will keep you in contact as I proceed to clean up the property and remove
the mobile home. Thanks for your indulgence.

This letter is in response and at your request during our telephone conversation - #A.
I would like to state that my wife and I have been away the past 131 months doing
volunteer work in West Chicago, Illinois for Wycliffe Associates (a layman's ministry
which supports 'Wycliffe Bible Translators). We were not aware of the deplorable
conditions of the #D property or that the Shanks were found guilty of this #C
violation on April 20, 1993.
We have tried to rid the Shanks from the property but were delayed in this action
because of their bankruptcy proceedings: After their neglect to continue to uphold
the bankruptcy conditions, we foreclosed. Foreclosure was completed on 1/7/93. At
our request, Butte County served Shanks with an eviction notice on 5/7/93 after we
determined they had not vacated the premises. This date is much later than the
"Owner of record as of 1/5/93" indicated on #C. I would have liked the County at
the serving of the eviction notice to require the Shanks to clean up the property.
Since we were not the occupants of the referenced property on 4/20/93, then we should
not be subject to the $300 fine.
In the six month period that we will be home in California, we will make arrange-
ments to remove and clean up the trash and filth. I have written my son who lives
in Chico but works in southern California, for names of people who could help me
get a dump truck that can traverse Mud Creek Road and remove said material. Like-
wise obtain some vehicle to pull the mobile trailer out for disposal. Do we need a
permit for disposal of the trailer or is there a site for such disposal?
I have also written a letter to CDF in the Chico area about what material could be
burned on site with a valid fire permit without a violation of environmental conditions.
Because of prior commitments through the end of 1993, I request permission to delay
the start of the clean up until after the first of 1994 or in case of heavy winter
storms, the first opportunity to reach the property after that date.

Dear Mr. Vieira:
Please find enclosed a check for $300 (three hundred dollars) to pay
the fine enforced on our property on October 21, 1993.
The only reason we are paying at this time is because we want to sell
the property and be rid of the whole problem we have had there. It
is our understanding that the property cannot be sold without removal
of this citation against the property. The buyer - Soper Wheeler
Lumber Co. - has agreed to complete the clean-up process begun by us.
They have indicated to us that their office has been in contact with
your office regarding this fact.
It does not seem fair though that Mr. David Shanks, the person who
was given the citation, is not the one who has to pay it. But then
knowing all the problems we had with him in paying us for the
property or for following through with the bankruptcy court's
instructions to pay us back payments as well as the monthly amount to
bring him current and then to have to foreclose, as well as having to
pay to have him evicted from the property months after he was to
vacate, it does not surprise us that we have had to foot his
responsibility!
I guess that is what is known as JUSTICE?

Soper -Wheeler Co. has completed the purchase of the Lyons' prop-
erty on Mud Creek road, Cohasset. As you and I have discussed in
the past, Soper -Wheeler Co.'s•plan is to continue the cleanup of
the property,in-fall•or early -winter when.open•burning can be
done. I will notify you when the job is done.
In June the Lyons sent you a check to cover the enforcement fine.
Will you please cash that check and have the County Treasurer
hold the funds pending our final cleanup work?
